06/08/1978 - City Council Special MINUTES OF A SPECIAL COUNCIL MEETING OF THE EAGAN CITY COUNCIL EAGAN, MINNESOTA JUNE 8, 1978 A special meeting of the Eagan City Council was held on June 8, 1978 at 5:00 p.m. at the Eagan City Hall. All Councilmembers were present. Also present was City Administrator Hedges and City Attorney Hauge. Mayor Murphy convened the meeting and stated the sole reason for the meeting was to determine whether to hire special legal counsel for the City relating to the Department of Natural Resources hearing based upon the application of the Minnesota Department of Transportation for a permit for a bridge crossing on Blackhawk Lake on proposed 135E. Councilmembers discussed the possibility of hiring outside law firm to assist in acting as a coordinator amongst the various municipalities and other parties that are intervening in favor of the application for the bridge permit along alternate A-i. It was noted that several neighboring communities have authorized intervention. Those attorneys who were discussed included Luther Stalland, a former township and village attorney for Eagan; Will Hartfelt, former member of the Attorney General's staff and Chief of the DNR section; Lindquist and Vennum in Minneapolis including MacClay Hyde and Tim Butler who acted on the behalf of Reserved Mining Company, and Raymond Haik of Popham, Raik, Schnobrich, Kaufman, & Doty of Minneapolis. There was discussion concerning the suggestion of hiring an attorney with facts and background regarding the 135E alternates A--1 and A-2 and in addition, the need to squire someone with background in the environmental law area. After considerable discussion, Smith moved and Parranto seconded the motion to retain the firm of Lindquist and Vennum of Minneapolis with the understanding the MacClay Hyde will act as Chief Attorney through the hearings regarding the permit application before the DNR scheduled to commence on June 22, 1978, to coordinate Eagan's presentation before the hearing examiner. Those in favor were: Smith, Page 2 June 8, 1978 Parranto, and Egan. Those against were: Wachter, and Murphy.
