MINUTES OF A SPECIAL MEETING OF THE EAGAN CITY COUNCIL
EAGAN, MINNESOTA
MAY 21, 1979
A special meeting of the Eagan City Council was held on
May 21, 1979 at 4:30 p.m. at the Eagan City Hall. Those
members present were: Mayor Murphy, Councilmembers Wachter,
Smith, Egan and Parranto. Also present were City Administra-
tor Hedges and City Attorney Hauge. Mayor Murphy presided.
WEST PUBLISHING COMPANY
Mr. John Nassef appeared with a request for a temporary
conditional use permit to permit the parking of approximately
2,000 Ford trucks on the West Publishing Company property on
Highway #49. He explained that Ford Motor Company expects
the Teamsters truck drivers to go on strike after the 1st of
June and it is anticipated that the strike will last no longer
than approximately two weeks. He also stated that the truck
drivers will not picket the Ford plant, and therefore, UAW
drivers will drive the trucks to the storage locations
throughout the Twin Cities area, indicating 800 trucks are
being assembled per day in St. Paul.
When the strike is over, McKee would then have its over-
the-road trucks enter the parking lots and distribute the
trucks throughout the area. He assured the City Council
that there would be no union problems and in the event that
there are, that West Publishing Company and Ford Motor
Company will be responsible and further would be responsible
for any violence, security on the premises and for any
damages or claims made against the City. Smith moved and
Wachter seconded the motion, all members voted in favor, to
grant the temporary conditional use and waive the normal
conditional use permit requirements including permit fee
because of the temporary nature and the need to expedite the
permit solely upon the following conditions:
1. That the City of Eagan will be held harmless by
Ford Motor Company and/or West Publishing Company for any
claims or causes of action of any nature that may arise as
a result of the strike, the parking of.the trucks on the
West Publishing Company, or the issuance of the conditional
use permit, and will indemnify the City for any claims or
causes of action, including attorneys fees, resulting therefrom.
2. That the entire parking area will be lighted.
3. That the applications will provide adquate security
on the premises at all times.

4. That no trucks will be moved on or off without
specific notice to the City Administrator.
DAKOTA COUNTY LIBRARY SITE
City Administrator Hedges reviewed a meeting held be-
tween Dakota County representatives and the City Administrator
on May 15th concerning the proposed location of a Dakota County
Library and administration site on the police facility pro-
perty on Pilot Knob Road. Councilmembers stressed the im-
portance of shared parking and reviewed the request of the
County negotiating group as follows:
1. Access from Wescott Road between Lexington Avenue
and Pilot Knob Road will be furnished by the City of Eagan
within the next two years and internal access off Wescott
Road to serve the library facility will be worked out with
the understanding that it will fit into the site plan for
the City including shared parking. It was further understood
that the road would be a 44 foot interior road.
2. The City would provide sewer and water access and
connection to the library complex at no cost to the County
with the understanding that there would be no connection
charges, lateral charges or trunk area charges, but the
County would be required to pay the SAC charge and install
the service line from the building to the water and sewer
laterals.
3. The City will provide snow removal of parking lots
and internal roads.
4. The City will provide general maintenance of grounds
including lawn maintenance and tree trimming, but the County
would be responsible for installing, planting and replacing
trees, bushes, sod, etc.
5. The City does not agree to pay a percentage of main-
tenance of the building including janitorial, repairs, im-
provements on a monthly or yearly arrangement nor provide a
flat monetary allocation when the library is opened.
6. The City agrees to lease five acres to the Dakota
County Library Board and to reserve up to five additional
acres for 20 years in the event the Dakota County Library
Board desires to expand the library complex. It was further
understood that the lease would be without cost to the County,
that the site will provide for shared parking with City
facilities, and that the plan for the complex will fit into

the overall site plan for the City complex; further, that
the County would install library site parking facilities at
its cost and would maintain or replace the parking facilities
at its cost.
7. The City will provide and pay for the general site
planning costs for the library site, which planning will be
outlined in more detail later.
8. The City of Eagan will provide core samples and
include engineering type studies such as hydrology, geology,
with the understanding that Eagan will hire a testing company
to drill five core samples sufficient for a two story building.
9. Regarding lesser priority items:
a. The City will not make annual commitments for
the acquisition of library books as determined by the
City Council from year to year.
b. The City will provide water and sewer service at
no charge to the County.
c. The City will connect the library facility with an
alarm system available through the police facility at
no cost to the County.
d. The City will waive its building'permit fee.
e. It is understood that the design of the building
and the immediate environs will be reviewed by the Eagan
City Council in order that the Council may determine
whether it is aesthetically and architectually compatible
with the other buildings in the municipally owned area.
1-494 MINI BIKE ISSUE
It was noted that a number of complaints have been
received by Councilmembers from area residents regarding the
use of mini bikes on the 1-494 corridor. Mr. Merrit Linzie
had been contacted and indicated the policy of Mn/DOT is not
to prohibit nor to sign the property prohibiting mini bikes,
motorcycles, etc., in the corridor. It was suggested that the
Council's main concern is the dropoff of bikes from outside
the area and a concern regarding noise, liability for acci-
dents, etc., without having to substantially increase the
policing of the corridor. The City Administrator was
instructed to send a letter to Mn/DOT requesting the state
sign the area to prohibit owners of mini bikes and any all-
terrain vehicles, etc., from dropping off their units and
using the 1-494 corridor; and further, that the City Police
Department be authorized to issue citations if there are violations
of the Council policy and in violating of ordinance #50 and
the state law.

IMPROVEMENT PROJECTS
The City Attorney submitted the following contracts for
approval:
1. Rahn Thomas Trail - Improvement 79-4, Project #230.
McNamara Vivant Construction Company.
2. Improvement 79-2, Beacon Hills street improvements,
McNamara Vivant Construction Company.
Upon motion by Wachter and seconded by Parranto, all
members voting in favor, it was RESOLVED that the contracts
be awarded subject, however, to the acquisition of necessary
easements.
ADJOURNMENT
Upon motion duly made and seconded, the meeting adjourned
at 6 p.m.
