of Eagan. The Property has been platted. There are no unresolved zoning or building
violations on file with the City. The use and development of the Property is governed by a
Final Planned Development Agreement, and subsequent Amendment to the Final Planned
Development Agreement. The allowed use is multi-family residential.
The Property includes former right-of-way that was vacated and incorporated into the plat
for the intended development. The former roadway pavement was removed in 2018;
