MINUTES OF A SPECIAL MEETING OF THE
EAGAN CITY COUNCIL
December 30, 1987
A special meeting of the Eagan City Council was held on Wednesday,
December 30, 1987 at 7:00 p.m., in Conference Rooms A and B of the Municipal
Center Building. Present were Mayor Blomquist and City Councilmembers Egan
and Smith. Also present was City Administrator Hedges. Absent were City
Councilmembers Ellison and Wachter. The purpose of the meeting, according to
the notice, was to receive a report from Mayor Blomquist and City
Councilmember Smith on their recent attendance at the National League of
Cities Conference in Las Vegas, Nevada.
NLC CONFERENCE REPORT
City Councilmember Smith reported on a session he attended at the
conference that discussed the advantages and disadvantages that most
municipalities are experiencing while participating in a liability insurance
pool with other communities. City Councilmember Smith stated that one
possible long range solution might be to insure only unexpected (either a very
large or frequent number of claims) losses and budget for normal claims each
year. He stated that this concept will work only if excess coverage is
available.
City Councilmember Smith also reported on a session he attended
entitled "Alternative Transit Systems." He provided a summary of a
presentation that was given by Mayor Lois Anderson from a small suburban city
in Seattle, Washington, stating that this community had been paying a
considerable amount for commuter service and, as a result, successfully formed
their own bus service which became an entire county system. He shared various
steps that were advised at the session if cities wish to consider an opt-out
transit system. Councilmember Smith reported that speakers at the session
stressed flexibility of the RFP to bid a level of service and then allow the
provider to meet that level of service. He further advised that information
is available from the Urban Mass Transit Association private sector office and
the American Public Transit Association for the City of Eagan as it continues
its consideration of opt-out alternatives. City Councilmember Smith provided
written summaries of sessions he attended on insurance and alternative transit
and also provided several handouts ranging from capital markets risk financing
and several other reports.
Mayor Blomquist reported on a meeting she attended at the NLC
conference on airport noise. She stated that the most important issue covered
at the session was a report on what communities were doing to comply with the
Part 150 Study. Mayor Blomquist further stated that the executive director of
NOISE, Mr. Thomas Duffy, was directed to intercede and research the level of
participation by NOISE member cities in the Part 150 Study. She further
stated that legislation will be introduced in Washington during the spring of
1988 and that NOISE is appealing to its membership to attend meetings that
will be planned in conjunction with the Washington NLC conference. After
further discussion by Mayor Blomquist, a report entitled "Airport Noise
Meeting and National League of Cities Conference" was distributed for City
Council review.
APPROVAL OF REGULAR MINUTES FOR DECEMBER 17, 1987 CITY COUNCIL MEETING
Administrator Hedges stated that at the request of Mayor Blomquist,
regular minutes for the December 17, 1987 meeting were included as a part of
the Special City Council meeting agenda. City Councilmember Smith stated that
the only change he suggested to the regular minutes was language to include
a payment for reimbursement of his NLC conference expenses to be included in
the paragraph whereby the City was refunding Charles Hall for legal expenses
he incurred for a City deposition. He stated that this expenditure was
discussed at the last regular meeting, however, was excluded during
preparation of the minutes. City Councilmember Egan stated that he was
satisfied with the corrections made in the December 1, 1987 City Council
minutes. After further discussion, a motion was made by City Councilmember
Egan, seconded by City Councilmember Smith, with all members voting in favor,
to ratify the December 17, 1987 City Council minutes, subject to the payment
of conference expenses for City Councilmember Smith while attending the
National League of Cities Conference and subject to a review by City
Councilmembers Ellison and Wachter.
PAYMENT AUTHORIZATION/NATIONAL LEAGUE OF CITIES CONFERENCE
FOR MAYOR BLOMQUIST
Mayor Blomquist presented a request for payment for her attendance
at the National League of Cities Conference in addition to a claim for mileage
expenses incurred while attending various meetings during the past several
months. In a motion by City Councilmember Smith, seconded by City
----Councilmember-Ega-n,--w#th-ali-members-voting--fn fav ,
incurred while attending a National League of Cities Conference and mileage to
City related meetings throughout the Metropolitan area for the past several
months to Mayor Blomquist was approved.
DNR AGREEMENT TO IMPLEMENT SHORELINE STANDARDS FOR
CLIFF LAKE GALLERIA PROJECT
Mayor Blomquist presented an agreement entitled "An Agreement to
Implement the Cliff Lake Shoreline Agreement to Protect Cliff Lake and its
Shoreline in its Original Form". She stated that the agreement was executed
by DNR and the Hoffman Development Company and requires approval by the City
of Eagan. City Administrator Hedges stated that he was not aware of the
agreement and to the best of his knowledge the City Attorney and appropriate
City staff have not reviewed the document and, therefore, either the City of
Eagan be stricken from the agreement or that any approval be subject to review
by the appropriate City staff. City Councilmember Egan suggested that he was
in agreement with the City Administrator and suggested that any action
consider the removal of the City of Eagan from the agreement and, further,
that staff review the agreement. In a motion by City Councilmember Egan,
seconded by City Councilmember Smith, with all members voting in favor,
authorization was given to confirm an agreement between the DNR and the
developer to implement the Cliff Lake Shoreline Agreement to protect Cliff
Lake and its shoreline in its original form and, further, that the City of
Eagan, wherever stated in said agreement, be removed and that the City staff
be directed to review the agreement of record.
