04/01/2025 - City Council Regular MINUTES OF A REGULAR MEETING OF THE EAGAN CITY COUNCIL Eagan, Minnesota April 1, 2025 6:30 PM A Listening Session was held at 6:00 p.m. prior to the regular City Council meeting. Present were Mayor Maguire, Councilmembers Fields, Bakken, Hansen and Supina. A regular Eagan City Council meeting was held on Tuesday, April 1, 2025 at 6:30 p.m. Present were Mayor Maguire, Councilmembers Fields, Bakken, Hansen and Supina. Also present: City Administrator Miller, City Attorney Bauer, Public Works Director Matthys, City Planner Dudziak, and Finance DIrector Feldman. II. ADOPT AGENDA Councilmember Fields moved; Councilmember Supina seconded a motion to adopt the agenda as presented. Aye:5, Nay: 0. Motion carried. III. RECOGNITIONS AND PRESENTATIONS Director Matthys recognized Angie Ellison, Engineering Technician - Streets, for her outstanding contributions to the community and dedicated service to the city. He spoke about her positive impact through her work in Public Works and presented her with a plaque in appreciation. Ms. Ellison expressed her gratitude to the city and the Public Works Department for their continued support. Mayor Maguire thanked her for her service to the City. IV. CONSENT AGENDA Councilmember Bakken moved, Councilmember Fields seconded a motion to approve the Consent Agenda. Aye: 5, Nay:0. Motion carried. A. It was recommended to APPROVE the Memorandum of Agreement regarding 2025 wages between the City of Eagan and IAFF Local 5171 – Firefighter and Fire Captain Unit. C. It was recommended to APPROVE Check Registers dated March 14, 2025. D. It was recommended to APPROVE the following contracts: • Purchase of NinjaOne Advanced Pro with Insight Public Sector, Inc. • Water Services Agreement for 4395 Dodd Road • Sponsorship Agreement with Allina Health | Aetna for National Senior Health & Wellness Day and Veterans Day Donuts in 2025. It was recommended to APPROVE Change Order No. 11 for Eagan Art House (City Project 1558). F. It was recommended to APPROVE Water Meter Surcharge Rebates. G. It was recommended to APPROVE Contract for Pavement Condition Assessment Services and Amendment to Public Works 5-Year Capital Improvement Plan, 2025- 2029, (Major Street Fund). H. It was recommended to APPROVE Eminent Domain Agreement with Eagan Property Owner, LLC. I. It was recommended to AWARD Contract 25-10 (Project 1377), Argenta Trail Street Reconstruction and APPROVE Construction Joint Powers Agreement and Temporary Construction Easements. J. It was recommended to APPROVE Final Payment, Contract 24-08, 2024 Water Quality Improvements. K. It was recommended to SET Interest Rate for Special Assessments for the next twelve months. L. It was recommended to DEFER the City’s Metropolitan City Entitlement Status and Adopt a Resolution authorizing participation in Dakota County Urban County Designation for CDBG, HOME and ESG Funding for fiscal years 2026 through 2028. M. It was recommended to APPROVE Professional Services Agreement with LHB, Inc. for a complete inspection of property located at 1500 Towerview Road to determine whether the Property meets requirements for establishment of a Redevelopment Tax Increment Financing District. N. It was recommended to APPROVE Temporary On-Sale Liquor License for the July 4th Funfest and waive the license, permit and rental fees O. It was recommended to APPROVE a Premises Permit and Adopt a Resolution for Rosemount Area Hockey Association to Conduct Lawful Gambling at Hy-Vee Market Grille. V. PUBLIC HEARINGS A. VACATE Drainage & Utility Easements, Lot 1, Block 1, YMCA 2nd Addition City Administrator Miller introduced the item and turned it over to Public Works Director Matthys, who gave a presentation including a description of the easement City Council Meeting Minutes April 1, 2025 Page 3 and a map detailing its location. Mayor Maguire opened the floor to Council for questions; hearing none, he then opened the public hearing. With no public comments, Councilmember Fields moved and Councilmember Supina seconded a motion to close the public hearing and continue the vacation of the public drainage and utility easements on Lot 1, Block 1, YMCA 2nd Addition, Drainage and Utility Easement Document No. 485039, Part of Utility Line Easement Document Nos. 94786, 94787 and 97718, and Part of Drainage and Utility Easement Document No. 249202. Aye 5, Nay: 0 Motion Carried B. Variance –4045 Lexington Ave South - Lee & Laurel Anderson - A 1-foot Variance to the maximum garage door height of 8 feet located at 4045 Lexington Ave South. City Administrator Miller introduced the item and invited Planner Dudziak to provide additional details. Planner Dudziak gave a presentation, including a map of the project area, and explained that the applicant is requesting a 1-foot variance to allow 9-foot tall garage doors. Mayor Maguire opened the floor for comments. The applicant thanked staff for their consideration. The mayor then opened the public hearing. Eric Spring, 4065 Lexington Avenue South, spoke in support of the project. There being not further public comment, the mayor closed the public hearing and turned the discussion back to Council. Councilmember Hansen moved and Councilmember Fields seconded a motion to approve a Variance of 1-foot to the required maximum 8-foot garage door height for property located at 4045 Lexington Avenue South, legally described as Lot 1, Block 1, Patrick Eagan Park Addition, subject to the conditions listed below. Aye: 5, Nay: 0. Motion carried. 1. If within one year after approval, the variance shall not have been completed or utilized, it shall become null and void unless a petition for extension has been granted by the council. Such extension shall be requested in writing at least 30 days before expiration and shall state facts showing a good faith attempt to complete or utilize the use permitted in the variance. 2. The applicant shall modify their building plans for the exiting Building Permit for review and approval by city staff for the garage door opening height modification. VI. OLD BUSINESS VII.
