MINUTES OF A SPECIAL MCETING OF THE EAGAN CITY COUAICIL

A special meeting of the Eagan City Council was held on Maq I1, 1.976 at 7 P.P1.
at the City Ha11. All members were present. Also present were Rosene, Bolke and
Hauge.
IMi'. PF~OJFCT X179. The Mayor convened the hearing for Phase II of the water
area assessments for Froject ~E179. The City Engineer explained the project and
there were a large number of o~:mers present some of whom objected to the assessments.
It was noted that the property owners could request thaC their property be elimin3rec
from the assessment roll by letter request to the City Clerk which would then be
reviewed by the Assessment Committee to determine whether the assessment sh~uid be
strikers. It was further stated that the increase in rates for water area p~:rposes
in recent years has been from 6% to 15% on the average and that this is an t+~~~..r'~un3t~
f_or the o~*ners to assess their pro}~erty for water area purposes at the 1975 rd~;'..a
in light of greatly increased costs and assessment rates beginning in 1976. At

PRJJECT ~~i.42 - JOHY~dY CAPE RIDGE ROAD. At 8 P.M. the Mayor convened thA pu'~?~c
hearing relating to Imp. Project ~~142 consisting of road improvements fog: 3ohnny
Cakke Ridge Road from Cliff Road one mile South to the Apple Valley line. It was
noted that an additional 17 feet on each side of the centerline is required to
complete the 100° rightwof-way. The road would consist of 52' of bituminous
surfacing with concrete curb and gutter. There were a number of auestiors from tl:e
audience. M:. Chuck Lowery, the Dakota County Park Planner and I~aketa County Eng.,
Robert Sandeen, There present. There were no objections from the county and they
pimply asked for additional information concerning the right-of way. Mr. M.F.
Nickelson of PIFM Corporation and Mr. William Almquist and Mrs. Armagost were present.

Representatives of all affected property owners were present at the hearing. There
was concern of the Council members about the need to upgrade other roads in the
general area as connecting links to Johnny Cake Ridge Road for access to the zoo.
Mx. Jerry Hegstroa?, a representative of the Zoo Board, appeared and was in favor of
the proposal. In addition, there was discussion about the need for future semaphore
at three intersections including Pilot Knob - Cliff, Johnny Cake Ridge - Cliff,
and Cliff - Cedar Avenue. At 8:30 P.M. the P~~ayor closed the hearing. Smith moved
and Rahn seconded a motion to authorize the installation of Project ~~142. Those
voting in favor were Smith, Rahn and Polzin, those against were tJachter and P.ydrych.
The motion failed for Zack of the 4/Sths vote under P1.S.A. 429, the special assess-
ment statute.
DAKOTA COUTiTTY EPtGINEER. Robert Sandeen discussed with the Council the progress
on the installation of certain semaphores particularly at Cliff Road and Ceds.r Avenue
He indicated that there was no FAU funding at the present time but that tiie ~ :ure:
may still acquire FAU funding in 1976. Pilot Knob Road improvements have now i:F•::i
deJ.ayed because of the lack of FAU fundins. The only alternate is fox the nor:~sl

Charles Slocun of Unisource Corporation appeared aad requested that ttse a..sessmera~~
on the property be deferred until 1977 or that the construction be deferred until
1977 and that assessments be spread over 1S years. Mr. Wallac Burrow also appeared
and requested a delay in the project on the same basis. No appearance was made on
behalf of the Indep. School District ~~19i, Burnsville and there was also complaints

Smith seconded the saoLson to order in the entire Project ~fl$0 and that the City
Engineer be autrnri2ed to prepare plans aad specifications. k.ll members voted in
favor.

TRUNK PIATER OVERSIZING FOR 1975. The City Engineer submitted a revision for
trunk water o•~ersizing from $280 per platted residential lot to $220 per platted
residential lot and upon motion by Smith, seconded Wachter, all members voting in
Favor, it was RESOLVED that the revision be approved effective as of April 1, 1976.

matted three bids from contractors on existing contracts in the City with a low bid
from Fredrick: on Excavating Company in the sum of $20,730, Upon motion by Smith,
seconded Rahn, all members voting yea, it was RESOLVED to approve Change Order #1
to Project #159 in the sum of $20,730 to be awarded to Fredrickson Excavating Co.
for a 2200 foot storm sewer force main in the Wilderness Run area.
Upon motion the meeting adjourned about 10:20 P.M.

HELD ON MAY 11, 1976
Pursuant to due call and notice thereof, a special meeting of the
City Council, of the City of Eagan, Dakota County, Minnesota was duly
held at the City Hall in said municipality on the 11 day of May •
1976 at 7 o'clock P .M.
The following members were present: Mayor Polzin, Councilmen Smith,
Wachter, Rydrych and Rahn and the
following were absent: NONE
The Clerk presented an affidavit showing publication of Notice of
Hearing on the proposed assessments for Imp. Project #179 - Consolidated Citywide
. Water Area Assessment - Phase 2
in the official newspaper in accordance with a reoolution heretofore adopted
by the City Council, which affidavit was examined, found satisfactory, and
ordered placed on file.
The Mayor announced that the meeting was open for the oonaaderati m.
of objections, if any, to said proposed assessments. All persons were than
