MINUTES OF A SPECIAL MEETING OF THE EAGAN CITY COUNCIL
EAGAN, MINNESOTA
SEPTEMBER 23, 1980
A special meeting of the Eagan City Council was held on September
23, 1980 at 7:00 p.m. at the Eagan City Hall. Those members present were Mayor
Blomquist, Councilmembers Egan, Smith, Wachter and Parranto. Also present were
City Attorney Hauge and City Administrator Hedges.
MAK'N MAGIC/STIPULATION OF SETTLEMENT
City Attorney Hauge presented the conditions of a stipulation of
settlement between the City of Eagan and Robin Geiger, owner and operator of
Mak'n Magic. He stated that all claims in this action have been fully settled
and compromised by both parties according to ten conditions that are outlined
in the stipulation of settlement. City Attorney Hauge stated that the City
will be responsible to pay $22,750 for Mr. Geiger's attorney fees on or before
September 30, 1980. He further commented that Mr. Geiger has agreed not to
operate or be involved in any way in any paraphernalia shop or the sale or dis-
tribution of drug paraphernalia in the City of Eagan. After reviewing and com-
menting on all the conditions, a motion was made by Wachter, seconded by Egan,
with all members voting in favor that the stipulation of settlement for the
lawsuit Robin Geiger and Mak'n Magic vs. the City of Eagan be approved as pre-
pared and presented by the City Attorney.
PARAPHERNALIA CASE/CITY OF HOPKINS
City Attorney Hauge stated that he was contacted by the City Attorney
representing the City of Hopkins to supply information regarding a lawsuit be-
tween a drug paraphernalia business and the City of Hopkins. After review by
the City Attorney and in a motion by Smith, seconded by Wachter, with all members
voting in favor, the City Attorney was authorized to prepare a brief for the
City of Hopkins regarding a drug paraphernalia lawsuit being challanged in that
community.
COMPREHENSIVE GUIDE PLAN
City Administrator Hedges stated that the City's request for a short
term extension to the deadline for submitting the Eagan Comprehensive Plan to
the Metropolitan Council was not granted by the Metropolitan Council. He pre-
sented a letter from the Chairman of the Metropolitan Council that stated "only
one extension may be granted to each local government and Eagan has already
requested and received one short term extension which establishes a new submittal
deadline of September 30, 1980." He further stated that the letter said that
it would not be possible for the Metropolitan Council to grant a second exten-
sion. Members of the City Council expressed their concerns about submitting
the Comprehensive Guide Plan prior to the amendment guideline procedures being
adopted by the Metropolitan Council. Parranto stated that he did not want the
Comprehensive Guide Plan submitted until the amendment guidelines were prepared
and adopted by the Metropolitan Council so the City could better evaluate whether

the Comprehensive Guide Plan would be treated as a master plan or a land use
plan by the Metropolitan Council. There were a number of questions raised by
the City Council as to how many cities have asked for extensions, how many cities
have filed their comprehensive guide plan, what are the repercussions of not
filing and, further, what are the positions of other communities. Mayor Blom-
quist recommended that the City Attorney contact the Association of Metropolitan
Municipalities in an attempt to coordinate the status of the Comprehensive Guide
Plan with that agency.
BUILDING PERMITS - RIDGECLIFFE ADDITION
Orrin Thompson, representing U.S. Homes, was present and asked for
building permits to construct model homes in the Ridgecliffe Additions prior
to final plat approval. In a motion by Smith, seconded by Parranto, with all
members voting in favor, building permits were authorized for model home con-
struction for the Ridgecliffe Additions to Orrin Thompson Homes.
1981 BUDGET
The City Administrator reviewed several budget revisions that were
requested by the City Council. After reviewing the budget revisions, a tentative
mill levy for 1981 was considered and the City Administrator was asked to prepare
the necessary financial data to consider certification of the 1981 mill levy
at the October 6, 1980 regular City Council meeting.
ADJOURNMENT
Upon motion duly made and seconded, the meeting was adjourned at
10:15 p.m.
