MINUTES OF A SPECIAL MEETING OF THE EAGAN CITY COUNCIL
EAGAN, MINNESOTA
MARCH 25, 1980
A special meeting of the Eagan City Council was held on March 25,
1980, at 7:00 p.m.,, at the Eagan City Hall. Those present were Mayor Blomquist,
City Councilmembers Egan, Smith, Wachter and Parranto. Also present were City
Administrator Hedges, Director of Finance Van Overbeke, and Brad Smith of the
City Attorney's office.
MAKIN MAGIC VS. CITY OF EAGAN
Brad Smith of the City Attorney's office presented several alterna-
tives as to how the City of Eagan can respond to the decision of the Eighth
Circuit Court of Appeals in St. Louis, regarding the case of Mak'n Magic vs.
City of Eagan. Mr. Smith stated that the Eighth District Court of Appeals in
St. Louis overruled the Federal District Court in St. Paul by making a fact
finding that the City of Eagan cannot enforce Ordinance #71, "An Ordinance Pro-
hibiting the Sale, Transfer and Possession of Drug-Related Devices". Mayor
Blomquist stated that she felt of the options reviewed by the City Attorney's
office she favored the redrafting and revision of Ordinance #71. The Mayor
stated that it might be helpful to use procedures and specifications such as
diagrams and other details for the revision of Ordinance #71. City Councilmember
Wachter stated that he is in agreement that Ordinance #71 should be amended
to draft a document that is more technical which after reading the decision
by the Eighth Circuit Court of Appeals seems to be lacking in Ordinance #71.
City Councilmember Egan suggested that the definition be incorporated for the
enforcement relating to Ordinance #71 similar to the language set forth by the
Drug Enforcement Administration. After further discussion on the matter, it
was the unanimous concensus of the City Council that the City Attorney's office
be directed to standardize the regulations, gather assistance through the Asso-
ciation of Metropolitan Municipalities and League of Minnesota Cities organiza-
tions, notify other cities looking for support in the drafting of a parapher-
nalia ordinance and further that the matter would be considered at the next
regular City Council meeting. There was no action taken on the matter.
INDUSTRIAL REVENUE MORTGAGE FINANCING
Mr. Ernie Clark and Mr. Dave Fredrickson, representing Miller &
Schroeder Municipals, Inc., appeared and reviewed the purpose and procedure
for the consideration and approval of Industrial Revenue Mortgage Financing
applications considered by the City of Eagan. Mr. Fredrickson outlined the
history, purpose, method and other related factors for the issuance of industrial
revenue mortgage financing applications. He stated that the guidelines set
forth by the City of Eagan are quite explicit and appear to establish a public
purpose and outline for the issuance of industrial revenue mortgages within
the City of Eagan. After further presentation by Mr. Fredrickson and Mr. Clark
and many questions by members of the City Council, the representatives of Miller
& Schroeder were given thanks for appearing before the City Council for the
purpose of providing additional background on industrial revenue mortgage
financing.
