1345 Deerwood Dr - Letter of Violation March 3, 2025 Larry Rodich 1345 Deerwood Drive Eagan, MN 55122 NOTICE OF ALLEGED VIOLATION (NOAV) Eagan Stormwater Management and Grading Requirements Dear Mr. Rodich, The City of Eagan hereby issues this Letter of Code Violation regarding compliance with City Code sections, Sec. 4.34 Stormwater Management Regulations and Sec.4.30 Excavation & Fills. On Tuesday, February 18, 2025, City staff conducted a follow-up inspection regarding a complaint at 1345 Deerwood Dr, Eagan, MN. Approximately 150-200 cubic yards of fill material was deposited along the southern slope of the property. Staff observed the deposited material was in excess of 5 feet in depth, resulting in changes to the natural contour of the land and site drainage. The scope of the observed activity is defined in Eagan City Code §4.34 (B)(2)(f) and §4.30(3)(A) which requires prior City authorization and permits. The corrective actions requested are as follows: Corrective Action Due Cease and desist all grading, filling, or other similar construction activity Immediately Submit a completed application for a Stormwater Management Permit using Eagan’s online permitting portal at Eagan.onlama.com Immediately Stabilize all placed fill material using an acceptable MNDOT approved method to include but limited to erosion blanket, hydraulically applied mulch, or an approved equal. The earthen fill material must be seeded with an acceptable perennial turf grass mix or an approved equal. March 12, 2025 Sediment control (ex. Silt fence, staked sediment logs, or an approved equal) shall be installed along the base of the slope to catch any runoff from the impacted slope. All sediment control shall remain installed and kept in good working order until the bare soils are stabilized with an adequate perennial vegetative cover. March 12, 2025 Establish at least 80% uniform coverage of a perennial turf grass mix (or an approved equal) shall be required within the impacted slope area June 30, 2025 Failure to take corrective action by the deadlines provided may result in additional enforcement action on behalf of the City.
