DECEMBER 13, 1977
A special meeting of the Eagan City Council was held on December 13, 1977 at
6;30 p.m. at the City Hall. 'hose present were Mayor Polain.. Councilmen Rahn
Smith Wachter and Pydrych. Also present were City Administrator Hedges, City
Engineer Rosene, City Clerk Bolke and City Attorney Hauge.
MINUTES. No minutes were presented for approval.
1978 BUDGE, ADOPTION. Mr. Hedges reviewed wi'-.h the Council the proposed
final draft of the 1978 City of Eagan budget and submitted a resolution proposing
adoption of the budget as a financial guideline. After considerable discussion
Smith moved and Wachter seconded a motion with all members voting in favor to
adopt the 1978 budget as a financial guideline.
ASSESSMEN'" POLICY. Administrator Hedges discussed the Assessments Guideline
Policy final draft dated December 9. 1977 that had been prepared by Mr. Ken Damlo
under the Administrator's supervision and stated that the Assessment Committee had
recommended that the policy be accepted by the Council. Smith moved and Rydrych
seconded the motion to delete a paragraph on page 27 stating that the City may
decide to pay up to 20% of the total storm sewer trunk costs from general funds.
It was suggested that earlier Council action be reviewed in this respect. After
further discussion, Rydrych moved and Wachter seconded a motion that the Assessment
Guideline Policy be accepted by the Council and that it reflect the Council's
position on current assessment policies. All members voted yes.
SHARON S:'AFF ':'RAILER PERMI'". Mrs. Sharon Staff of 1340 Pocky Lane submitted
an application for a trailer home permit in order to care for her elderly mother
at 1340 Rocky Lane. Rahn moved and Smith seconded a motion to grant the applica-
tion for a one-year period.

Rosene submitted the plans and specifications for the utility improvements under
Project #217 for Eagan Hills First Addition. Upon motion by Rahn, seconded Smith
all members voting yes it was RESOLVED that the plans and specifications be approved
and accepted and that the Clerk be authorized to advertise for bids to be opened
on February 3. 1978 at 3 p.m. at the City Hall.
DAKOTA COUN"'Y - SEMAPHORE LIGHT PLAYS. City Engineer Rosene next submitted
the plans for semaphore signal lights at Johnny Cake Ridge Road and Cliff P.oad
and also at Pilot Knob Road and Cliff Road prepared by Dakota County. Upon motion
by Smith., seconded Rydrych all members voting yes it was RESOLVED that the plans
and specifications be accepted by the City.
ON AND OFF SALE BEER LICENSES RENEWALS. The renewal applications will be
considered at the next regular meeting.
CONDI.TONAL USE RENEWALS, Ho action was taken and the applications will be
considered at the next regular Council meeting.
OAK CHASE ADDI''ION. James Frisbee appeared and reviewed his letter of December
7, 1977 addressed to City Attorney Hauge requesting that the City Council forward
a letter to the Dakota County Auditor approving a deferment of payments on the
principal on the special assessments covering the following lots for an additional
two year period:
1. Lot One, Block Five, Oak Chase First Addition.
2. Lot One., Block Four, Oak Chase First Addition,
3. Lot '.tao, Block Four, Oak Chase First Addition.
Each of the foregoing lots will be replat*_ed into the Oak Chase Fourth Addition.
In addition, he requested that Lot One, Block Three, First Addition, and Lot "`wo,
Block Three. First Addition, scheduled for replat with the Fifth Addition. be
deferred for a two-year period to avoid tax forfeiture of all of the five lots.
Mr. Frisbee indicated that he would grant the ponding easement to the City

requested by the City at the Northwest corner of Oak Chase Road and Cliff Road at
the time of platting the Fourth Addition and in addition would grant necessary
slope easement and permanent right of way easement.for Cliff Road at that timl
Further, Mr. Frisbee stated that he will complete the dedication of three additional
lots along Wilderness Run Road to the City for park purposes prior to the end of
1977. including the payment of all real estate taxes on all three lots and assess-
ments on the two lots according to the earlier agreement. Wachter moved and Rahn
seconded a motion to approve the request for a deferment of the payment of the
assessments including principal and interest for an additional two years from the
present date with the understanding that no waiver of interest will be granted;
further with the understanding that the ponding easement a_. the Northwest corner
of Oak Chase Drive and Cliff Road be gran~ed to che City ac the time of filing the
final plat of the Fourth Addition, and in addition, the required slope and perman-
ent easement for future Cliff Road improvements, and further conditioned upon the
dedication of the c.hree additional lots for park purposes, including payment of
all real estate taxes on all three lots and assessments on two lots prior to the
end of 1977. All members voted in favor except Rydrych, who voted no.
PROJECT #210A CONTRACT. The City Attorney submitted a contract with Minnesota
Va1 eg S rf #g Company concerni:.g Project #210A regarding street improvements
in several areas. Wachter moved and Rydrych seconded a motion with all members
voting inUvor to approve the contract and order it to be signed.
TAX FORFEITED PROPERTY. A.list of parcels allegedly forfeited for tax
purposes received from Dakota County covering lots in Oak Chase Addition was reviewed
by the City Clerk. Because action is being taken by the Council to defer the pay-
ment of assessments, no action was taken,
PSC - CITY ATTORNEY'S STATEMENT. A statement for legal services covering the
hearings held before the Public Service Commission regarding the Peoples Natural

Gas franchise, submitted by the City Attorney, was reviewed by the Council. Polzin
moved and Wachter seconded a motion with all members voting in favor to approve the
statement.
PUBLIC. WORKS DEPARTMENT EMPLOYMENT AGREEMENT. City Administrator Hedges sub-
mitted a proposed contract with Teamsters' Local #320 covering the Public Works'
employees. The contract would cover two years including 1978 and 1979 with a 7.2
percent increase in 178 and a 6 percent increase in 179, plus certain other changes.
The union representatives requested that health insurance be left open for re-nego-
tiation for the second year of the term. Polzin moved, Smith seconded a motion,
with all members voting in. favor to approve the contract with the understanding
that health insurance can be re-negotiated for the second year.
POLICE ASSOCIATION EMPLOYMENT AGREEMENT. 'The Administrator next submitted it
proposed agreement for the Police Department employees with the Police Association
for 1978. Rahn moved and Wachter seconded a motion with all members voting in
favor to approve the agreement as submitted.
DOG CATCHER CONTRACT. The Clerk submitted a contract between Robin Clarey
and the City for temporary dog catching responsibilities. Smith moved and Wachter
seconded a motion to approve the contract; all members voted yes..
ADJOURNMENT. Rahn moved and Wachter seconded a motion that the meeting be
adjourned at approximately 9:15 p.m., followed by an informal discussion with
newly elected Council members concerning miscellaneous City issues..
