The inte ded purpos eand organization of a cooperative agreement is set forth in the enclosod agreement form which has been draf ted by the Police Chief"s-Association as their recommended method of implementing the concept. The ideas contained in the agreement form were discussed by the Criminal Justice Council at length, and after a thorough consideration' the members voted unanimously in support of that concept. Engineer, Whirlpool 1/17/74 vmb DAKOTA LAW ENFORCEMENT ASSOCIATION AGREEMENT The undersigned governmental units hereby recognize the need 'to prepare t { to deal adequately with current crime problems and'proble'ms of law enforcement which could intensify with continuing population growth and changes and which are of a regional nature and are occurring or likely to occur within the region represented by Dakota County. WHEREAS, they likewise recognize that they all have the power to., and do in fact, maintain police departments and police personnel, and WHEREAS, one of the stated purposes of the Association shall be to preserve the authority and responsibility of local law,.enforeement to the extent to which it is practical and economical, and WHEREAS, the undersigned governmental.±units recognize that pursuant to . the provisions of the Joint Exercise of Powers Act, :Section 471.`53 of 'Minnesota Statutes,, they have the authority to enter into this agreement where they are jointly and cooperatively exercising a power common to all of the-contracting parties; and. , ,pursuant to this, and in order to insure that A proper regional organization be established ' ities involved with. authority and responsibility representative of the various municipal to research and study problems of law enforcement of a. regional nature, together ,with ' the authority and power to implement such regional .services as hereinafter set forth and., the parties hereto do establish the following ©rgaanizati, with the management authority vested herein as set forth as follows: 1) The name shall be Dakota Law Enforcement Association. 2} The membership of the Dakota La-%v Enforcement A.ssoc�iation shall consist of chief o- police- � y, together .,� h.. f o�_icP- o_f each participating govern�riental txn�.t in Dakota Count 1, with,one :individual to be appointed by the governing body cif than governmental unit. The County shall be represented by the Sheriff anti Qne`'othe ` individual appointed by t the .Board of County Commissioners. In addition,,, the hoard of Counter Commissioners shall appoint two individuals: one to repr°esent.the'unincorporated areas within the County and one to represent the incorporated areas`-zn the County who do not have a police department. The police chiefs and Sheriff shall be permanent `members of',the Dakota Law Enforcement Association. All other members shall serve for a one-year term, their terms to begin on the First of January of each year. 3) The Dakota Law Enforcement Association shall be governed by a 7-man board of directors selected from among their member s, four of whom shall be members of a law enforcement agency. The board of directors shall select its own chairman, vice-chairman, and secretary-treasurer, who shall serve for a period of one year, their terms to begin on the first day of each year. The chairman, vice-chairman and secretary-treasurer shall serve at all meetings of the Board of Directors and shall also serve in that capacity at all general meetings of the Dakota Law Enforcement Association. All meetings of the board of directors and the Dakota Law Enforcement Association shall be called by the chairman of the board of directors. And further, the first meeting of the Dakota Law Enforcement Association shall be called by the President of the Dakota County Police Chiefs Association and in no event shall be called later than May 1, 1974. At that time, the Dakota Law Enforcement Association shall select its board of directors and shall determine the method, time, place and frequency of their subsequent meetings. The Dakota Law Enforcement Association shall adopt such rules and regulations for the conduct of its general business as may be expedient and necessary and conformable to law. 4) That the governmental units hereby delegate to the Dakota Law Enforcement Association and its board of directors herein described that they be empowered as follows: (a) To undertake research and initial recommendations for law enforcement which may be regional in nature and regional in responsibility or that have a common purpose which could be carried on in a more efficient manner collectively than separately. (b) To initiate and carry on law enforcement responsibilities which are of mutual concern to the parties to the agreement,, including the authority to hire the personnel. necessary and acquire the equipment and property that might be called for i.n an), one of the projects which might be determined to be of regional significance_ However, no governmental unit shall he liable for expenditures made by the Dakota Law Enforcement Association without approval of ,.t.he governing body of that governmental unit. 2 (c) That the area over which this Dakota`Lam Enforcement Association shall have responsibility shall be the entire County of Dakota. (d) That the Dakota Law Enforcement Association shall have the authority to make application for State and Federal funds, toenter into contracts with various State and Federal agencies in regard to the expenditure of such funds; the Dakota Law Enforcement Association shall have the authority to make application to and receive funds ,from various foundations, organizations, or individuals to assist the Dakota Law Enforcement Association in carrying out its responsibilities; the Dakota Law Enforcement Association shall have the authority to receive funds from, any local governmental units to assist it in carrying out its responsibilities. (e) Any new programs may be initiated;by the Dakota Law Enforcement Association upon majority vote of its members at any regular,meeti:ng of the Dakota Law Enforcement Association. 5) That each participating governmental unit may withdraw from this Agreement upon ninety (90) days written notice to the Dakota Law Enforcement Association. IN WITNESS WHEREOF, we, the undersigned, on behalf of our governmental unit, do hereby bind'ourselves in accordance with the terms and conditions of this Agreement, 'executed this day of 1973.
