A Listening Session was held at 6:00 p.m. prior to the regular City Council meeting. Present were Mayor
Maguire, Councilmembers Fields, Bakken, Hansen and Supina.
A regular Eagan City Council meeting was held on Tuesday, May 7, at 6:30 p.m. Present were Mayor
Maguire, Councilmembers Fields, Bakken, Hansen and Supina. Also present: City Administrator Miller,
City Attorney Bauer, Police Chief New, Public Works Director Matthys, Community Development
Director Hutmacher, and City Planner Schultz.

F. It was recommended to approve termination of City Contract 24-42 (Steel Erection) with
South Central Erectors Inc. for the Eagan Art House (City Project 1558) and authorize Mayor
and City Clerk to execute all related documents.
G. It was recommended to accept a grant from the Minnesota Department of Public Safety for
funding to support Pathways to Policing Program.
H. It was recommended to approve grant dollars from the Federal government for
sustainability related expenses; and amend the Sustainability Fund budget accordingly to
account for these revenues and corresponding expenses.
I. It was recommended to receive Bids for Work Scope Packages 5A, 7B, 8A, 8B, 9D, 10A, 23B,
26A, 1A, 7A, 8C, 10C for Goat Hill Phase 3 Improvements (City Project 1557) and authorize
the Mayor and City Clerk to execute all related contracts and documents.
J. It was recommended to approve a contract with AVI Systems, Inc. to provide audio visual
equipment for the City Hall Training Room and Police Multipurpose Room.
K. It was recommended to approve City Contract 24-75, Steel Erection Package for Eagan Art
House (Project 1558) and award the contract to Spartan Steel Erectors, Inc. for the amount
of $55,200 and authorize Mayor and City Clerk to execute all related documents.
L. It was recommended to approve an On-Sale Wine and Beer License with Sunday sales for El
Camino Taco Deli, LLC doing business as El Camino Gourmet Tacos located at 3345 Central
Park Commons #100.
M. It was recommended to receive the bids for Contract 24-14 (2024 Streetlight Improvements
– Cedar Grove Area Streetlight LED Retrofit and Yankee Doodle Road, Construction), award a
contract to Taylor Electric Company, LLC for the base bid in the amount of $209,155.00, and
authorize the Mayor and City Clerk to execute all related documents.
N. It was recommended to receive the bids for Contract 24-16 (2024 Streetlight Improvements
– Cedar Grove Area Streetlight LED Retrofit, Equipment Purchase), award a contract to JT
Services of Minnesota, Inc., for the base bid of $345,356.00, and authorize the Mayor and
City Clerk to execute all related documents.
O. It was recommended to proclaim May 19 through May 25, 2024, as Public Works Week, and
authorize the Mayor and City Clerk to execute all related documents.
P. It was recommended to proclaim July 2024 as Eagan Lakes Appreciation Month and
authorize the Mayor and City Clerk to execute all related documents.

R. It was recommended to approve final payment of $2,865.53 for 23-15 (Evergreen Park
Utility Inspection Pilot Program) and accept the improvements for perpetual City
maintenance subject to warranty provisions.
S. It was recommended to amend the 2024 Sustainability Fund budget to add two new
streetlight LED projects for the 2024 streets plan.
T. It was recommended to approve and direct staff to submit to the Metropolitan Council a
Comprehensive Guide Plan Text Amendment to the Eagan 2040 Comprehensive Plan
integrating the Northwest Central Commons Small Area Plan into the Central Commons
Special Area.
V. PUBLIC HEARINGS
CERTIFICATION of Delinquent Utility Bills
City Administrator Miller introduced the item and noted Finance Director Feldman was available for
questions. The delinquent account under consideration for assessment has a history of non-payment
and is currently carrying a high balance.

Mayor Maguire called for public comment on the item. Hearing none, the Mayor closed the public
hearing and returned the discussion to Council for additional discussion and motion.
Councilmember Hansen moved, Councilmember Fields seconded a motion to close the public hearing
and approve the final assessment roll for delinquent utility bills and authorize its certification to Dakota
County for collection with property taxes. Aye: 5, Nay: 0. Motion carried.
STREET IMPROVEMENT PROJECT 1377,
Argenta Trail Street Reconstruction
City Administrator Miller introduced the item and invited Public Works Director Matthys to provide
additional information and a map of the project. As it exists on the corporate boundary, the street
would be reconstructed in partnership with Inver Grove Heights; a Joint Powers Agreement with the City
of Inver Grove Heights was approved for preparation of a feasibility report for both cities.
Director Matthys stated curb and gutter would be included with the street reconstruction, along with
new storm sewer and watermain replacement. Dakota County would coordinate the addition of a
segment of the Mendota-Lebanon Hills Greenway Trail system on the west side of the reconstructed
roadway.
Councilmember Bakken asked when the original watermain was installed. Director Matthys estimated it
was installed prior to 1960. The purpose of the watermain replacement is to enhance the fire flow
capacity for service to the buildings in the area.
Director Matthys stated that special assessments of the adjacent properties would contribute funding
for the improvements. He clarified the comprehensive guide designation for the single-family residence
that would be assessed is Industrial. The assessment policy is based on the highest and best use of each
property, but an appraisal would be done prior to an assessment hearing, and assessments would need
to be capped at the appraisal amount.
Mayor Maguire called for public comment on the item. Hearing none, the mayor returned the
conversation to Council for additional conversation and motion.
Councilmember Fields moved, Councilmember Supina seconded a motion to close the public hearing
and approve 1377 (Argenta Trail - Street and Utility Improvements) as presented and authorized the
preparation of detailed plans and specifications. Aye: 5, Nay: 0. Motion carried.

CONDITIONAL USE PERMIT – Mulligan’s Indoor Golf/Matthew Schroeder – 1020 Discovery Road
City Administrator Miller introduced the item and invited City Planner Schultz to provide additional
information. Mr. Schultz shared a location map and noted that no site changes are proposed other than
interior remodels to the building. A public hearing was held at the Advisory Planning Commission.
The applicant was not present.

Mayor Maguire called for members of the public wishing to speak on the item. Hearing none, the mayor
returned the conversation to the Council.
Councilmember Bakken moved, Councilmember Supina seconded a motion to approve a Conditional
Use Permit to allow an indoor golf facility as a health and fitness club in a Business Park zoning district,
upon property located at 1020 Discovery Road, subject to the following conditions: Aye: 5, Nay: 0.
1. This Conditional Use Permit shall be recorded at Dakota County within 60 days of
approval by the City Council.
2. The indoor golf facility shall be located as shown on the Tenant Delineation Plan dated
March 19, 2024.
3. A Building Permit shall be obtained for the tenant buildout.
4. All signage shall comply with City Sign Code standards. A Sign Permit shall be obtained
prior to installation of any signs.
PLANNED DEVELOPMENT AMENDMENT and INTERIM USE PERMIT –
Cedar Cliff Professional Park/Tony Reid – 2117, 2119 Cliff Drive
City Administrator Miller introduced the item and invited City Planner Schultz to provide additional
information. Mr. Schultz shared a location map and noted the applicant is requesting an Interim use
Permit to allow for up to 25 vehicles to be parked overnight in the parking lot. The Planned
Development Amendment request is to allow flexibility of the 10-foot minimum parking stall width,
allowing 90foot wide stalls which have been in place for at least the last 17 years. Mr. Schultz noted staff
is not aware of issues related to parking or circulation on the site related to this existing deviation.
The applicant was present for questions.
City Planner Schultz responded to a question from Councilmember Supina and confirmed the vehicles
would fit within the existing 9 x 13 feet stalls.
City Planner Schultz also responded to questions from Mayor Maguire and Councilmember Hansen
regarding the deviation and how it came to be. City Planner Schultz stated the conditions of approval
pre-date the current owner and aerial images show the stalls have been out of compliance for some
time. It’s also not universally known that a zoning permit is recommended for parking lot paving and
restriping, as this gives staff an opportunity to check for existing conditions of approval for the property.

Councilmember Fields moved, Councilmember Hansen seconded a motion to approve an Interim Use
Permit to allow outdoor storage of up to 25 vehicles and one enclosed trailer upon property located at
2117 and 2119 Cliff Drive, legally described as Lot 1, Block 1, Cedar Cliff Commercial Park 5th Addition,
subject to the following conditions: Aye: 5, Nay: 0. Motion carried.
1. This Interim Use Permit shall be recorded at Dakota County within 60 days of approval by

the City Council.
2. The outdoor storage shall be limited to one enclosed trailer, and 25 vehicles consisting of
passenger sedans, vans, and trucks.
3. The outdoor storage shall be limited to the location as identified on the Site Plan submitted
April 3, 2024.
4. The Interim Use Permit is approved for a term of three years and shall terminate on May 7,
2027.
5. The Interim Use Permit shall be subject to an annual administrative review. The purpose of
such review shall be to determine that the conditions of the permit are within compliance.
6. The Interim Use Permit may be revoked for failure to comply with any condition of the
permit following notice of the noncompliance and a hearing by the City Council with all
interested parties being given an opportunity to be heard.
Councilmember Fields moved, Councilmember Bakken seconded a motion to approve a Planned
Development Amendment to allow less than the 10-foot minimum parking stall width for the property
legally described as Lot 1, Block 1, Cedar Cliff Commercial Park 5th Addition, subject to the following
conditions. Aye: 5, Nay: 0. Motion carried.
1. This Planned Development Amendment shall be recorded at Dakota County within 60 days
of approval by the City Council.
2. The applicants shall submit a Revised Site Plan depicting the typical parking stall
dimensions, including ADA designated stalls.
3. The vehicle parking shall be limited to the locations as identified on the Revised Site Plan to
be submitted.
4. The parking lot shall be maintained with 126 parking spaces dimensioned 9 feet by 18 feet
as depicted on the Revised Site Plan to be submitted.
COMPREHENSIVE GUIDE PLAN AMENDMENT – Thomson Reuters Campus Redevelopment /
Ryan Companies – 610 Opperman Drive
City Administrator Miller introduced the item and invited City Planner Schultz to provide additional
information. Planner Schultz provided staff report, including the proposed concept plan. Schultz noted
the existing warehouse and binding facility will be retained by Thomson Reuters and is not included in
this application. City Planner Schultz summarized the surrounding land uses and the adjacent roadways.
The applicant, Peter Fitzgerald, Ryan Companies, was present and addressed the Council.
Councilmember Bakken inquired about the two residential parcels south of the subject site and whether
they would become nonconforming. City Planner Schultz stated the properties were subdivided but
since some residential allowances were part of the PD, the subdivision was allowed. Schultz noted staff
would review the land use designation (Major Office) and options to remove the parcels from the PD
zone.

Mayor Maguire inquired about the EAW and whether it would be completed at the upper limits of the
housing proposals. City Planner Schultz stated staff worked with the applicants on a reasonable upper
density range, but the housing illustrated on the concept plan doesn’t exceed that number.
Mayor Maguire inquired about the 150-foot buffer between the residential neighborhood on the west
side of Elrene. City Planner Schultz stated that Thomson Reuters volunteered the 150-foot buffer, the
City Code requires 100-feet. Schultz added the PD is technically expired. City Attorney Bauer added that
after expiration, it remains in place until the property is rezoned.
Mayor Maguire inquired about the potential roadway connections. A civil engineer on the applicant
team stated the preference would be to connect Opperman to Yankee Doodle, but they would need
Gopher Resources to comply. In addition, they would like to connect Trails End to Elrene.
Councilmember Supina inquired how the industrial traffic would go west on Yankee Doodle. The access
to Yankee Doodle would be restricted to right turns only.
Mayor Maguire called for public comment on the item.
Paul Hagstrum, 3742 Windtree Drive, inquired why the housing proposal has been reduced from 200-
300 single family homes to 71, as well as the number of townhomes that were presented at that time
compared to the number planned now. Additionally, the multifamily duplexes were not discussed at the
community meeting previously held.
Joe Bourne, 3772 Ridgewood Drive, stated the preservation of the character of Wescott Station Park is
important.
Patricia Connelly, 801 Ivy Lane, expressed concern over bringing industrial uses into a residential
neighborhood. Asked the Council to focus on what can be done to limit impacts to residents, focus on
light industry and possibility of mixed use. Imagine living a block away from this property, is it a place
you would like to live.
Joan Kappes, 3733 South Hills Drive, asked all of us to remember what a treasure Eagan is. Elrene is a
treasure to people that live in this part of Eagan, and to take that away would diminish what we know
and love. There are creative things that can be done to allow for housing but to preserve the beauty that
is there. I’m asking that we be creative rather than do the same old, because this is our opportunity to
preserve what we love.
Kaitlyn Hillis, 713 Stonewood Road, stated the design of this project is important to us and implored the
City to not just do the bare minimum to meet the requirements of the environmental review process
but to preserve as much habitat as possible.
Mayor Maguire called for additional public comment. Hearing none, the mayor returned the
conversation to the Council for additional conversation.
The applicant responded to the question raised by Mr. Hagstrum about the number of units, saying they
are not prepared to offer a specific number of units or square footage of housing. They believe a
residential use for Elrene is appropriate.

Councilmember Fields moved, Councilmember Bakken seconded a motion to direct staff to submit to
the Metropolitan Council a Comprehensive Guide Plan Amendment to change the land use designation
from Major Office to Industrial, and Low and Medium Density Residential upon approximately 179 acres
located southeast of Yankee Doodle Road and Elrene Road, formerly the Thomson Reuters campus. The
property is legally described as Lot 1, Block 1, and Outlots B and C, West Publishing Company 4th
Addition; and Lot 1, Block 1, West Publishing Company 7th Addition. Aye: 4 Nay: 1 (Councilmember
Bakken). Motion carried.
Councilmember Bakken moved, Councilmember Supina seconded a motion to direct preparation of an
Alternative Urban Area-wide Review (AUAR) for the 179-acre site bounded by Yankee Doodle Road,
Elrene Road, and State Highway 149. Aye: 5, Nay: 1. Motion carried.
