MINUTES OF A SPECIAL MEETING OF THE EAGAN CITY COUNCIL
EAGAN, MINNESOTA
JULY 17, 1980
A special me-eting of the Eagan City Council was held on July 17,
1980, at 7:00 p.m. at the Eagan City Hall. Those present were Mayor Blomquist,
Councilmembers Egan, Smith, Wachter, and Parranto. Also present were City
Administrator Hedges, Director of Public Works Colbert and Kevin Eide of the
City Attorney's office.
IMPROVEMENT 80-5 (FISH LAKE OUTLET)
The Director of Public Works reported that a change order to bypass
the Jim Horne property for construction of a storm sewer outlet, a segment of
Improvement 80-5, was negotiated with Parrott Excavating in the amount of
$33,000. He stated that the actual bypass would cost approximately $28,000
and a berm to be constructed would cost approximately $5,000. It was also
reported that Mr. Ed Dunn of Dunn & Curry Real Estate Management, Inc., had
been contacted regarding the construction of a storm sewer main on their property
as an alternative to the Jim Horne property, and he is willing to consent to
the easement at a rate of compensation of $3,000 per acre. There was a brief
discussion by the City Council, noting that the reason for the change order
was that Mr. Horne did not agree to the offer presented by the City at a rate
of $2,000 per acre to construct the outlet across his property; and with the
anticipated delay and cost of condemnation for acquiring the easement, it
appeared to be less expensive to proceed with the bypass as proposed. In a
motion by. City Councilmember Smith, seconded by Councilmember Egan, with all
members voting in favor, change order #1 to Improvement 80-5 to Parrott
Excavating to bypass the Jim Horne property and proceed with storm sewer
construction on the property owned by Dunn & Curry Real Estate, Inc., in the
amount of approximately $33,000 was approved.
IMPROVEMENT 80-19 (TWIN VIEW MANOR UTILITIES)
Kevin Eide of the City Attorney's office asked for direction as
to whether the City wanted to proceed with a District Court hearing to consider
an injunction that was served on the City by several property owners of Twin
View Manor Addition attempting to stop the utility improvement proposed under
Improvement 80-19 for that subdivision. Members of the City Council expressed
a desire to proceed with the project stating that the project was petitioned
by property owners in Twin View Manor who are experiencing severe difficulty
with their wells and septic systems creating a potential health hazard for the
area and therefore felt the improvement should continue. There was no action
taken on this matter.

AMUSEMENT DEVICE ORDINANCE
An Amusement Device Ordinance was presented by Mr. Kevin Eide,
representing the City Attorney's office. The proposed ordinance was reviewed
in detail with a number of corrections and changes offered by the City Council.
After completing the revisions and in a motion by City Councilmember Wachter,
seconded by Councilmember Egan, with all members voting aye, an ordinance
regulating the licensing of amusement devices, referred to as Ordinance 73, was
adopted and the City Clerk was authorized to publish the same in the Dakota
County Tribune.

AMENDMENT TO ORDINANCE 52
An amendment to Ordinance 52, the Zoning Ordinance, was then reviewed
by Mr. Kevin Eide of the City Attorney's office. Mr. Eide informed the City
Council that it is necessary to amend Ordinance 52, the Zoning Ordinance, to
include provisions for definition of amusement devices and also to specify how
amusement devices are classified within various zoning classifications. Upon
motion by City Councilmember Wachter, seconded by Councilmember Egan, with all
members voting aye, an amendment to Ordinance #52 relating to classification
of amusement devices was adopted and the City Clerk was authorized to publish
the same in the Dakota County Tribune.

PUBLIC WORKS DEPARTMENT ANALYSIS
Director of Public Works Colbert reviewed an 18 page analysis of
the Public Works Department as requested by the City Council. The analysis
included a review of the engineering, maintenance, and special assessment
activities of the Public Works Department as observed by the Director of Public
Works during his first 18 months of service with the City of Eagan. Public
Works Director Colbert stated that he would like to add manpower to the
engineering division which would allow the City to perform minor plans and
specification work on various projects authorized by the City Council. The
City Council discussed long range engineering and felt it was appropriate to
consider engineering support staff for purposes of reconstruction and maintenance
while contracting with the consulting engineering firm for new design projects.
There was discussion regarding inspections supervisors, a method in which to
control development to allow more improved productivity amongst the existing
support staff and other related matters concerning the Public Works Department.
Proposed organizational charts prepared by the Public Works Director were then
reviewed and it was determined that all maintenance and engineering activities
with the exception of park maintenance would be the direct responsibility of
the Public Works Director. It was suggested that all maintenance activities
for the Parks and Recreation programs be under the direct supervision of the
Parks and Recreation Director with the understanding that capital equipment
needs would be analyzed by both the Public Works Director and the Parks and
Recreation Director for use in the Park Department. City Administrator Hedges

stated that it was determined in December 1979 that salaries for the three fore-
man positions (utilities, streets, and parks), along with the salary of the
Public Works Director would be reviewed for consideration for a mid-year adjust-
ment in 1980 upon completion of an analysis of the Public Works Department by
the Public Works Director. It was the recommendation of the City Administrator
that the salaries for the foremen would be increased to $1,684.00 per month.
This salary adjustment will provide additional compensation for consideration
of overtime and provide a more equitable differential between the maintenance
level three position and foreman. After brief discussion and in a motion by
City Councilmember Egan, seconded by Councilmember Smith, with all members voting
in favor, salaries for Utilities, Streets and Parks and Recreation Foremen were
increased to $1,684.00 per month to be effective July 1, 1980. The City
Administrator also recommended a salary increase for the Director of Public
Works at a rate of compensation equal to $2,575.00 per month. He further stated
that the Director of Public Works has only received one salary adjustment since
assuming his duties in October of 1978 which was a cost of living adjustment.
The performance evaluation, as prepared by the City Administrator, was agreed
with by the City Council; and in a motion by City Councilmember Egan, seconded
by Councilmember Wachter, with all members voting aye, a mid-year salary adjust-
ment to $2,575.00 per month was approved to the Director of Public Works, Tom
Colbert, to be effective July 1, 1980.

TERRY STOVER PROPERTY
City Councilmember Parranto presented a proposal given to Mr. Terry
Stover to correct the landscaping of his property that was damaged due to the
high water level of West Thomas Lake. The proposal submitted by Greenside,
Inc., was in the amount of $1,769. The City Council discussed the matter and
felt payment was justified in that the problem was very similar to that
experienced by Mr. Dave Peterson, a resident of Carlson Lake, whom the City
did compensate due to the high water of that lake caused by the lack of an out-
let to the lake that would control the high water level. In a motion by City
Councilmember Parranto, seconded by Councilmember Egan, with all members voting
aye, the City Administrator was directed to make payment in the amount of $1,769
to Terry Stover for damage caused his property due to the high water level of
West Thomas Lake.

Upon motion duly made and seconded, the meeting adjourned at 11:00
p.m.
