There is hereby established the POILce DePartaost of the Township of Eagan,

SECTION 11
Patrolman
Appointments to the Police Department shall be made from a list of eligible
applicants. This list shall be prepared by the Chief of Police and/or the Board of
Supervisors or other person(s) appointed by the Board of Supervisors. A new list shall
be compiled annually when necessary to appoint an individual to the police force.
To be considered for placement as a patrolman, an applicant must fulfill the
following minimum requirements:
I - At least a high school. graduate.
2. At least 23 years of age and not more than 35 years of age unless waived by
the Chief of Police and/or the Board of Supervisors because of previous
police experience or other exceptional qualification(s).
3. Applicant must be at least five feet eight inches tall in bare feet and a
minimum of 150 pounds s"ripped.
4. Signed statements by a doctor of medicine and an optometrist, licensed by
the State of Minnesota, stating that he is in good physical condition anu
has no impairments that would affect his work as a police officer and that
this has been determined by a complete and thorough ex-,nination no earlier
than ten (10) days prior to the submission of the application.
5. Evidence of a good credit rating. Affidavits from three references stating
that he is of good moral character, has temperate and industrious habits,
is orderly in deportment, is in all respects fit for police service, and
that the sitgner of this statement is willing to `,ave this statement made
public.
6. Each applicant shall submit in writing to the Chief of Police and/or the
Chairman of the Town Board a statement under oath giving a complete record,
as to his name, date and place of birth, name of each parent, each residence
and occupation for the preceding ten (10) years, education and other informa-
tion as may be required. A clear set of fingerprints shall be obtained and
forwarded to the F.B.I. for investigation. The F.B.I. report shall be attached
to his application and become a permanent part of his record.
7. Obtain a satisfactory grade on a written examination which will be designed
to obtain an indication of the applicant's intelligence, knowledge of basic
law, and suitability of personality for service in the police force. This
test is to be designed by persons of acknowledged competence in these matters
appointed by the Board of Supervisors and/or the Chief of Police.
8. If requested, shall pass a physical agility test.
9. Satisfactorily complete an oral examination to be conducted by three persons
appointed by the Chief of Police and the Board of Supervisors to determine
the suitability of the personality of the applicant in his appearance, approach,
poise, respon.§et ability to express himself orally, and the like. The Chief
of Police may also conduct any other such examinations as he may see fit.
10. Must become a resident of Eagan Township within six months after appointment.

SECT iON III
Serzeant
,ro be considered for placement as a sergeant, an applicant must fulfill the
following mininium requiremen, s:
1. He shall. have two years experience as a full-time police officer and at
least one year on the Eagan police force.
2. He must be a member of the Eagan Police Department at the time of his
appointment to the position of sergeant.
3. He must satisfactorily pass a written examination and a physical examina-
tion. (including psychiatric exam, if requested) and an oral examination
if requested.
4® He shall be appointed to the position of sergeant by the Chief of Police
and the Board of Supervisors or other person(s) appointed by the Board
of Supervisors.

SECTION IV
T e rin i nsion & Tenure

The following items relate to termination, suspension and tenure-,
1. All appointments shall be provisional for one year and may be terminated
upon recommendation of the Chief of Police and the majority of the Town
Board.
2. After the one-year probationary period has expired, an officer may be
-removed from the force only on the recommendation of the Chief of Police
and the unanimous vote of the Board of Supervisors at a special public
meeting. The Chief of Police may order the suspension of an officer for up
to ten (10) days, with or without pay at his discretion but if without pay,
action must be approved by the Town Board by a majority vote, in any one
year for disciplinary reasons. Any suspensions after the ten days' suspen-
sion in one year and up to thirty (30) days must be made by the Town Board
upon the recommendation of the Chief of Police. Thirty-one (31) days'
suspension in any eighteen (18) month period must result in the officer's
removal. from the police force.
3. Upon the request of the Chief of Police or the Board of Supervisors, an
officer must submit to a complete physical examination (including eye exam
and psychiatric, if requested) conducted by licensed physician(s) from the
SLa,Le of Minnesota. Signed statements frofft such physician(s) shall be
presented to the Chief Of Police and/or the Town Board. Should such an
examination(s) disclose that the officer is for any reason, other than that
of a temporary nature, not sound in all, respects or not physically qualified
for the requirements of the police department, he shall be removed from the
police force. Such removal may be vacated by contrary evidence by a majority
of a three physician team if so requested by the affected officer®
4. All officers of the Eagan Police Department who have been so engaged for at
least six months prior to the enactment of this ordinance shall be appointed
to the police department and shall be considered to have fulfilled the
probationary period.

SECTION V
Acting Chief of Police
.An applicant for Acting Chief of Police shall meet the following requirements:
1. Bea. Member of the Eagan Police Department for at least two years.
2. Be at least thirty years of age.
3. An Acting Chief of Police may be appointed by a majority of the: Board of
Supervisors. He serves at the pleasure of the Board and may be removed at
any time by a majority of the Beard.

SECTION VI
Chief. of Police
An applicant for Chief of Police shall meet the following requirements:
1. Be at least thirty years of age.
2. Possess a minimum of five years' experience in police work.
3. Must become a resident of Eagan Township within six months after appointment.
4. Any other requirements set by the Board of Supervisors at a given time.
The responsibilities and duties of this office shall be:
1. The Chief of Police shall be the chief executive officer of the police de-
partment and shall have direct control and management of all members of the
department in the lawful exercise of their duties, subject to the provisions
of law and township ordinances, and subject to such other orders as may be
issued by the Town Board as provided by law.
2. The Chief of Police shall be responsible for the maintenance of order, the
enforcement of laws and the ordinances and regulations of the township, the
prevention of crime, the protection of life and property, and the safety
education of residents of the township.
3. The Chief of Police shall maintain rigid discipline so as to secure complete
efficiency in the department.
4. The Chief of rolice shall be responsible for the training of police officers
so as to establish and maintain a high degree of competance and efficiency.
5. The Chief of Police shall cooperate with the Civil Defense Director in estab-
lishing and making efficient use of the Civil Defense Police Reserve so as to
supplement the regular police department.
6. The Chief of Police shall have the authority to issue such administrative
rules and regulations as are necessary to govern the police department and
to provide for the department to function on the highest level of efficiency,
including the prescribing of penalties for violation of such rules and
regulations.
7. The Chief of Police shall be responsible for the custody, care and control
of the public property and equipment of the police department.
8. The Chief of Police shall keep an accurate record of all complaints, arrests,
violations, convictions and the disposition of each case handled by the
department and all other such records as may be required by the state,
9. The Chief of Police shall subatit an Annual Report at the Annual Town Meeting
which shall include a proposed budget, such recommendations as he shall deem
advisable with respect to departmental organization, personnel, property or
equipment, police and police reserve training, safety education programs,
ordinances or other such matters as he shall consider to affect the effective
operation of the department in the public interest.
