MINUTES OF A REGULAR MEETING OF
THE EAGAN CITY COUNCIL

March 18, 2025
A Listening Session was held at 6:00 p.m. prior to the regular City Council meeting. Present
were Mayor Maguire, Councilmembers Fields, Bakken, Hansen and Supina.
A regular Eagan City Council meeting was held on Tuesday, March 18, 2025 , at 6:30 p.m.
Present were Mayor Maguire, Councilmembers Fields, Bakken, Hansen and Supina. Also
present: City Administrator Miller, City Attorney Bauer, City Planner Schultz, Community
Development Director Hutmacher, Police Chief New, Fire Chief Searle, Parks and
Recreation Director Pimental, Assistant City Administrator Alig, and Deputy Public Works
Director Plath.
II. ADOPT AGENDA
Councilmember Hansen moved; Councilmember Bakken seconded a motion to adopt the
agenda as presented. Aye:5, Nay: 0. Motion carried.
III. RECOGNITIONS AND PRESENTATIONS
Police Chief New introduced newly promoted Police Sergeant David Streefland to the Council
and the community. After a brief introduction, he administered the Oath of Office.
IV. CONSENT AGENDA
Councilmember Bakken moved, Councilmember Fields seconded a motion to approve the
Consent Agenda. Aye: 5, Nay:0. Motion carried.
A. It was recommended to approve the minutes from the March, 4, 2025 Regular City
Council meeting.
B. It was recommended to:
• Accept the resignation/retirement of Angie Ellison, Engineering Technician and
authorize replacement.
• Accept the resignation/retirement of Curtis Sticha, Police Sergeant and authorize
replacement.
• Approve the hiring of Mario Terrazas, Utilities Maintenance Worker –
Production.
• Accept the resignation of Cameron Huntington, Firefighter and authorize
replacement.
• Approve the Memorandum of Agreement with the Law Enforcement Labor
Services Local #185 – Police Sergeants Unit.

V. PUBLIC HEARINGS
Mayor Maguire introduced the item and invited City Planner Schultz to provide further
details. Planner Schultz noted the applicant is seeking a 5.5-foot variance to the city's
required 10-foot rooftop setback for the installation of solar panels, proposing a
minimum setback of 4 feet 7 inches from the roof edge.
Council members discussed the proposed variance and expressed their support for
encouraging renewable energy solutions such as solar panels. While there were
concerns about the proximity of solar panels to ventilation pipes, it was noted that the
applicant would work to ensure compliance with safety and building code standards.
Councilmembers emphasized the importance of updating city codes to align with state
requirements, particularly in relation to setbacks for solar panels.
Councilmember Fields moved and Councilmember Hansen seconded a motion to
approve (or direct preparation of Findings of Fact for Denial) a Variance of 5.5 feet to
the required 10-foot rooftop setback for a solar energy system for property located at
4145 Knob Drive, legally described as Lot 7, Block 1, Knob Hill Professional Park with the
following conditions:
1. If within one year after approval, the variance shall not have been completed
or utilized, it shall become null and void unless a petition for extension has
been granted by the council. Such extension shall be requested in writing at
least 30 days before expiration and shall state facts showing a good faith
attempt to complete or utilize the use permitted in the variance.

2. The Amendment to the Planned Development Agreement from the 2020
approval for a building expansion shall be executed, in a form acceptable to
the City Attorney, and recorded with the Dakota County Recorder’s office
prior to issuance of a permit for installation of the solar energy system.
3. The applicant shall obtain a Building Permit from the city prior to installation
of the solar energy system. Planning Report – Pilot Knob Animal Hospital

4. The solar energy system shall comply with the standards in Section 11.70,
Subdivision 26A regarding alternative energy systems.
5. If the solar energy system remains nonfunctioning or inoperable for a period
of 12 consecutive months, the system shall be deemed abandoned and shall
constitute a public nuisance. Within 30 days of abandonment of the system
or notice from the city to remove, the owner shall remove the abandoned
system, including all parts and components at the owner’s expense and shall
comply with all Minnesota State Building Code requirements for the
demolition and removal of the system. Aye:5, Nay:0. Motion carried.
VI. OLD BUSINESS
City Administrator Miller introduced the item, explaining that an ordinance amendment
would allow the City Administrator to oversee all new non-department head
appointments, promotions, resignations, and retirements. This change aims to improve
efficiency, especially considering the time between City Council meetings. Human
Resources Director Swenson was present to address any questions. No comments from
members of the public.
Councilmember Supina moved, Councilmember Bakken seconded a motion to approve
Ordinance Amendments to City Code, Chapter 2, regarding control and appointments of
departments. Aye:5, Nay:0. Motion carried.
