Koethe, County Recorder ACCESS EASEMENT This Access Easement is made this 6th day of NOVember, 2023, by and between BT- OH, LLC, a Delaware limited liability company (hereinafter referred to as "Grantor") and the City of Eagan, a Minnesota municipal corporation (hereinafter referred to as "Grantee"). Grantor is the fee owner of property legally described as follows: Lot 1, Block 1, U.P.S. 2nd Addition, according to the recorded plat thereof, Dakota County, Minnesota (the "Property"). Grantor, in consideration of the sum of One Dollar ($1.00) and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, does hereby grant and convey unto Grantee a non-exclusive easement for access purposes over, under and across that portion of the Property legally described as follows: A 20 foot wide easement over and across that part of Lot 1, Block 1, U.P.S. 2nd Addition, according to the recorded plat thereof, Dakota County, Minnesota, lying 10 feet on either side of a centerline described as commencing at the northeast corner of said Lot 1; thence South 00 degrees 17 minutes 06 seconds East, assumed bearing along the east line of said Lot 1, a distance of 330.00 feet to the south line of existing drainage and utility easement per said plat; thence South 89 degrees 29 minutes 23 seconds West, along said south line of the drainage and utility easement, 54.42 feet to the point of beginning of the centerline to be described; thence South 00 degrees 00 minutes 00 seconds East 93.74 feet; thence South 45 degrees 00 minutes 00 seconds West 101.82 feet; thence South 90 degrees 00 minutes 00 seconds West 1086.57 feet to a point hereinafter known as Point "A"; thence South 00 degrees 00 minutes 00 seconds East 349.17 feet; thence South 90 degrees 00 minutes 00 seconds West 782.92 feet; thence South 63 degrees 45 minutes 56 seconds West 48.00 feet to a westerly line of Lot 1 and said centerline there terminating. Together with a 20 foot wide easement described as lying 10 feet on either side of a centerline described as beginning at the above described Point "A"; thence North 32 degrees 27 minutes 31 seconds West 43.26 feet; thence North 00 degrees 00 minutes 00 seconds West 118.72 feet to said south line of existing drainage and utility easement and said centerline there terminating. (the "Easement Area") See also Exhibit "A" attached hereto and incorporated herein. The grant of the foregoing easement includes the right of Grantee, its contractors, agents and invitees to utilize the Easement Area to allow for Grantee's access to its public stolen sewer and pond for maintenance, at Grantee's sole expense. Grantor covenants with Grantee, its successors and assigns, that Grantor is the owner of the Property and has good right to grant and convey the easement herein to Grantee. The use of the easement shall be nonexclusive. Grantor shall have the right to use the Property for any and all uses and purposes provided that such use does not obstruct, encroach upon or materially interfere with the intended purpose of the easement. This easement and the covenants contained herein shall run with the Property and shall bind. Grantor and its successors and assigns.
