12/17/2024 - City Council RegularMINUTES OF A REGULAR MEETING OF THE EAGAN CITY COUNCIL Eagan, Minnesota December 17, 2024 A Listening Session was held at 6p.m. prior to the regular City Council Meeting. Present were: Mayor Maguire, Councilmembers Fields, Bakken, Hansen, and Supina. A regular Eagan City Council meeting was held on Tuesday, December 17, 2024 at 6:30 p.m. Present were Mayor Maguire, Councilmembers Fields, Bakken, Hansen and Supina. Also present: City Administrator Miller, Public Works Director Matthys, Community Development Director Jill Hutmacher, City Planner Schultz, Finance Director Feldman, Police Lieutenant Johnson, Assistant City Administrator Alig, and Parks and Recreation Director Pimental. II. Adopt Agenda Councilmember Bakken moved, Councilmember Fields seconded a motion to adopt the agenda as presented. Aye: 5, Nay: 0. Motion carried. III. Recognitions and Presentations City Administrator Miller announced that Brian Thom, Shop Supervisor and Chief Mechanic, was honored with the "Supervisor of the Year" award by the American Public Works Association (APWA). Mr. Thom has been with the City for 19 years. Administrator Miller then introduced Monica Heil, who presented the award. Mr. Thom thanked the City Council for their leadership and thanked staff for the nomination. IV. Consent Agenda A. It was recommended to approve the minutes from the following City Council Meetings: • November 19, 2024 – Regular City Council Meeting • December 2, 2024 – Finance Committee Meeting • December 3, 2024 – Regular City Council Meeting B. Personnel Items: • It was recommended to approve the 2025 compensation plan for full time and part time non-union regular employees, interns, non-union part time recurring employees, non-union seasonal and temporary employees. • It was recommended to approve the collective bargaining agreement with the Teamsters Local 320- Clerical Unit. • It was recommended to approve the promotion in rank of Jessica Hoffman from Battalion Chief to Assistant Chief/Deputy Fire Marshal- Fire Prevention. • It was recommended to accept the resignation/retirement of Mark Dornseif, Parks Maintenance Worker and authorize replacement. It was recommended to approve the hiring of a Firefighter, to be named at a future City Council meeting. • It was recommended to approve the hiring of two Pathways to Policing employees, to be named at a future City Council meeting; to approve the authorization to fill the position of Utility Maintenance Worker – Production. • It was recommended to authorize the replacement for the position of Maintenance Coordinator position at the Civic Arena; and to approve the hiring of the following part-time recurring and seasonal employees: Mitchell Stafford Facility Operations Eric Olson Facility Operations Jack Bryntesen Rink Attendant Ryan Danich Rink Attendant Leighton Olson Rink Attendant Camryn Clark Rink Attendant C. It was recommended to ratify the check register dated November 29 and December 6 as presented. D. It was recommended to approve the following ordinary and customary contracts: • Municipal Advisory Agreement for Northland Securities to assist with the issuance of the $19.37M General Obligation Bonds, Series 2025A. • Joint Powers Agreement Between City of Eagan and Dakota County for Social Services Embedded Social Worker and Public Safety • Management Control Agreement Between Dakota County Social Services Department, Dakota County Sheriff's Office, and City of Eagan for Embedded Social Worker JPA • Video Services Agreement with the U.S Hockey Hall of Fame Museum E. It was recommended to adopt a Resolution to Accept the following Donations: • $2,500 donation from The Good Team (Wal-Mart) to be used towards the Shop with a Cop Initiative. F. It was recommended approve an Implementation Stormwater Resilience Grant Agreement with Minnesota Pollution Control Agency (MPCA) and authorize the Mayor and City Clerk to execute all related documents. G. It was recommended to approve the updated Sperry Tower Lighting Schedule. H. It was recommended to receive the Draft Feasibility Report for Project 1566 (Birch Park/ Windcrest/ Denmark Avenue/ Deerwood Drive - Street Improvements) and schedule a public hearing to be held on January 21, 2025. I. It was recommended to receive the Draft Feasibility Report for Project 1567 (Cedar Industrial - Street Improvements) and schedule a public hearing to be held on January 21, 2025. J. It was recommended to receive the Draft Feasibility Report for Project 1571 (Ridgecliff 1st/ Berkshire Ponds/ Parkridge/ Safari/ Covington Lane - Street Improvements) and schedule a public hearing to be held on January 21, 2025. K. It was recommended to receive the Draft Feasibility Report for Project 1572 (Slater Acres/ Whispering Woods 1st and 2nd - Street Improvements) and schedule a public hearing to be held on January 21, 2025. L. It was recommended to approve a Joint Powers Agreement with the Dakota County Transportation Department for Projects 1537 (County Project 31-112) and 1620 (County Project 43-57), County Highway Trail Improvements, approve a resolution amending the Public Works Department’s 5-Year Capital Improvement Plan (CIP) (2025-2029) to add trail improvements along a segment of Lexington Avenue (CSAH 43), and authorize the Mayor and City Clerk to execute all related documents. M. It was recommended to approve the plans and specifications for Contract 25-07 (2025 Water Quality Improvements) and authorize the advertisement for a bid opening to be held at 10:30 a.m. CST on Friday, January 24, 2025, via an electronic bid site. N. It was recommended to approve the plans and specifications for Contract 24-19 (Cliff Lake Road – Sewer Televising) and authorize the advertisement for a bid opening to be held at 10:00 a.m. CST on Thursday, January 9, 2025, via an electronic bid site. O. It was recommended to receive the petition to vacate public drainage and utility easements on Lot 1 and the south half of Lot 2, Block 2, Letendre Addition (Vacation Document No. 882729) and Utility Line Easement Document No. 391013, and schedule a public hearing to be held on January 21, 2025. P. It was recommended to approve a Final Plat (Valhalla Addition) to create one lot upon 2.91 acres located at 4395 Dodd Road. Q. It was recommended to approve Final Payment to Jackson & Associates, LCC in the amount of $61,250 for CMF Metal Roof Project. R. It was recommended to approve Change Order No. 6 for Goat Hill Phase 3 Improvements (City Project 1557) S. Approve Change Order No. 7 for Eagan Art House (City Project 1558) T. ITEM PULLED U. Approve a resolution authorizing the issuance and sale of approximately $19,370,000 in General Obligation Bonds, Series 2025A. V. It was recommended to adopt a Resolution to approve an Off-Site Gambling Permit for the Eagan Lions Club to conduct bingo during the Viking Lakes Winter Skoltice. W. It was recommended to adopt a Resolution directing the City Clerk to issue 2025 alcohol license renewals upon licensees’ submission of renewal documents and fees. X. It was recommended to approve the 2025 Community Waste Abatement Grant Agreement. Y. It was recommended to approve Plans and Specifications for City Contract 25-08, Sky Hill Athletic Courts and Authorize the Advertisement for Bids V. Public Hearings A. VACATE Drainage & Utility Easement, Lot 3, Block 1, Sky View (Parkside Circle) City Administrator Miller introduced the item and noted all affected property owners have received notice. No objections were received. Administrator Miller invited Public Works Director Matthys to provide more information. Director Matthys provided a presentation detailing the plat and current drainage easements. Director Matthys stated that the property was re-platted on September 17, 2024, but the easements were not vacated during the approval of the redevelopment plat. The new development has incorporated all necessary drainage and utility easements, rendering the existing easements obsolete. There were no comments from the public. There were noquestions from @Dianne Miller Council Members. Council Member Hansen moved and Council Member Fields seconded a motion to close the Public Hearing and approve the vacation of the drainage and utility easements at Lot 3, Block 1, Sky View. Aye: 5, Nay: 0. Motion carried. B. APPROVE an ordinance establishing the Townhomes of Widgeon Woods Housing Improvement Area and Adopt Resolution imposing an improvement fee on housing units therein. City Administrator Miller introduced the item and invited Community Development Director Hutmacher to provide further details. Director Hutmacher then presented additional information, including a summary of estimated costs. HIA consultant Doug Strandness, Finance Director Josh Feldman, and Financial Advisor Tammy Omdal were available for questions. The Mayor invited representatives from Widgeon Woods to speak. HOA Board President Jane Tunseth expressed gratitude to the Council for their consideration. Councilmember Supina moved and Councilmember Bakken seconded a motion to close the Public Hearing and adopt an ordinance establishing the Townhomes of Widgeon Woods Housing Improvement Area and to adopt a resolution imposing an improvement fee on housing unites therein. COMPREHENSIVE GUIDE PLAN AMENDMENT, PRELIMINARY SUBDIVISION, REZONING and PRELIMINARY PLANNED DEVELOPMENT - Veterans Village - Steve Troskey/ Lennar Corporation - A Comprehensive Guide Plan change from QP, Quasi- Public to MD, Medium Density, A Preliminary Subdivision to create 2 lots for 22 townhome units, A Rezoning from PF, Public Facility to PD, Planned Development to allow for 22 townhome units and a Preliminary Planned Development to allow 22 townhome units located at 3920 Rahn Road. City Administrator Miller introduced the item and invited City Planner Schultz to provide further details. City Planner Schultz presented a location map and staff report on the project. Jon Lovald, CEO of the Minnesota Assistance Council for Veterans thanked the Council for their consideration. The Mayor called for questions or comments from the Council. A question was raised regarding trash collection. Joe Jablonski, Vice President of Land Development at Lennar, provided further information on potential options. The Mayor called for comments from the public. Whitaker Salts, middle school student at Blackhawk Middle School spoke in favor of the project as it would help homeless veterans. Paul Hirsh, 3928 Beryl Road, expressed concerns about the safety of the community due to the proximity of a public park and what services MACV will be providing. Nick Erickson, 4505 Oak Pond Road, noted he was with Housing First and a resident of Eagan, noted his support for this project. City Administrator Miller reviewed one question. Mr. Lovald responded, stating that MAC-V would be providing supportive services to assist Veterans living in the development. Councilmember Hansen moved and Councilmember Fields seconded a motion to implement a Comprehensive Guide Plan Amendment to change the land use designation from Quasi-Public to Medium Density upon approximately 2.7 acres located at 3920 Rahn Road legally described as Lot 1, Block 1 Mount Calvary Addition. Aye: 5, Nay: 0. Motion carried. Councilmember Fields motioned and Councilmember Hansen seconded a motion to approve a rezoning from public facility to planned development upon approximately 2.7 acres located at 3920 Rahn Rd legally described as Lot 1, Block 1 Mount Calvary Addition subject to the conditions listed in the APC minutes. Aye: 5, Nay: 0. Motion carried. Councilmember Supina moved and Councilmember Bakken seconded a motion to approve a Preliminary Planned Development to approve 22 Townhome units upon approximately 2.7 acres located at 3920 Rahn Rd legally described as Lot 1, Block 1 Mount Calvary Addition subject to the conditions listed in the APC minutes. 1. A Preliminary Planned Development Agreement shall be executed and recorded against the property at the Dakota County Recorder’s office. The Preliminary PD Agreement shall contain the following plans: • Preliminary Site Plan (revised for parking) • Preliminary Building Elevations • Preliminary Landscape Plan 2. A Final Planned Development Agreement shall be required prior to issuance of a Building Permit. The following plans are required for the Final Planned Development Agreement and shall be consistent with the approved Preliminary Planned Development: • Final Site Plan (revised for trash/recycling location) • Final Building Elevations including trash enclosure and screen wall • Final Landscape Plan • Final Tree Mitigation Plan • Final Planting Plan • Final Site Lighting Plan 3. The Planned Development shall have a term of three (3) years. 4. This Preliminary Planned Development approves a townhome development with 22 units. Platting 5. The property shall be platted prior to issuance of a building permit. 6. The developer shall dedicate standard drainage and utility easements around the perimeter of the property Mechanical Screening 7. All mechanical equipment shall be screened in accordance with the provisions of the City’s zoning code. Site Plan 8. The Site Plan shall be revised to modify the parking count near units 20-23. Architecture 9. The trash enclosure shall be relocated to a centralized location to be approved by the City Planner. 10. The developer shall demonstrate sufficient recycling capacity of .1 cubic yards per unit. 11. The trash enclosure shall be designed consistent with City Code standards in compliance with City Code Section 11.70 Subd. 21.D.7. Signage 12. All signage shall be subject to compliance with the City Sign Code standards, and a Sign Permit shall be obtained prior to installation of any signs. Address Numbers 13. Building address numbers shall be installed consistent with the provisions of Section 2.78 of City Code. Site Lighting 14. Site lighting shall be provided in conformance with City Code standards. Fixtures shall be downcast and shielded so the source of light is not visible from off the property, illumination throughout the parking lot should be not less than 0.5 footcandles and shall not exceed 1.0 footcandle at the property line. Landscaping and Tree Preservation 15. The applicant shall submit a revised Landscape Plan minus tree mitigation. 16. The applicant shall submit a Tree Mitigation Plan. 17. The applicant shall fulfill tree mitigation requirements through the installation of ninety-four (92) Category B trees or an equivalent thereof and/or cash payment ($500.00 per Category B) tree in lieu as determined by the City Forester. 18. The applicant shall submit a Planting Plan which combines both landscape and tree mitigation requirements. 19. A performance guarantee in the amount of $8,850.00 shall be required for the preservation of trees within 15 feet of the construction zone. The performance guarantee is to be collected prior to the issuance of any land disturbance permit. 20. The applicant shall ensure the survival of preserved trees via protection of the tree’s critical root zones through the placement of required Tree Protective measures (i.e., orange colored silt fence or four-foot polyethylene laminate safety netting), to be installed at the Drip Line or at the perimeter of the Critical Root Zone, whichever is greater, of significant trees/woodlands to be preserved on-site. 21. The applicant shall contact the City Forestry Division and set up a pre-construction site inspection at least five days prior to the issuance of the grading permit to ensure compliance with the approved Tree Preservation Plan and placement of the Tree Protection Fencing. Grading 22. The plans shall reflect necessary grading within the old Rahn Road right-of-way for storm sewer installation. 23. Retaining walls are proposed in multiple locations throughout the site for grading purposes, the developer shall obtain a separate building permit for retaining walls with a design height greater than 4-feet. 24. The retaining walls shall be designed and certified by a licensed engineer. Storm Drainage 25. The applicant shall provide a minimum of 15-foot-wide unobstructed equipment access path (without obstructions from grading, private utilities, trees, large shrubs, etc.), from street- edge to all stormwater facilities’ inlets/outlets for private maintenance. The unobstructed equipment access path should be capable of supporting typical maintenance / excavation equipment, for periodic maintenance access to the filtration basin. 26. All erosion/ sediment control plans submitted for development and grading permits shall be prepared by a designer who has received current Minnesota Department of Transportation (MNDOT) training, or approved equal training as determined by the City Engineer in designing stormwater pollution prevention plans. Also, all personnel responsible for the installation of erosion/ sediment control devices, and the establishment of vegetation for the development, shall have received Erosion/Sediment Control Inspector/Installer certification through the University of Minnesota, or approved equal training as determined by the City Engineer. 27. This development shall comply with Eagan’s Land Disturbance Stormwater Pollution Prevention and Post-Construction Stormwater Management Requirements (City Code Section 4.34) for stormwater management and surface water quality, including land disturbance requirements and water quality treatment equivalent to 1.1-inch Volume Control, for effective treatment of the site’s impervious surface area (including effective soil remediation for all of the site’s disturbed soils that are to be revegetated greenspace). 28. The applicant shall provide adequately sized pre-treatment structures (e.g. 4-foot minimum depth sump, 5-foot minimum diameter, with floatable skimmer hood, energy dissipation, etc.) at, or immediately upstream of, any stormwater facility inlet to provide for effective capture and easily-accessible cleanout of fine-sand sized particles and floatable pollutants. Pre-treatment structures shall be accessible by appropriate maintenance equipment. Details shall be included in applicable plan sheet(s) using Eagan Standard Detail Plate E231. 29. Prior to receiving City approval to permit land disturbing activity, the applicant shall provide appropriate details for an enhanced-removal filtration basin, which shall include the removal of a majority of dissolved phosphorus from the site’s stormwater runoff to the filtration basin, to the satisfaction of the City Engineer. Details shall include construction cross- sections and notes to include an appropriate impermeable liner and under-drain with cleanout/vents. Plans shall include iron-sand mix specification/composition/source and appropriate estimated iron-sand mix volume needed based on accepted calculations for majority capture of dissolved phosphorus and minimum of 25-year service life (approximately 50 cubic yards or 66 tons of iron-sand mix). Basin inlets (pipe outfalls) shall have appropriate rip-rap with fabric beneath (following City Details) extending to the basin bottom elevation, to prevent discharging onto side-slopes. Basin bottom with exposed iron- sand shall not be planted, but remainder of basin bottom shall be live-planted with appropriate species at 18-inch on-center spacing with biodegradable netting erosion-control blanket (or covered in 3 inches of pea-gravel). Side slopes shall be seeded and/or live planted and covered with erosion-control blanket with biodegradable netting. Details shall include temporary erosion-control protections at top and toe of side-slopes and sediment log surrounding the iron-sand filter portion. These graphical details and notes shall be prominently included in all applicable plan sheets (e.g. Grading Plan, Utility Plan, etc.). Pertinent plan sheets shall also include notes that grading and utility contractor(s) shall provide minimum of 24-hours advance notice to City Water Resources Staff of any grading or utility work involving the proposed filtration basin system and installation of any pre- treatment structures, inlets, outlets and any other structural components or critical construction steps, providing contact email and phone number for City Water Resources Staff for arranging inspections at critical construction steps. 30. Prior to receiving city approval to permit land disturbing activity, the property owner shall provide detailed Soil Management Strategies in the plan set for City review, and acceptance by the City Engineer, that provide graphical details and notes on soil protection/restoration in the Stormwater Management Plan and prominently included in all applicable plan sheets (e.g. Erosion & Sediment Control Plan, Grading Plan, Landscape Plan, etc.) and shall specify estimated quantities of soil ripping area and volume of compost to be imported and incorporated on pertinent plan sheet quantity tables. Prior to receiving a Certificate of Occupancy for any affected construction, Soil Management Strategy implementation documentation (e.g. haul tickets, representative on-site soil samples, compaction testing and soil organic content test results) shall be provided to City Water Resources staff to verify approved soil management strategy compliance. Notes shall be provided that implementing contractor shall provide 24-hours advance notice to City Water Resources staff prior to implementation of soil loosening and amendment. 31. Prior to proceeding with land disturbing activity, the Property Owner shall enter into a long- term stormwater management system maintenance agreement with the City, detailing the annual inspection and maintenance required to occur to ensure proper operation and performance of the private permanent stormwater management system, in a form acceptable to the City Attorney. 32. Before the city returns any Stormwater-related Performance Guarantee Fees on the development site, the applicant shall demonstrate that all stormwater management practices are performing as intended and shall provide the City Engineer as-built plans meeting City requirements for as-built standard submittals that demonstrate that all constructed stormwater conveyance structures, stormwater management facilities (sump(s), filtration basin, conveyance piping/discharge, etc.), including soil loosening & amendment prior to landscaping, conform to design and/or construction plans, as approved by the City. The applicant shall submit to the City Engineer certification that the stormwater management facilities have been installed in accord with the plans and specifications approved. This certification shall be provided by a Professional Engineer licensed in the State of Minnesota. Utilities 33. The developer shall obtain a sewer and water permit as well as a right-of-way permit for the work to be conducted in Rahn Road. 34. The developer shall provide utility plans meeting the City’s engineering standards including, but not limited to, profile views and utility crossings. Streets/ Access/ Pedestrian Circulation 35. The developer shall replace and repair all pavements, curb and gutter, sidewalks, trails, and boulevards disturbed by construction activities within public right-of-way. 36. The developer shall obtain a right-of-way permit for work conducted within the old Rahn Road right-of-way. 37. No street parking will be allowed within the development. “No Parking Fire Lane” signs shall be installed on both sides of the drive aisles throughout the development. Engineering- Agreements 38. The developer shall enter into an encroachment agreement with the City for this storm pipe and structures in a manner acceptable to the City Attorney. 39. The developer shall provide a maintenance agreement for the privately owned storm sewer in a manner acceptable to the City Attorney. 40. Private utility maintenance agreements for the private utilities shall be provided in a form acceptable to the City Attorney. 41. Cross-easements for ingress/egress and shared parking shall be executed in a form acceptable to the City Attorney. 42. The developer shall provide private maintenance agreements for the private streets, in a form acceptable to the City Attorney, at time of final subdivision approval. 43. The developer shall provide an encroachment agreement for installing storm sewer within the old Rahn Road right-of-way. Engineering- Other 44. This development shall provide hydrant spacing and locations in accordance with City Fire Department and Public Works standards, generally this will require at least one hydrant added to the north side of the site to adequately cover lots 17-23. 45. The developer shall provide a contractor staging and parking plan in a manner acceptable to the City Engineer. Parks and Recreation 46. This development is subject to cash park and trail dedication due with the building permit at the rates then in effect. The 2024 rate for park dedication is $4,466 per unit, and $310 per unit for trail dedication. Councilmember Fields and Councilmember Bakken seconded a motion to approve a Preliminary Subdivision (Mount Calvary 2nd Addition) to create 24 lots upon 6.7 acres of land located at 3920 Rahn Rd legally described as Lot 1, Block 1 Mount Calvary Addition subject to the conditions listed in the APC minutes. 1. The developer shall comply with these standards conditions of plat approval as adopted by Council on July 1, 2014: A1, B1, C1, C2, C4, E1, G1 H1 and L1. 2. The property shall be platted. 3. The unobstructed equipment access path should be capable of supporting typical maintenance / excavation equipment, for periodic maintenance access to the filtration basin. 27. All erosion/ sediment control plans submitted for development and grading permits shall be prepared by a designer who has received current Minnesota Department of Transportation (MNDOT) training, or approved equal training as determined by the City Engineer in designing stormwater pollution prevention plans. Also, all personnel responsible for the installation of erosion/ sediment control devices, and the establishment of vegetation for the development, shall have received Erosion/Sediment Control Inspector/Installer certification through the University of Minnesota, or approved equal training as determined by the City Engineer. 28. This development shall comply with Eagan’s Land Disturbance Stormwater Pollution Prevention and Post-Construction Stormwater Management Requirements (City Code Section 4.34) for stormwater management and surface water quality, including land disturbance requirements and water quality treatment equivalent to 1.1-inch Volume Control, for effective treatment of the site’s impervious surface area (including effective soil remediation for all of the site’s disturbed soils that are to be revegetated greenspace). 29. The applicant shall provide adequately sized pre-treatment structures (e.g. 4-foot minimum depth sump, 5-foot minimum diameter, with floatable skimmer hood, energy dissipation, etc.) at, or immediately upstream of, any stormwater facility inlet to provide for effective capture and easily-accessible cleanout of fine-sand sized particles and floatable pollutants. Pre-treatment structures shall be accessible by appropriate maintenance equipment. Details shall be included in applicable plan sheet(s) using Eagan Standard Detail Plate E231. 30. Prior to receiving City approval to permit land disturbing activity, the applicant shall provide appropriate details for an enhanced-removal filtration basin, which shall include the removal of a majority of dissolved phosphorus from the site’s stormwater runoff to the filtration basin, to the satisfaction of the City Engineer. Details shall include construction cross-sections and notes to include an appropriate impermeable liner and under-drain with cleanout/vents. Plans shall include iron-sand mix specification/composition/source and appropriate estimated iron-sand mix volume needed based on accepted calculations for majority capture of dissolved phosphorus and minimum of 25-year service life (approximately 50 cubic yards or 66 tons of iron- sand mix). Basin inlets (pipe outfalls) shall have appropriate rip-rap with fabric beneath (following City Details) extending to the basin bottom elevation, to prevent discharging onto side-slopes. Basin bottom with exposed iron-sand shall not be planted, but remainder of basin bottom shall be live-planted with appropriate species at 18-inch on- center spacing with biodegradable netting erosion-control blanket (or covered in 3 inches of pea-gravel). Side slopes shall be seeded and/or live planted and covered with erosion-control blanket with biodegradable netting. Details shall include temporary erosion-control protections at top and toe of side-slopes and sediment log surrounding the iron-sand filter portion. These graphical details and notes shall be prominently included in all applicable plan sheets (e.g. Grading Plan, Utility Plan, etc.). Pertinent plan sheets shall also include notes that grading and utility contractor(s) shall provide minimum of 24-hours advance notice to City Water Resources Staff of any grading or utility work involving the proposed filtration basin system and installation of any pre- treatment structures, inlets, outlets and any other structural components or critical construction steps, providing contact email and phone number for City Water Resources Staff for arranging inspections at critical construction steps. 31. Prior to receiving city approval to permit land disturbing activity, the property owner shall provide detailed Soil Management Strategies in the plan set for City review, and acceptance by the City Engineer, that provide graphical details and notes on soil protection/restoration in the Stormwater Management Plan and prominently included in all applicable plan sheets (e.g. Erosion & Sediment Control Plan, Grading Plan, Landscape Plan, etc.) and shall specify estimated quantities of soil ripping area and volume of compost to be imported and incorporated on pertinent plan sheet quantity tables. Prior to receiving a Certificate of Occupancy for any affected construction, Soil Management Strategy implementation documentation (e.g. haul tickets, representative on-site soil samples, compaction testing and soil organic content test results) shall be provided to City Water Resources staff to verify approved soil management strategy compliance. Notes shall be provided that implementing contractor shall provide 24- hours advance notice to City Water Resources staff prior to implementation of soil loosening and amendment. 32. Prior to proceeding with land disturbing activity, the Property Owner shall enter into a long-term stormwater management system maintenance agreement with the City, detailing the annual inspection and maintenance required to occur to ensure proper operation and performance of the private permanent stormwater management system, in a form acceptable to the City Attorney. 33. Before the city returns any Stormwater-related Performance Guarantee Fees on the development site, the applicant shall demonstrate that all stormwater management practices are performing as intended and shall provide the City Engineer as-built plans meeting City requirements for as-built standard submittals that demonstrate that all constructed stormwater conveyance structures, stormwater management facilities (sump(s), filtration basin, conveyance piping/discharge, etc.), including soil loosening & amendment prior to landscaping, conform to design and/or construction plans, as approved by the City. The applicant shall submit to the City Engineer certification that the stormwater management facilities have been installed in accord with the plans and specifications approved. This certification shall be provided by a Professional Engineer licensed in the State of Minnesota. Utilities 34. The developer shall obtain a sewer and water permit as well as a right-of-way permit for the work to be conducted in Rahn Road. 35. The developer shall provide utility plans meeting the City’s engineering standards including, but not limited to, profile views and utility crossings. Streets/ Access/ Pedestrian Circulation 36. The developer shall replace and repair all pavements, curb and gutter, sidewalks, trails, and boulevards disturbed by construction activities within public right-of-way. 37. The developer shall obtain a right-of-way permit for work conducted within the old Rahn Road right-of-way. 38. No street parking will be allowed within the development. “No Parking Fire Lane” signs shall be installed on both sides of the drive aisles throughout the development. Engineering- Agreements 39. The developer shall enter into an encroachment agreement with the City for this storm pipe and structures in a manner acceptable to the City Attorney. 40. The developer shall provide a maintenance agreement for the privately owned storm sewer in a manner acceptable to the City Attorney. 41. Private utility maintenance agreements for the private utilities shall be provided in a form acceptable to the City Attorney. 42. Cross-easements for ingress/egress and shared parking shall be executed in a form acceptable to the City Attorney. 43. The developer shall provide private maintenance agreements for the private streets, in a form acceptable to the City Attorney, at time of final subdivision approval. 44. The developer shall provide an encroachment agreement for installing storm sewer within the old Rahn Road right-of-way. Engineering- Other 45. This development shall provide hydrant spacing and locations in accordance with City Fire Department and Public Works standards, generally this will require at least one hydrant added to the north side of the site to adequately cover lots 17-23. 46. The developer shall provide a contractor staging and parking plan in a manner acceptable to the City Engineer. Parks and Recreation 47. This development is subject to cash park and trail dedication due with the building permit at the rates then in effect.
