A regular Eagan City Council meeting was held on Tuesday, April 4, at 6:30 p.m. Present were Mayor Maguire, Councilmembers Bakken, Hansen, Fields, and Supina. It was recommended to adopt a resolution to accept a donation of $2000 from the Eagan Citizens Crime Prevention Association for funds to support an event for Police staff members following a recent accident involving an Eagan Police Officer. F. It was recommended to approve the renewal of a Joint Powers Agreement allowing the City of Eagan to continue its participation in the Dakota County Drug Task Force. The signed agreement would be in effect until December 31, 2027. G. It was recommended to a approve final payment for City Contract 20-20, Cascade Bay improvements, in the amount of $20,885.00 to Global Specialty Contractors and accept the improvements for perpetual City maintenance. H. It was recommended to set the interest rate for special assessments levied in the next twelve months at 5.0%. I. It was recommended to approve an Agreement for assisting in OCDETF investigations, strategic initiatives and prosecutions and approve the use of overtime by the state and local agencies. J. It was recommended to receive the bids for Contract 23-02 (Neighborhood Street Revitalization) and award a contract to Bituminous Roadways, Inc. for the base bid in the amount of $2,061,576.12 and authorize the Mayor and City Clerk to execute all related documents. K. It was recommended to approve highway and temporary easements over Goat Hill Park (4391 Lexington Avenue) and highway and temporary easements over Walnut Hill Park (Outlot B, Wedgwood 1st Addition) for the Lexington Avenue (CSAH 43) and Wilderness Run Road Pedestrian Crossing Safety Improvements (County Project 97-217) and authorize the Mayor and City Clerk to execute all related documents. L. It was recommended to approve the final disposition of the Water Meter Inspection/Repair/Replacement (I/R/R) Program (City Code 3.05) surcharge for the identified properties in accordance with the related City Ordinance. M. It was recommended to approve a resolution with the Metropolitan Council for the Municipal Publicly Owned Infrastructure Inflow & Infiltration Grant Program and authorize the Mayor and City Clerk to execute all related documents. N. It was recommended to receive the Draft Final Assessment Report for Project 1438 (Town Centre - Street Improvements) and schedule a public hearing to be held on May 2, 2023. O. It was recommended to receive the Draft Final Assessment Report for Project 1439 (Dodd Road/Oak Bluffs - Street Improvements) and schedule a public hearing to be held on May 2, 2023. P. X. It was recommended to approve a manager change of the Off-Sale 3.2 Liquor License issued to Holiday Stationstores, LLC doing business as Holiday Stationstore located at 4595 Nicols Road. V. NEW BUSINESS CONDITIONAL USE PERMIT – Sunbelt Rentals – Shana Conklin / 940 Aldrin Drive City Administrator Miller introduced the item and invited City Planner Schultz to provide a site map and staff report on the proposal. The applicant is requesting outdoor storage for air conditioning, heating, and trailer units. The units are oriented seasonally. The Fire Marshall has reviewed the plan to ensure access for emergency vehicles. There is a 25-foot fire lane around the building. The applicant was also requesting outdoor storage of two propane tanks and one diesel fuel sell enclosed with a jersey barrier for protection. City engineer staff noted there was a high potential for pollution discharge into stormwater, so the site should include pollution prevention practices. The applicant, Shannon Compline, was present for questions. Councilmember Bakken inquired about the height of the jersey barriers. Ms. Compline deferred to Colin Scofield, who represented Sunbelt Rentals. Mr. Scofield stated the concrete walls are about 3 ½ feet in height. Councilmember Bakken inquired on the height of the building to the left. City Planner Schultz estimated the building was 26 to 28 feet in height. City Council Meeting Minutes April 4, 2023 Page 5 Mayor Maguire inquired whether the sediment and hydrocarbon storage were included in the conditions. City Planner Schultz responded yes, they were included in the report. Mayor Maguire called for public comment. Hearing none, the Mayor returned the conversation to Council for additional discussion and motion. Councilmember Bakken inquired of staff what the purpose of the jersey barriers. City Planner Schultz stated they were intended to protect the tanks from vehicles. The barriers were not intended to contain runoff or fluids. Councilmember Bakken stated he was agreeable as long as the Fire Marshal has signed off. City Planner Schultz stated more information would be gathered when they file for a building permit. Councilmember Hansen moved, Councilmember Fields seconded a motion to approve a Conditional Use Permit to allow outdoor storage of equipment, trucks, and trailers within a designated area for property located at 940 Aldrin Drive, legally described as Lot 3, Block 2, Eagandale Corporate Center, subject to the following conditions. Aye: 5, Nay: 0. Motion carried. 1. This Conditional Use Permit shall be recorded at Dakota County within 60 days of approval by the City Council. 2. The applicant shall provide a revised site plan illustrating the existing parking arrangement, one additional ADA designated parking stall, and delineated storage boundary. 3. Outdoor storage shall be limited to the designated area illustrated on the site plan as identified behind the office portion of the building. No outdoor storage to occur in the front parking lot, including service vehicles. Expansion of the outdoor storage is prohibited without approval of an amendment to this Conditional Use Permit or a new Conditional Use Permit. 4. Outdoor storage shall be limited to heaters, AC units, trailer mounted equipment, service vehicles, and other equipment related to the tenant. 5. Outdoor storage shall be maintained in a neat and orderly manner, not impede the vehicular and emergency drive aisle around the warehouse portion of the building. 6. The parking lot and outdoor storage areas shall be repaired to prevent further deterioration no later than September 30, 2023. 7. If additional parking is required, the applicant shall provide additional parking within the storage/service area behind the office portion of the building. No parking shall occur on the public street. 8. The existing gates to the outdoor storage area will be affixed with KNOX Gate Key Switches to allow for emergency access. 9. This CUP shall supersede and replace all prior Conditional Use Permits previously issued to the property prior to March 1, 2023. Councilmember Hansen moved, Councilmember Fields seconded a motion to approve a Conditional Use Permit to allow outdoor storage of two 1,000-gallon propane tanks and one 500-gallon diesel fuel cell for property located at 940 Aldrin Drive, legally described as Lot 3, Block 2, Eagandale Corporate Center, subject to the following conditions. This Conditional Use Permit shall be recorded at Dakota County within 60 days of approval by the City Council, and proof of recording submitted to the City 2. The above ground tanks shall be maintained at the specified location on the Site Plan received March 20, 2023. 3. All Building and Mechanical Permits shall be completed and approved prior to installation of the tanks. 4. The parking lot and outdoor storage areas shall be repaired to prevent further deterioration no later than September 30, 2023. 5. If additional parking is required, the applicant shall restripe the parking lot to the original 90- degree angled stalls as identified on the original site plan or provide additional parking in outdoor storage area of the site. No parking shall occur on the public street. 6. The applicant shall include appropriate spill containment measures by the fueling area(s), including providing appropriate spill kits and an Emergency Response Plan that details procedures for spill response/cleanup/disposal, including protocols, emergency contacts, and incidence log, which shall be accessible at the site, and shall include an inspection/maintenance schedule (of an appropriate recurring frequency and after 0.5-inch rain events or greater) in a manner acceptable to the City Engineer, to ensure that no hydrocarbons enter the catch-basin inlet from the site’s fueling areas. Details shall be included in applicable plan sheet(s). 7. The applicant shall include effective catch-basin inserts to separate and capture sediment, debris and hydrocarbons from the stormwater from this site prior to entering the public storm system, in a manner acceptable to the City Engineer. The applicant shall include an inspection/maintenance schedule (of an appropriate recurring frequency and after 0.5-inch rain events or greater) and other details for ensuring effective operation of these pollutant capture practices. Details shall be included in applicable plan sheet(s). 8. The property owner shall enter into a long-term stormwater management system maintenance agreement with the City, detailing the inspection and maintenance required to occur to ensure proper operation and performance of the private stormwater management system pollutant containment practices and measures, in a form acceptable to the City Attorney. 9. The existing gates to the outdoor storage area will be affixed with KNOX Gate Key Switches to allow for emergency access. 10. This CUP shall supersede and replace all prior Conditional Use Permits previously issued to the property prior to March 1, 2023. PLANNED DEVELOPMENT AMENDMENT – Guidepost Montessori – Ben Udell City Administrator Miller introduced the item and invited City Planner Schultz to provide a site map and staff report of the proposal. City Planner Schultz presented a site map and overview of the project. Schultz noted the Planning Commission held a public hearing on March 28th regarding the item and recommended approval on a 4- 0 vote. City Council Meeting Minutes April 4, 2023 Page 7 The applicant, Ben Udell, 227 West Monroe Street, Chicago, IL, represented Murphy Real Estate Services and the applicant, introduced himself. Mr. Udell stated there was one change to the proposed elevations, modifying the roof design from a pitched to a flat roof. The other materials would remain the same. Councilmember Bakken inquired whether the flat roof would comply with City Code. City Planner Schultz stated the roof design would be reviewed with the building permit but the height appears to meet building Code. Schultz added that elements such as mechanical screening will also be reviewed with the building permit. Councilmember Bakken stated that he would prefer the flat roof. Mayor Maguire inquired of the current guiding of the property. City Planner Schultz confirmed the property was guided Office/Service, similar to the vacant lot to the south. Mayor Maguire inquired of flag lot design. City Planner Schultz stated the staff assumes the flag lot was created to be allowed access via Patrick Road to the north and avoid accessing Lexington Avenue. Councilmember Hansen inquired about access for the subject site. City Planner Schultz responded access to the Guidepost Montessori property would also be a single access via Patrick Road. Councilmember Hansen inquired of the applicant whether all the trees on the property would be removed. Mr. Udell responded all existing trees would be removed. Councilmember Bakken asked whether there were significant trees on the site. City Planner Schultz responded that there were 15 significant trees inventoried. The applicant worked with the City Forester that originally identified 50 significant trees. The applicant would be providing $12,000 in tree mitigation. Mayor Maguire called for public comment. Hearing none, the Mayor returned the conversation to Council for additional discussion and motion. Councilmember Fields moved, Councilmember Supina seconded a motion to approve a Planned Development Amendment to allow a child daycare upon 1.5 acres located at 4270 Lexington Road, legally described as Outlot D, Eagan Center 1st Addition, subject to the following conditions. An Amendment to the Planned Development Agreement shall be executed and recorded with the Dakota County Recorder’s office. The following exhibits shall be made part of the Agreement: • Site Plan • Building Elevations • Landscape Plan • Signage Plan • Site Lighting Plan 2. The property shall be platted prior to issuance of a Building Permit. 3. The Site Plan key notes shall be revised to correspond correctly and clearly identify the plan details including fence type and height. 4. The Building Elevations shall be revised to provide the breakdown of building materials, per class, to ensure minimum requirements are met. 5. Building address numbers shall be installed consistent with the provisions of Section 2.78 of City Code. 6. A second connection to the sidewalk along Patrick Road to the north shall be incorporated into the development plans. 7. The trash enclosure shall comply with the City Code standards and full compliance will be evaluated at the time of Building Permit application. 8. The rooftop and ground mounted mechanical equipment shall comply with the City Code standards and full compliance will be evaluated at the time of Building Permit application. 9. The applicant shall fulfill tree mitigation requirements through a cash dedication of $12,000.00. 10. The applicant shall ensure the survival of preserved trees via protection of the tree’s critical root zones through the placement of required Tree Protective measures (i.e., orange-colored silt fence or 4-foot polyethylene laminate safety netting or silt fence), to be installed at the Drip Line or at the perimeter of the Critical Root Zone, whichever is greater. 11. The applicant shall contact the City Forestry Division and set up a pre-construction site inspection at least five days prior to the issuance of the grading permit to ensure compliance with the approved Tree Preservation Plan and placement of the Tree Protection Fencing. 12. A revised Site Lighting Plan shall be provided that includes pole-mounted fixture height of not more than 30 feet, an average to minimum ratio for the parking lot area of not more than 4.0 footcandles and ensure there is no light spillover at the west end of the site. 13. A revised Sign Plan consistent with City Code standards shall be provided and the monument sign plan should either remain unlit or incorporate internal lighting, and better integrate the sign base to match in the principal building’s design. 14. A Sign Permit shall be required prior to installation of any signs, and compliance with the City Sign Code shall be demonstrated at that time. 15. All erosion/ sediment control plans submitted for development and grading permits shall be prepared by a designer who has received current Minnesota Department of Transportation (MNDOT) training, or approved equal training as determined by the City Engineer in designing stormwater pollution prevention plans. Also, all personnel responsible for the installation of erosion/ sediment control devices, and the establishment of vegetation for the development, shall have received Erosion/Sediment Control Inspector/Installer certification through the University of Minnesota, or approved equal training, as determined by the City Engineer. City Council Meeting Minutes April 4, 2023 Page 9 16. Erosion control measures shall be installed and maintained in accordance with City code and engineering standards. 17. The storm sewer connection between the infiltration basin and public storm sewer system shall be designed and installed in a manner acceptable to the City Engineer 18. This development shall comply with Eagan’s Land Disturbance Stormwater Pollution Prevention and Post-Construction Stormwater Management Requirements (City Code Section 4.34) for stormwater management and surface water quality, including land disturbance requirements, and Runoff Rate Control and 1.1-inch Volume Control, for effective treatment of the site’s impervious surface area (including effective soil remediation for all of the site’s disturbed soils that are to be revegetated greenspace). 19. Prior to receiving City approval to permit land disturbing activity, the applicant shall provide to the City with soil borings equally spaced within the footprint of any proposed infiltration feature, extending a minimum of 10 feet below the bottom of the proposed infiltration excavation with continuous sampling, to evaluate and ensure suitability for infiltration of stormwater, including, but not limited to, depth to saturated soils and P200 analysis if SM soils are encountered below the excavation extent. A minimum of 2 soil borings must be provided within the footprint of the proposed stormwater infiltration basin (to a minimum elevation of 964.0, based on proposed over-excavation to 974.0). If the soil boring logs indicate incompatibility of existing sub-soil permeability, or shallow groundwater conflict, with the submitted and reviewed design plans for meeting volume control requirements, the applicant shall revise the design and/or construction plans to ensure water quality equivalent of volume control requirements are fully met for the mitigated impervious drainage area, to the satisfaction of the City Engineer. 20. The applicant shall provide adequately sized pre-treatment structure (e.g. 4-foot minimum depth sump, 5-foot minimum diameter, with floatable skimmer hood, energy dissipation, etc.) at, or immediately upstream of, any stormwater infiltration basin inlet to provide for effective capture and easily-accessible cleanout of fine-sand sized particles and floatable pollutants. Pre- treatment structures shall be accessible by appropriate maintenance equipment. Details shall be included in applicable plan sheet(s) using Eagan Standard Detail Plate E231, etc. 21. Prior to receiving city approval to permit land disturbing activity, the applicant shall provide construction details of the proposed infiltration basin following MPCA Minnesota Stormwater Manual Standards & City Engineering Standards for Infiltration Basins for City review/acceptance by the City Engineer and include in construction plans. Construction details shall include infiltration basin cross-sections, construction/protection/inspection notes, infrastructure components involved, sub-soil testing/loosening, soil media specifics, and planting/stabilization specifics, to ensure infiltration practices are properly designed, constructed, planted, and adequately protected during / after construction to prevent clogging, and able to be properly maintained to function as intended. Infrastructure details shall be included for stable inlets, outlets and emergency overflows and unobstructed access for inspections and maintenance of inlets/outlets. Details for basin soil requirements shall include sub-soil infiltration testing for the infiltration basins following City/MPCA guidelines, sub-soil ripping of 18-inch depth minimum x 18-inch maximum spacing at over-excavation prior to soil amendment backfilling, and appropriate soil amendment criteria. Details for planting and stabilization requirements shall include live planting at 18-inch on-center spacing of all basin bottom area, appropriately seeded side-slopes, and permanent erosion-control details for basin bottom and side-slopes, etc. These graphical details and notes shall be prominently included in all applicable plan sheets (e.g. Grading Plan, Utility Plan, Details, etc.). Notes shall be provided City Council Meeting Minutes April 4, 2023 Page 10 that grading and utility contractor(s) shall provide 24-hours advance notice to City Water Resources Staff of any grading or utility work involving the proposed infiltration basins, including installation of all inlets and outlets, including contact email and phone number for City Water Resources Staff. 22.During infiltration system over-excavation/sub-soil work, the applicant shall ensure that a Certified Soil Scientist will be present to verify and document that infiltration system sub-soils are suitable for a saturated-state infiltration rate of no less than 1.5-inches per hour (based on 0.75-inch per hour design rate with safety factor) or greater (but less than 8.0-inch per hour). If the sub-soil infiltration rates are less than 1.5-inches per hour (or greater than 8.0-inch per hour), the applicant shall immediately notify the City Engineer and revise the volume control practice(s) design and construction as necessary (e.g. over-excavation/soil-amendment depth, under-drain with iron-sand mounding, etc.) to ensure volume control requirements are fully met. Verification of sub-soil infiltration testing rates shall be provided immediately to the City of Eagan on the day of infiltration testing. The applicant shall ensure that the City Water Resources staff is provided 24-hour advance notice of the occurrence of infiltration verifications and also provided notice prior to any excavation and/or soil backfilling within the infiltration practices, to arrange for inspections. 23.Prior to receiving city approval to permit land disturbing activity, the property owner shall provide detailed Soil Management Strategies in the plan set for City review, and acceptance by the City Engineer, that provide graphical details and notes on soil protection/restoration in the Stormwater Management Plan and prominently included in all applicable plan sheets (e.g. Erosion & Sediment Control Plan, Grading Plan, Landscape Plan, etc.) and shall specify estimated quantities of soil ripping area and volume of compost to be imported and incorporated on pertinent plan sheet BMP Quantity Tables. Prior to receiving a Certificate of Occupancy for any affected construction, Soil Management Strategy implementation documentation (e.g. haul tickets, representative on-site soil samples, compaction testing and soil organic content test results) shall be provided to City Water Resources staff to verify approved soil management strategy compliance. Notes shall be provided that implementing contractor shall provide 24- hours advance notice to City Water Resources staff prior to implementation of soil loosening and amendment. 24.Prior to proceeding with land disturbing activity, the Property Owner shall enter into a long- term stormwater management system maintenance agreement with the City, detailing the annual inspection and maintenance required to occur to ensure proper operation and performance of the private permanent stormwater management system, in a form acceptable to the City Attorney. 25.Before the city returns any Stormwater-related Performance Guarantee Fees on the development site, the applicant shall demonstrate that all stormwater management practices are performing as intended and shall provide the City Engineer as-built plans meeting City requirements for as-built standard submittals that demonstrate that all constructed stormwater conveyance structures, stormwater management facilities (pre-treatment structures, infiltration basin, etc.), including greenspace soil loosening & amendment prior to landscaping, conform to design and/or construction plans, as approved by the City. The applicant shall submit to the City Engineer certification that the stormwater management facilities have been installed in accord with the plans and specifications approved. This certification shall be provided by a Professional Engineer licensed in the State of Minnesota. 26.This development should provide hydrant spacing and locations in accordance with City Fire Department and Public Works standards. City Council Meeting Minutes April 4, 2023 Page 11 27.The applicant shall provide a contractor parking and staging plan prior to issuance of a building permit, in a manner acceptable to the City Engineer.
