REAL ESTATE EASEMENT AGREEMENT
THIS AGREEMENT is made on July 09, 2023,by and between Deena Farver of 786 Sunset Drive,
Eagan, Minnesota 55123, hereinafter("Grantor"), and Lucas Meyer of 784 Sunset Drive, Eagan,Minnesota,
55123 hereinafter("Grantee").
Recitals
A. The Grantor is the owner of certain real property commonly known as 786 Sunset Drive, Eagan,
Minnesota, 55123, and more fully described as follows: Sunset 4th Addition Lot 7 Block 1, (Servient Estate).
B. The Grantee is the owner of certain real property commonly known as Minnesota, 784 Sunset Drive,
Eagan Lucas Meyer, Sunset 4th Addition Lot 8 Block 1, ("Dominant Estate").
C. The Grantee desires to acquire certain rights in the Servient Estate.
1. Grant of Easement
For valuable consideration, Grantor hereby grants to Grantee an easement on and across the following-
described portion of the Servient Estate: Sunset 4th Addition Lot 7 Block 1.
2. Character of Easement
It is the intention of the parties that the easement granted appurtenant to the Dominant Estate, in that the
easement benefits the use and enjoyment of the Dominant Estate by Said easement shall benefit and be
appurtenant to all and any portion of Lot 8, Block 1, Sunset Fourth Addition, and said easement shall run
with Grantors' land and the title thereto and shall be binding on Grantors and their heirs, successors, and
assigns and any person who shall hereafter acquire title to Grantors'property. The driveway shall be
constructed and maintained by Grantee, its successors and assigns, at their sole cost and expense..
3. Duration and Binding Effect
The easement shall endure 50 years. This Agreement is made expressly for the benefit of, and shall be
binding on, the heirs,personal representatives, successors in interest, and assigns of the respective parties.
4. Purpose of Easement
The purpose of the easement will be to allow the owners of Sunset Drive Lot 8 Block 1 to put an additional
parking pad on the West side of the garage in addition to current driveway easement. The pad will be used to
park vehicles on.
The pad will extend loft 8in from the west side of the garage and 23ft from the north side of the garage.
The parking pad will continue on to the driveway that is already in place at the property with the existing
easement.
5. Limitations
It is expressly agreed that the easement, rights, and privileges conveyed to Grantee are limited to Said
easement shall benefit and be appurtenant to all and any portion of Lot 8, Block 1, Sunset Fourth Addition,
and said easement shall run with Grantors' land and the title thereto and shall be binding on Grantors and
their heirs, successors, and assigns and any person who shall hereafter acquire title to Grantors'property.
The driveway and pad shall be constructed and maintained by Grantee, its successors and assigns, at their
sole cost and expense.
6. Exclusiveness of Easement
The easement, rights, and privileges granted by this easement are exclusive, and Grantor covenants not to
convey any other easement or conflicting rights within the area covered by this grant, or nonexclusive, and
Grantor reserves and retains the right to convey similar easement and rights to such other persons as Grantor
may deem proper.
The parties have executed this agreement on the above mentioned date.
