Comments: The Property identified above is located within the corporate limits of the
City of Eagan. The Property is platted and is served by municipal utilities. Access to the
Property is shared with the adjacent lot. There are no unresolved zoning violations or
open permits on the Property.
The use and development of the Property is governed by an Amendment to the Final
Planned Development Agreement dated December 16, 2014. Use of the Property as a
fast-food restaurant with drive-through service and retail sales and service are permitted
within the Planned Development. The Planned Development was established in 1980
identifying this Property for “office/commercial” uses. A Conditional Use Permit was

approved February 5, 1985, allowing use a bank with drive-through facilities and a pylon
sign. The 2014 Amendment to the Planned Development superseded and replaced the
prior Final Planned Development Agreement, and includes continued use of the existing
pylon sign.
