That said proceedings were taken and completed by the City of Eagan, Dakota County, Minnesota, on April 7, 2026; and that the description of the real estate and land affected by the vacation of said drainage and utility and is contained in the Resolution vacating said easements of which a copy is attached hereto and made a part hereof and marked as Exhibit "A" along with the Certificate of Survey for reference. DATED: April 7, 2026 ATTEST: zVIMA�� By: ,Elizabeth VanHoose Its: City Clerk CITY COUNCIL - CITY OF EAGAN K- - hlwk�' By: Mike 61aguire Its: Mayor EXHIBIT "A" RESOLUTION CITY OF EAGAN WHEREAS, a regular meeting of the City Council of the City of Eagan, Dakota County, Minnesota, was held on the 7th day of April 2026, at 6:30 p.m. at the City Hall located at 3830 Pilot Knob Road, Eagan, Minnesota; and WHEREAS, pursuant to M.S.A. §412.851, the Mayor convened the public hearing to consider the proposed vacation of public easements lying over and across the following described real property in the City of Eagan, County of Dakota, State of Minnesota, described as follows: All Drainage and Utility Easements dedicated on Lot 1 and Lot 2, Block 1, Hilltop Plaza, and the Westerly 229.25 feet, as measured at right angles of Lot 3, Block 1, Hilltop Plaza according to the recorded plat thereof, Dakota County, Minnesota. WHEREAS, the Council at a regular meeting on the 7' day of October 2025, accepted a petition to vacate said public drainage and utility easements pursuant to a petition and scheduled a public hearing on the vacation for the V day November 2025, at 6:30 p.m. at the City Hall; and WHEREAS, an Affidavit of Publication of Notice of Hearing in the St. Paul Pioneer Press newspaper, dated October 9 and October 16, 2025, relative to the proposed vacation was submitted; and WHEREAS, it having been determined that other than petitioner, there are no other parties, including public utility companies, having an interest in said public drainage and utility easement, and it appearing that it is in the public interest to vacate such easement, and there being no objections; and WHEREAS, the Council at the public hearing on November 3, 2025, closed the hearing to be continued to coincide with further consideration of the Final Subdivision of Kwik Trip 1795; and WHEREAS, the Council at a regular meeting on the 7" day of April 2026, approved the Final Subdivision of Kwik Trip 1795; and NOW THEREFORE, it was resolved that the public easements lying over and across the following described property, as shown in Figure 1 which is attached, is hereby vacated: n� All Drainage and Utility Easements dedicated on Lot 1 and Lot 2, Block 1, Hilltop Plaza, and the Westerly 229.25 feet, as measured at right angles of Lot 3, Block 1, Hilltop Plaza according to the recorded plat thereof, Dakota County, Minnesota.
