12/19/2023 - City Council RegularMINUTES OF A REGULAR MEETING OF THE EAGAN CITY COUNCIL Eagan, Minnesota December 19, 2023 A Listening Session was held at 6:00 p.m. prior to the regular City Council meeting. Present were Mayor Maguire, Councilmembers Bakken, Fields, Hansen and Supina. A regular Eagan City Council meeting was held on Tuesday, December 19, at 6:30 p.m. Present were Mayor Maguire, Councilmembers Bakken, Fields, Hansen and Supina. Also present: City Administrator Miller, City Attorney Bauer, Community Development Director Hutmacher, Finance Director Feldman, Assistant Finance Director Foiles, Public Works Director Matthys, and City Planner Schultz. II. ADOPT AGENDA Councilmember Hansen moved, Councilmember Fields seconded a motion to adopt the agenda as presented. Aye: 5, Nay: 0. Motion carried. III. RECOGNITIONS AND PRESENTATIONS IV. CONSENT AGENDA Councilmember Bakken moved, Councilmember Supina seconded a motion to approve the Consent agenda. Aye: 5, Nay: 0. Motion carried. A. Item pulled from agenda. B. Personnel Items: 1. It was recommended to approve the hiring of Joshua Kickbush, Street Maintenance Worker. 2. It was recommended to approve the hiring of ZoeAnn Olson, Forestry Maintenance Worker. 3. It was recommended to approve the hiring of a Maintenance Trainee, to be named at a future City Council meeting. 4. It was recommended to approve the promotion to Assistant Chief of EMS and Training, to be named at a future City Council meeting. 5. It was recommended to approve the hiring of firefighters, to be named at a future City Council meeting. 6. It was recommended to approve the change of status of Saundra Allen from part-time to full-time Clerical Tech in the Police Department. 7. It was recommended to approve the revisions of the Employee Handbook. 8. It was recommended to approve the Memorandum of Agreements regarding Employee Sick and Safe Leave between the City of Eagan and the following union groups: Teamsters Local 320 – Clerical Unit, Law Enforcement Labor Services Local #185 – Sergeants, Law Enforcement Labor Services Local #170 – Police Officers Unit, and Eagan Public Works and Parks Collective Bargaining Unit. 9. It was recommended to ratify the check registers dated December 8. D. It was recommended to approve the following ordinary and customary contracts: 1. Compensation and Classification Study Agreement with GovHR USA, LLC in 2024 2. Sponsorship Agreement with Think Bank for Market Fest events in 2024. 3. Municipal Advisory Agreement to engage Northland Securities as the City’s Municipal Advisor on the 2024A bond issuance 4. Vendor Agreement with All in Casino Party for senior event on March 18, 2024 5. Vendor Agreement with Kids Dance for Sweetheart Dance on February 9, 2024 E. It was recommended to approve the updated Sperry Tower Lighting Schedule. F. It was recommended to Approve Change Order No. 1 for Contract 22-02 (2022 Neighborhood Street Revitalization) and authorize the Mayor and City Clerk to execute all related documents. G. It was recommended to approve final payment of $619,068.96 for Contract 23-03 (2023 Trail and Parking Lot Improvements) and accept the improvements for perpetual City maintenance subject to warranty provisions. H. It was recommended to Receive the bid from the State of Minnesota Cooperative Purchasing Venture (Sourcewell-MN) for Contract 23-17 (North Water Treatment Plant Administrative Offices Renovation), approve a contract with RAK Construction, Inc. for the bid amount of $338,081.04, and authorize the Mayor and City Clerk to execute all related documents. I. It was recommended to approve a resolution authorizing issuance and sale of approximately $19,975,000 Taxable General Obligation Bonds, Series 2023A, on February 13, 2024. J. It was recommended to approve an application for a $187,785 Federal High-Intensity Drug Trafficking Grant on behalf of the Dakota County Drug Task Force. K. It was recommended to approve Project 1578 (Sperry Tower – Lighting System Replacement) and authorize the preparation of plans and specifications. L. It was recommended to approve Change Order No. 2 for City Project 1556 (Goat Hill Pavilion), City Contracts 23-18, 23-16, & 23-14 (PEMB Erection, Concrete, & Earthwork) and authorize Mayor and City Clerk to execute all related documents. M. It was recommended to approve issuing a Request for Quote (RFQ) for procurement and implementation services and equipment costs for new broadcast control rooms and supporting equipment for Council Chambers and Eagan Room. It was recommended to approve a resolution directing the City Clerk to issue 2024 alcohol license renewals upon the licensees’ submission of renewal documents and fees. O. It was recommended to approve a temporary on-sale liquor license and waive the license fee for Church of St. Thomas Becket on March 9, 2024 at 601 River Ridge Parkway. P. It was recommended to approve a Purchase Agreement and Maintenance License with Peace Reformed Church and authorize the Mayor and City Clerk to execute all related documents. Q. It was recommended to approve a settlement agreement with Trent Johnson in the Trent Johnson v. City of Eagan lawsuit. V. PUBLIC HEARINGS There were no items for public hearing. VI. OLD BUSINESS ORDINANCE AMENDMENT – City Code Chapter 11 City Administrator Miller introduced the item and invited City Planner Schultz to present additional information on the code amendment to Chapter 11 regarding residential program facilities and emergency housing. Mr. Schultz provided additional background on the ordinance amendment and several changes following the Council’s recommendations in September. The ordinance establishes zoning allowances for residential program facilities and residential shelters, sets performance standards and adoption of new land use definitions. Mayor Maguire called for public comment on the item. An Inver Grove Heights resident addressed the Council and recommended that the ordinance consider parking demand for staff members and visitors involving a residential program facility. Mr. Schultz responded that the ordinance is written to address a variety of facility types, and that parking may be addressed on a case-by-case basis. Councilmember Supina moved, Councilmember Hansen seconded a motion to approve an ordinance amendment to City Code Chapter 11, Sections 11.30 (Definitions), 11.60 (Use Districts and Overlays), and 11.70 (Performance Standards), regarding residential program facilities and residential shelters. ADMINISTRATIVE AGENDA There were no items for the Administrative Agenda. XII. VISITORS TO BE HEARD A resident addressed the Council regarding staff response to recent fires in Eagan. XIII.
