MINUTES OF A REGULAR MEETING OF THE
BOARD OF SUPERVISORS, EAGAN TOWNSHIP
A regular meeting of the Board of Supervisors was held on July
19th, 1960 at 8.00 o'clock P.M. at the Town Hall at which all members
were present.
Chairman Rahn opened the meeting. The Minutes of the preceding
meeting were read and unanimously approved as read.
The following applications for building permits were presented and
upon motion duly made and seconded were unanimously granted:
1. Richard J. Thorpe - Residential house permit.
2. Dustin Kruger - On behalf of Cedar Grove Construction Company,
18 residential home permits for Cedar Grove Nos. 1 and 2.
3. B. E. Haining - Residential home upon Lot 4, Block 5, Twin
View Manor.
4. Harry Ray - Residential home on 17 acres situated on Blackhawk
Road.
5. Wilfred G. Baumann - For garage at 2105 Emerald Lane, Cedar
Grove.
6. Myron and Henry Ellman, Contractors - Residential home upon
Lot 1, Block 8, Country Home Heights.
~ Mr. Samuel Hertogs appeared on behalf of Kimmes-Bartelma Construction
Company, Inc. regarding the gravel pit near the intersection of Highway No.
19 and McCarthy Road. A proposed agreement and the proposed Ordinance No.VIII
were submitted to Mr. Hertogs for study to determine his company's position
in regard to it in view of the fact operations were commenced prior to the
enactment of said Ordinance No.VIII without obtaining any permit or permission

from the Town Board. He advised the Board he would review the matter with
his client and contact the Town attorney within several days.
Application of Victor Karg for re-zoning from A, Agricultural to
I-l, Light Industrial of the following described lands was presented, to-wit:
Lot 1, except the Southeasterly 100 feet thereof,
and Lot 2, Loren Place, according to the plat
thereof on file and of record in the Office of the
Register of Deeds in and for Dakota County, Minnesota.

Mrs. Gooselaw and Mr. Gooselaw, Jr. appeared in opposition thereto.
The Town Board considered the arguments for and against the proposed re-
zoning and application for issuance of a special use permit to install
a commercial enterprise known as U-HaulCompany for the storage, assembly,
disassembly, repair and rental of automobile trailers. Upon motion duly
made by Supervisor Schwanz and seconded by Chairman Rahn, it was RESOLVED
that said application for re-zoning and for the issuance of a special use
permit be, and hereby is, denied.
The Town attorney presented proposed rules for the conduct of Town
Board and Advisory Planning Committee meetings. Upon motion duly made by
Supervisor Schwanz and seconded by Chairman Hahn, the rules were adopted
as presented.
A delegation from McKee Addition appeared requesting posting of
speed limits of from 20 to 30 miles per hour in McKee Addition in view of
heavy traffic and speeders in an area heavily populated with children. The
Board advised the delegation that it did not have the authority to establish
restrictions, which power resides in the Commissioner of Highways. Upon
motion duly made by Supervisor Schwanz and seconded by Chairman Rahn, it was
iESOLVED that the Town attorney make written request to the Commissioner of
Highways to examine the situation in McKee Addition and establish a speed

maximum of 30 miles per hour in that area.
The Town attorney presented proposed Ordinance No.VIII which was
discussed and changes directed. Upon motion duly made by Chairman Rahn and
seconded by Supervisor Schwanz, it was RESOLVED that said ordinance No.VIII,
an ordinance regulating excavations, pits and removal of earthly deposits
in Eagan Township be, and hereby is, approved and adopted subject to changes
in Section 3(f) requiring an annual renewal fee to be paid on or before
January 1st of each year following issuance of the permit and adding to
Section 5 the following:
(e) Use and employ such devices and methods necessary to control
noise and dust of processing and crushing equipment.
Clerk Louis Fischer reported he would be out of the State for 10 days
commencing July 21st, 1960. Upon motion duly made by Supervisor Schwanz and
seconded by Chairman Rahn, it was RESOLVED that Herbert Polzin be, and hereby
is, appointed as Deputy Clerk to act for and on behalf of Clerk Louis Fischer
during the latter's absence.
Chairman Rahn reported receiving communication from the Dakota County
engineer that the Township had been incorrectly advised prior to the 1960
annual Town meeting that the gas tax which would accrue to Eagan Township
for the year would amount to approximately $20,000.00, that the actual amount
of gas tax allocable to Eagan Township was approximately $5,500.00.
Supervisor Trapp reported that no application had been made by the
Rosemount School District for a building permit for its new school in the
South end of the Township. The Town attorney was informally requested to
contact the School Board about this.
Upon motion duly made the meeting adjourned.
