03/16/1993 - City Council Special MINUTES OF A SPECIAL MEETING OF THE EAGAN CITY COUNCIL Eagan, Minnesota March 16, 1993 A special City Council meeting was held on Tuesday, March 16, 1993 at 5:00 p.m., at the Eagan Municipal Center Building for the purpose of holding an executive session to discuss collective bargaining, reviewing a schedule for consultant RFP's, an update on the Williams Brothers Pipeline clearcutting of easements and reflection on the annual Council/staff retreat. Present at the meeting were Mayor Egan and City Councilmembers Awada, Hunter, Masin and Wachter. Also present were Assistant to the City Administrator Duffy, Assistant to the City Administrator/Acting Director of Community Development Hohenstein, Director of Finance VanOverbeke, Director of Parks and Recreation Vraa, Director of Public Works Colbert, Chief of Police Geagan and City Administrator Hedges. EXECUTIVE SESSION Mayor Egan convened the executive session at approximately 5:00 p.m. for the purpose of discussing the status of collective bargaining with the public works/park maintenance union. After a consideration of counter proposals from the union and direction given to the City Administrator by the City Council, the executive session was adjourned at approximately 5:30 p.m. CONSULTANT RFP'S Mayor Egan reconvened the special City Council meeting asking for a presentation by the City Administrator on a recommended schedule for requests for proposals for various City consultants. The City Administrator presented a schedule for processing requests for proposals for all consultants including engineering, legal, financial, bond counsel and insurance (general liability and workers compensation). He stated that it is the recommendation of the management team that the RFP scheduled for City Attorney and prosecuting attorney be scheduled for later in the summer/early fall, allowing the City to study the cost benefit of an in-house city attorney. The City Administrator stated that with the population in excess of 50,000 and the fact that building expansion plans will be reviewed during the next several months, it seemed appropriate for the City Council to consider an in-house city attorney at this time. City Councilmembers concurred and the City Administrator was directed to proceed with the schedule for processing requests for proposal for all consultants as presented. WILLIAMS BROTHERS PIPELINE CLEARCUTTING OF EASEMENTS Director of Parks and Recreation Vraa stated that Williams Brothers Pipeline is planning to clearcut their easement right-of-way through the City of Eagan this spring/summer. With the use of a video tape, provided by Williams Brothers Pipeline, he visually outlined the easement corridor where the clearcutting will take place pointing out the more sensitive areas where brush and trees exist that are close to residential subdivisions. The Director of Parks and Recreation stated that it has been their philosophy to keep the easements clear of vegetation, buildings or use by adjacent properties to enhance ongoing safety or repair work if a pipeline should develop a leak or require emergency repair. The Director of Parks and Recreation stated that the Williams Brothers pipelines transport a crude oil that is collected by small piping averaging six inches in diameter and transported to refineries in trunk lines as large as 54 inches. He stated that the pipeline located and traversing through the City of Eagan does transport crude oil as a part of a vast underground pipeline network. Director of Finance VanOverbeke and the Director of Parks and Recreation, have met with representatives of Williams Brothers Pipeline and informed the City Council that there are no permits or action required by the City Council, however, it is fully expected that residents SCC MINUTES MARCH 16, 1993 PAGE TWO will call the City offices or the City Council with complaints, concerns or questions once the clearcutting begins. They also Indicated that Williams Brothers Is attempting to notify residents adjacent to the clearcutting so that residents and business alike are informed In advance. OTHER BUSINESS Mayor indicated that there would not be enough time to review the annual Council/staff retreat due to the necessity to begin the regular City Council meeting scheduled at 6:30 p.m. There was no further business and the meeting was adjourned at 6:25 p.m. N L TLH March 16. 1993 LOD- Date City Clerk
