However, he and I were unable to finalize our original discussion regarding your proposal to restart the daycare at Christ Lutheran Church before the start of this vacation. What I informed Joe was that I was willing to allow the daycare to restart with the understanding the number of children will not exceed the 15-20 children the City Council granted “temporary” approval of in 1983. The 10 you note is clearly below the threshold that Council accepted at that time. So at this time the City will not require you to seek a new Conditional Use Permit to restart daycare operations. However, if that number exceeds the 15 to 20 children staff would ask you submit a CUP. Since that 1983 approval the City has included “day care” as a conditional use within the Public Facility zoning district (which almost all churches are zoned PF) and staff has consistently required churches seeking new daycares or expanded daycare (increase in number of children), to gain CUP approval. Staff is unsure why Council granted only “temporary” approval, as indicated in the Council minutes, but obviously the daycare has been allowed to remain in operation for ~37 years. The benefit of seeking a CUP would formally recognize the day care use and remove the “temporary” approval granted in 1983 (Joe can forward you a copy of the minutes). You will not need to seek a CUP to restart your daycare for the10 children you note. However, staff encourages you to seek CUP approval if you expand the number of children under your license or if you want to remove the “temporary” language Council attached to the daycare at the church. I happen to have a meeting with Julie this morning, so I’ll touch base with her and the rest of our planning staff. I wanted to share with you the minutes I found from a 1983 City Council session regarding the CLC preschool. The minutes note that the Public Facility Zoning District where the church is located does not permit nursery schools, but that the City Council granted the church permission to operate a school on a temporary basis. The meeting minutes don’t define what ‘temporary’ means, but given the church suspended operations in 2021, City staff interpret that to mean the deal from 1983 between the Church and the City for the original preschool has expired. Having a CUP on record would clearly define the terms with which you’re allowed to operate a preschool. A CUP is a property right that “runs with the land” and under state statute (Minn. Stat. § 462.3595, subd. 3) a CUP remains in effect on the property as long as the conditions agreed upon are observed. Wendy Ashbridge, our preschool director, spoke with Julie at the City of Eagan in September asking if there were any zoning requirements for us and was told nothing was needed from us.
