10/17/2023 - City Council RegularMINUTES OF A REGULAR MEETING OF THE EAGAN CITY COUNCIL Eagan, Minnesota October 17, 2023 A Listening Session was held at 6:00 p.m. prior to the regular City Council meeting. Present were Mayor Maguire, Councilmembers Bakken, Fields, Hansen and Supina. A regular Eagan City Council meeting was held on Tuesday, October 17, at 6:30 p.m. Present were Mayor Maguire, Councilmembers Bakken, Fields, Hansen and Supina. Also present: City Administrator Miller, City Attorney Bauer, Community Development Director Hutmacher, Public Works Director Matthys, and City Planner Schultz. II.ADOPT AGENDA Councilmember Hansen moved, Councilmember Fields seconded a motion to adopt the agenda as presented. Aye: 5, Nay: 0. Motion carried. III.RECOGNITIONS AND PRESENTATIONS There were no recognitions or presentations. IV.CONSENT AGENDA Councilmember Bakken moved, Councilmember Supina seconded a motion to approve the Consent agenda. Aye: 5, Nay: 0. Motion carried. A.It was recommended to approve the minutes of the October 3 Regular City Council Meeting. B.Personnel Items: 1.It was recommended to approve the promotion of Jason Zumwalt from Utility Maintenance Worker to Engineering Technician and authorize replacement. 2.It was recommended to approve the promotion of Hunter Bowlin from Maintenance Trainee to Street Maintenance Worker and authorize replacement. 3.It was recommended to approve the hiring of a Utility Maintenance Worker – Production, to be named. 4.It was recommended to approve the hiring of a Forestry Maintenance Worker, to be named. 5.It was recommended to approve the hiring of the following part-time recurring and seasonal employees: •Christopher Ward PT Custodian – Civic Arena C.It was recommended to ratify the check registers dated September 29 & October 6. It was recommended to approve an easement agreement and facility placement on Outlot F, Dakota Path (George Ohmann Park) for the installation and maintenance of a Northern Natural Gas monitoring well. G. It was recommended to approve the plans and specifications for Contract 21-14 (River Valley Acres - Drainage Improvements and Erosion Restoration) and authorize the advertisement for a bid opening to be held at 10:30 a.m. CST on Friday, November 10, 2023, via an electronic bid site; It was further recommended to approve a temporary construction easement over Lot 2, Block 1, Transport America Addition (3303 Terminal Drive) for access to and completion of the proposed improvements and authorize the Mayor and City Clerk to execute all related documents. H. It was recommended to approve the plans and specifications for Contract 24-08 (2024 Water Quality Improvements) and authorize the advertisement for a bid opening to be held at 10:30 a.m. CST on Friday, November 10, 2023, via an electronic bid site. I. It was recommended to approve a termination of leases and settlement and release agreement for private antenna facilities on City of Eagan properties, including water reservoirs, specifically addressing lease agreements with Sprint Spectrum Realty Company LLC and Clear Wireless, LLC. J. It was recommended to approve the plans and specifications for Contract 24-03 (Lexington Storm Sewer Lift Station - Rehabilitation) and authorize the advertisement for a bid opening to be held at 11:00 a.m. CST on Tuesday, November 7, 2023, via an electronic bid site. K. It was recommended to approve a Joint Powers Agreement with Dakota County for the provision of absentee voting administration services for 2023 Special Election and Elections in 2024 and 2025. It was recommended to approve a resolution calling for a public hearing on November 21, 2023 for the approval of a proposed tax abatement for Park Improvement Projects and issuance of General Obligation Tax abatement bonds. M. It was recommended to approve a modification to the conditions of a Conditional Use Permit for property located at the northeast corner of Yankee Doodle Road and Columbia Drive, legally described as Part of Lots 33-38, Block 4, Eagandale Center Industrial Park No. 4; Further, it was recommended to approve a Final Plat (Yankee Doodle AREM) to create one lot upon approximately 6.9 acres located at the northeast corner of Yankee Doodle Road and Columbia Drive, legally described as Part of Lots 33-38, Block 4, Eagandale Center Industrial Park No. 4. N. It was recommended to approve a resolution appointing election judges for the November 16, 2023 and December 5, 2023 Special Election. O. It was recommended approve Final Payment for fiber extension to Denmark Lift Station and Eagan Civic Arena to AEI Construction, Inc and Accept the Improvements for Perpetual City Maintenance Subject to Warranty Provisions. V. PUBLIC HEARINGS WAIVER OF SUBDIVISION REQUIREMENTS – Twin Cities Habitat for Humanity – 2042/2044 Pin Oak Drive City Administrator Miller introduced the item and invited City Planner Schultz to provide additional information and a location map. City Planner Schultz provided a location map and staff report. Schultz noted each lot would meet the bulk and lot minimum standards of the R-2 zoning district. . Schultz clarified the typical subdivision requirements to be waived are platting and collection of fees such as park and trail dedications. Mayor Maguire asked if there were any questions of staff. Seeing none the Mayor asked if there were any public comments. Seeing none the Mayor asked for a motion. Councilmember Fields moved, Councilmember Bakken seconded a motion to approve a Waiver of Subdivision Requirements for a duplex lot split located at 2042 and 2044 Pin Oak Drive, legally described as Lot 1, Block 5, Vienna Woods. Aye: 5, Nay: 0. Motion carried. FINAL ASSESSMENTS for the following: Project 1488, Coachman Rd / Four Oaks Rd / Coachman Oaks Project 1490, Duckwood Drive & Lexington Place Project 1491, Slater Road Project 1492, Wescott Road & Elrene Road Project 1493, Cedar Cliff 1st - 3rd Project 1494, Drexel Heights Project 1496, Murphy Farm Project 1497, Opperman Drive Project 1498, Pilot Knob Heights City Council Meeting Minutes October 17, 2023 Page 4 Project 1499, Rustic Hills/ Post/ Oster/ Kennerick 2nd Project 1501, Silver Bell Road Project 1502, Woodgate 1st Mayor Maguire called for members of the public in attendance for any of the projects with proposed final assessments. Hearing none, the Mayor invited Director Matthys to present additional information on the projects. Director Matthys provided an overview of the combined list of projects totaling just under 11.5 miles of street improvements. City Attorney Bauer responded to a question from Mayor Maguire, that property owners would have the opportunity to appeal final assessments once Council took action to approve them. Property owners would have thirty days from the date of approval of the assessments to appeal. Mayor Maguire called for members of the public wishing to speak in the public hearing. Hearing none, the Mayor returned the conversation to Council for additional conversation and action. Councilmember Bakken moved, Councilmember Fields seconded a motion to close the public hearing and approve the Final Assessment Reports for Projects 1488, 1490, 1491, 1492, 1493, 1494, 1496, 1497, 1498, 1499, 1501, and 1502, and authorize the certification to Dakota County for collection. Aye: 5, Nay: 0. Motion carried. VI. OLD BUSINESS There were no items for Old Business. VII. NEW BUSINESS There were no items for New Business. VIII. OTHER BUSINESS There was no other business. IX.
