This Ingress and Egress Easement is made this . day of MWU , 2025,
between DRP MN 1, LLC, a Delaware limited liability company (herein kferred to as
"Landowner") and the City of Eagan, a municipal corporation, organized under the laws of the State
of Minnesota (hereinafter referred to as the "City").
WITNESSETH:
That the Landowner, in consideration of the sum of One Dollar ($1.00) and other good and
valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does hereby
grant and convey unto the City, its employees, agents or contractors, a 20 -foot wide easement for
access ingress and egress purposes lying over, under and across Lot 67, Block 1, TRAILS END
COMMONS, Dakota County, Minnesota, the centerline of said easement described as follows:
Commencing at the Northeast corner of said Lot 67, thence on an assumed
bearing of South 00 degrees 04 minutes 54 seconds East, along the East line of
said Lot 67, 193.64 feet to the point of beginning of said centerline; thence North
23 degrees 47 minutes 55 seconds West, 3 8.8 5 feet; thence Northwesterly 111.19
feet, along a tangential curve concave to the northeast, central angle 53degrees 05
minutes 26 seconds, radius 120.00 feet; thence North 76 degrees 53 minutes
21seconds West, tangent to said curve, 166.85 feet; thence Northwesterly 136.50
feet along a tangential curve, concave to the northwest, central angle 11 degrees
10 minutes 22 seconds, radius 700.00 feet; thence North 65 degrees 42 minutes 59

seconds West, tangent to said last Curve, 18.29 feet the north line of said Lot 67
and there terminating.
The sidelines of said easement shall be prolonged or shortened to terminate on
said North and East lines of said Lot 67.
See also Exhibit "A" attached hereto and incorporated herein.
This permanent easement for ingress and egress purposes is to permit City personnel and
equipment to use this easement for the purpose of water tower access, utility maintenance,
inspection and operation. No obstructions such as trees, shrubs, fences, buildings, gardens, etc. will
be permitted to occupy this easement. Any costs incurred for removal of any obstructions for access
usage by the City will be the financial responsibility of the individual lot owner.
The Landowner, its successors and assigns, does covenant with the City, its successors and
assigns, that it is the owner of the premises aforesaid and has good right to grant and convey the
easement herein to the City.
