Funding needs to reflect suburban growth and demographic changes that outpace the region. Legislative Priorities (STA) –Priority 1: Increase MVST to 6.27% •In 2001 state transit funding shift from property taxes and 2006 Constitutional amendment that increased MVST in the region without providing the STP’s in statute any of the funding resulted a funding model that did not account for suburban growth. •In 2017, STP’s received a MVST cut from the Met Council for MVST not in statute, which has led to challenges with preservation of services and state of good repair. –Priority 2: Allocate all current and future Federal Allocations using 5307 Federal Funding Formula •Require MPO to distribute federal funding utilizing the same methodology as CARES Act and CRRSAA. •American Rescue Plan (ARP) Act signed into law in March 2021 -$313M Met Council has still not allocated funds to Suburban Providers. -Bills introduced SF2135 Osmek, HF 2374 Masin (Bi-Partisan Support) Minnesota Valley Transit Authority | Transit Update EAGAN CITY COUNCIL | March 2022 Planning for the Future Systemwide Study –Currently in the midst of a systemwide study examining an upgrade to our route services that factors in potential changes coming out of pandemic. –Study examining reverse-commute options to meet employment needs in suburbs. –Feedback on future routes currently being accepted through April 15. Shelters to include customer safety features and amenities, MVTA branding, and variety in size and cost. –MVTA is pursuing grant funding via Dakota County’s CIP, in 2022, for shelter expansion (stop locations that currently only feature a bus stop sign). •Stop locations to be prioritized based upon ridership, surrounding customer foot traffic, equity data, and current/potential future routes. PRESENTATION ON EV CHARGING INFRASTRUCTURE AND RECEIVE PROPOSAL BY ENERGY MANAGEMENT SOLUTIONS (EMS) AND CARBON SOLUTIONS GROUP (CSG) Action For Consideration: To receive a presentation by staff and the companies that are looking to create a twin cities wide EV Charging network of electric vehicle charging infrastructure. Give direction to staff on possible future contract with EMS and CSG on providing a citywide infrastructure program for the city. Facts:  In mid-2021, EMS and CSG started discussions with several cities in the Twin Cities area regarding a no cost, comprehensive EV charging infrastructure option. The City of Plymouth was the first city to contract with these organizations in late 2021. Recently New Brighton has contracted with them for EV charging infrastructure needs.  Additional cities receiving proposals and looking to be a part of the larger charging network with these organizations include Apple Valley, Lakeville, Golden Valley, Maple Grove, Eden Prairie and Eagan.  The City of Eagan had EMS provide a presentation in December to the Eagan Energy and Environment Advisory Commission as a first review of the opportunity. Good conversation was had, including the commission asking staff to look at some additional options for the increase in EV infrastructure development in the city.  Staff was unable to find comparable turnkey solutions of this magnitude that will provide solutions for EV charging ahead of the demand as more and more EV’s are purchased in Minnesota. In addition, new federal stimulus money is yet to be determined on how much and how the money could be distributed and to who will receive and distribute funds.  A proposal for developing this infrastructure was received in January from EMS and CSG for consideration by City Council to move forward with this no cost option. In short, the proposal includes the following: 10-year commitment of renting parking spaces throughout the city at facilities and park locations for up to 64 charging lines (32 total units) with option of another 10 years of renewal. Total revenue over 10 years for city is estimated at $248,000 for the rental of spaces and share of charging revenue. Another $362,000 of revenue is estimated to be received for the second 10 year period if the City extends the contract. All installation, material and other costs and rebates to be coordinated, incurred, and received by EMS and CSG. Over the life of these units it is estimated the City will save $2,933,650 on costs to purchase, install and maintain a similar infrastructure. Proposal includes a blend of fast charging units where use would be shorter time periods (significant charge in about 30 minutes) along with level 2 units where they make more sense (6 – 8 hour charging time to accomplish significant charge). Prepaid lease for two electric vehicles for city use, where the city will have the option to purchase at the end of the lease (5 years).  With recent Federal Stimulus funding through the American Investment Act and Build Back Better Act, there will be funding specifically for charging infrastructure over the next several years. The challenge the city has is that we do not have staffing currently nor anticipated in future years to apply for this funding, contract with companies to install and manage, and ultimately carry the ongoing expenses of maintaining the units.  The city currently has two level two, dual charging units at City Hall and ECC. We would propose maintaining these to be owned by the city and used for charging of current and future city fleet EV’s.  Staff desires feedback from Council on where our elected leadership would like to see the City’s participation with EV infrastructure over time and if this turn key solution would make sense for Eagan. Attachments: (4) IV- 1 Staff presentation introducing EV Infrastructure program IV-2 Conclusion presentation and policy questions IV-3 Presentation by EMS IV-4 Proposal from CSG CITY OF EAGAN EV Charging Infrastructure Proposal Introduction •EV infrastructure has been a discussion among cities in recent past, including in Eagan.•Two companies have come together to present a turn key, solutions-based program for EV charging in cities in MN.•Energy Management Solutions and Carbon Solutions Group have worked with cities of Plymouth and New Brighton, and currently working with Eagan, Lakeville, Apple Valley, Golden Valley, St. Louis Park and others currently in proposal phase.•Sustainability plan and Greensteps Cities compliant Details of program •EMS works with city to identify parking spots to be rented True turn-key solution –no work to be completed by city staff, and no costs to be incurred by the city on this infrastructure development. •Revenues to be received by city for rent and revenue share is estimated to be $600,000+ over 20 years. •Displaced cost of infrastructure and maintenance over this time is more than $2,933,650 that the city would not be paying. Positive considerations of program •True turn-key solution –no work to be completed by city staff, and no costs to be incurred by the city on this infrastructure development. •Having an immediate charging solution for EV owners now allows for greater consumer confidence in purchasing EV’s in your local community. •Money generated by EV program can be used to reinvest in additional sustainability program costs. •Staff resources needed to operate this system would be minimal. No need to follow up on maintenance issues, nor would there be financial management needing to occur with the charging units. Possible negative Considerations of program •Some cities have been concerned that rates being charged reflect on them and that public may not use chargers •Advertisements on the controllers would be at the discretion of EMS and CSG •Unknown at this time how additional federal funding will be distributed for EV Infrastructure development across the country (American Investment Act and Build Back Better Act) EMS presentation •Will now switch to EMS to go over the current proposal by CSG for charging infrastructure in Eagan. •A conclusion and policy questions will be gone over after their presentation is complete and questions are answered. In conclusion – Although there may be other solutions to be available in the future for EV charging infrastructure development, staff appreciates the consideration of this proposal as a lowest impact to city staff resources and maintenance/management over time to accomplish a similar goal. Rental Licensing Direction for Consideration: Provide direction to staff regarding the rental licensing communications and engagement plan and ordinance provisions. Background The City of Eagan currently has approximately 8,730 registered rental units which is 29 percent of the City’s housing stock. Rental housing includes 6,617 rental apartments, 716 rental townhomes, and 1,426 single unit rentals. Single unit rentals are units which were constructed as ownership units but are currently rented. At the November 9, 2021, City Council Work Session meeting, the Council directed staff to proceed with developing a rental licensing program. A schedule outlining tentative milestone dates for program development is attached. The rental licensing program is scheduled to be activated on January 1, 2023. The schedule may be adjusted based upon stakeholder input or other unanticipated factors. Communications and Engagement Plan Communications and Engagement will be partnering with Community Development and City Administration to create and implement a communications plan. The plan will have a multi-phased approach including: o discovery and socialization, o engagement, o education and impact, o Implementation, requirements, and compliance. Phases of the Communications and Engagement Plan Phase 1 - Discovery and Socialization: Kickoff a Discovery and Socialization phase in early April which will include a front end communications element to inform the upcoming conversation of the potential current deficits, needs, and benefits of a rental licensing program. Content will be developed to educate the community about housing stock and focus on safe housing. Phase 2 – Engagement: In the spring of 2022, we will engage the community through a digital survey, which will be followed by guided-facilitated conversations with stakeholders and interested parties to gather input around rental licensing.  Phase 3 – Education and Impact: In late summer of 2022, we will focus communication efforts on education and the impact of rental licensing, and key aspects proposed in Eagan’s rental licensing program. Key messages may include findings and feedback from engagement efforts, success stories from neighboring communities along with intended benefits of licensing in our community: public safety, equity, and maintenance of housing stock.  Phase 4 – Implementation, requirements, and compliance: In the final phase we will provide information on the requirements for landlords, how to enter the program, and how to be compliant with the program/policy. This cycle will be repeated as necessary, and potentially adjusted for annual communications. Rental Licensing Ordinance – General Provisions  City staff have reviewed rental licensing ordinance provisions from several cities and have outlined general parameters for Eagan’s ordinance.  Most cities exempt certain types of rental units from licensing. The most common exemptions include rentals to qualifying relatives (parent, stepparent, child, stepchild, grandparent, brother, sister, uncle, aunt, nephew, or niece by blood, marriage, or adoption). Most cities also exempt units licensed by the Minnesota Department of Health such as assisted living, nursing home, group home, or hospice units and units which have been granted reasonable accommodation by the city under the Federal Fair Housing Amendments Act of 1988. Less common exemptions authorized by some cities include: o Units that are rented less than 120 consecutive days per year and occupied by the owner the remainder of the year; o Rented rooms within an owner-occupied dwelling unit; o Residential properties sold on a contract for deed; and/or o Units owned by a member of the United States Armed Services during the time that the owner is on active duty.  The ordinance will list information to be required by the application including a tax identification or social security number for the owner. Tax identification information must be reported annually to the Minnesota Department of Revenue.  Licenses will be issued annually and are non-transferable. Licenses expire upon change in ownership.  Rental licenses must be posted in common areas or within the dwelling unit for single- unit rentals.  Some cities specify inspection schedules within the ordinance. Many cities describe inspection procedures within the ordinance and allow administrative flexibility for the timing of inspections.  The ordinance will define procedures for renewals, denials, revocations, and appeals. Rental Licensing Ordinance – Public Safety Provisions  The Police Department has made recommendations regarding public safety provisions.  Written applications and lease agreements will be required. Written leases protect both the landlord and tenant.  Background checks will be required for tenants. Property owners may establish screening criteria and choose resources for background checks.  State statutes require criminal background checks for rental managers, leasing agents, and maintenance personnel who may enter dwelling units. Violation of the statute is a petty misdemeanor. The City’s ordinance will require adherence to MN State Statute 299C.68 Background Check on Residential Building Manager as a requirement for licensing.  Property owners will be required to maintain a tenant register and provide it to the City upon request.  Property owners must participate in the City’s Crime-Free Multi-Housing Program and use a crime-free lease addendum. Owners and/or managers must attend training at least once every three years.  City ordinance Section 10.44 Repeat nuisance call service fee addresses repeat service response calls. The rental licensing ordinance will reference Section 10.44. Fees  The costs of a rental licensing program are recovered from licensing fees. Rental licensing fees will be included in the City’s fee schedule.  The City Council will be asked to consider a rental licensing budget and fee schedule in June.  City staff contacted the Dakota County CDA for their input on a rental licensing program. The CDA advocated for fee waivers or reductions for affordable housing.  Some cities charge rental conversion fees for units that are being converted to rental. The rental conversion fee does not apply to units that are constructed as rental housing units. The rental conversion fee covers the higher inspection and staff costs for conversion of single-unit rentals. A rental conversion fee could be waived in the initial year of rental licensing as an incentive for registration. Policy Questions 1. Which exemptions from rental licensing should be granted? 2.
