MINUTES OF REGULAR }.1Eh.~ING OF THE BOARD OF SUPERVISORS '- EAGAN ';rOWNSHIE
A regular meeting of the Board of Supervisors, Eagan Township
was held on August 15, 1961, at the Town Hall at 8:00 0' clock P.M.
at which all members were present except Supervisor Trapp.
Chairman Rahn presided. Tbe minutes of the preceding meeting
were approved as read with the exception of the item on residents from
Valley View Plateau which should be changed to: The Board of Super-
visors informal~ suggested that the group meet with them at the sight
on August 14. 1961 at 7:00 0' clock P.M.
Building permit applications were presented and approved as follows:

The Town Attorney rendered an opinion regarding the proposed
payment to Advisory Planning Committee members for services rendered. It
appeared, by Attorney General's opinion, no salaries could be paid to
Planning Committee members.
The application of John Baxley for the rezoning of special pro-
perty in Section 13-27-23 and for a special use permit to operate a junk
yard thereon was considered by the Board and it was noted that the Ad-

visory Planning Committee recommended denial thereof. Upon motion duly
made by Supervisor Schwanz and seconded by Chairman Rahn, it was
RESOLVED that said application for rezoning and for the issuance of
a special use permit to operate a junk yard thereon be, and the
same hereby is, denied; and it was FORmER RESOLVED that applicant
should take notice that he would have thirty (30) days from and
after the date of such notification received by him within which
to cease and desist from the operation thereof of said commercial
enterprise.
The Town Attorney reported regarding the legal aspects of
assessments for road improvements. A written legal opinion was
submi. tted to the Board of Supervisors.
The Town Engineer submitted the proposed new, up-to-date,
zoning map of Eagan Township. It was noted that the Advisory Plan-
ning Committee recoanended approval thereof. UPon motion duly made
by Chairman Rahn, and seconded by Supervisor Schwanz, it was RE-
SOLVED that the new zoning map as presented by the Town Engineer
be, and the same hereby is, finally approved. It was FURTHER RE-
SOLVED that the Town Ensineer file a copy thereof with the Register
of Deeds, Dakota County, Minnesota.
Mr. William Merlyn, Attorney, and Mr. Bruce Thompson, appeared
on behalf of DoIUllq Builders, Inc., with respect to the proposed
rezoning and preliminary plat approval of 127 acres situated in Sec-
tion 17-27-23 for the purpose of platting and constructing residen-
tial homes thereon. Informally the applicant was advised that cer-
tain problems existed with respect to central water and sewer systems

and that contact should be made with Cedar Grove Utilities Company
with respect thereto, and further studied by the Town. Attorney and
Town Engineer with regard to the existing franchise agreement cover-
ing said area.
Certain land owners situated in Valley View Addition appeared
requesting action regarding road improvements in the platted area.
Upon motion duly made and seconded, it was RBSOLVED that the Town
Attorney prepare an appropriate petition for the residents therein
with regard to the proposed improvements.
The application by Bisanz Construction Company for preliminary
plat approval in the Southwest one-quarter of Section 34-27-23 was
presented. Upon motion duly made and seconded, it was RESOLVED that
Bisanz should be informed to negotiate additional dedication of
road area from adjoining land owner Ohmann before any further action
would be taken upon the preliminary plat.
Upon motion duly made by Supervisor Schwanz and seconded by
Chairman Rahn, it was RESOLVED that the submission of the legal des-
cription with regard to the Frank Heuer property pursuant to previ-
ous resolution be. and the same hereby is approved, as appropriate
to the said previous resolution, as follows: The East 1/2 of the
East 1/2 of the Southeast 1/4 of Section ll, except the South 13-1/3
acres thereof; that part of the West 1/2 of the Southwest 1/4 of Sec-
tion l2, lying South and West of the railroad (C.M.St.P. & P.R.R.),
except the South 26-2/3 acres; that part of the SW 1/4 NWl/4 of Sec-
tion 12, lying Southwest of the railroad, all being in T. 27 N., R.
23 W., Dakota County, Minnesota, according to the Government survey
thereof.

Mr. Kenneth Rounds, Highway No. 19 appeared in behalf of
his application for real estate tax abatement on the ground of the
nearby Moeller Gravel Pit operation. Upon motion duly made by
Chairm3n Rahn and seconded by Supervisor Schwanz, said application
was denied.
Upon motion duly made by Chairman Rahn and seconded by
Supervisor Schwanz, it was RESOLVED that the Town Attorney prepare
bids f.or the purchase by the Township of a mower, loader, tractor,
and miscellaneous equipment subject to the presentation prior to
preparation of said bids of the appropriate equipment desired by
