MINUTES OF REGULAR MEETING OF BOARD OF SUPERVISORS t EAGAN TOWNSHIP
November 21st, 1961
A regular meeting of the Board of Supervisors, Eagan Township,
was held on November 21st, 1961 at 8:00 0' clock P.M. at the Town Hall.
Because Chairman Rahn was delayed, Supervisor Edward Schwanz acted as
Chairman .
The minutes of the preceding meeting were unanimously approved as
read.
Mr. Elroy Beulke, Route #1, St. Paul 11, Minnesota made applica-
tion for a building permit to construct a machine shed at the estimated
cost of $2,100 with dimensions of 32' x 64'. Upon motion duly made and
seconded, it was RESOLVED that said permit be, and the same hereby is,
granted.
The application of the Alexander Construction Co. for a gravel
pit operation on the Hugo Goers property on Highway No. 19, initial
operations to be conducted upon the East part of the ~ of the S~, Sec-
tion 15-27-23, was presented, along with the recommendation of the Ad-
visory Planning Committee for conditional approval. In view of the
strong public opposition to the proposed gravel pit operation, Chairman
Schwanz referred the application back to the Advisory Planning Committee
for consideration at its December ll~ meeting, facts other than present-
ed to the committee having been presented to the Board of Supervisors.
The application of Stuart Barringer for an electrical wiring per-
mit was stricken from the Agenda for lack of appearance by the applicant.
No action was taken by the Board on recommendation of the Advisory Plan-
ning COllllittee.
The legal opinion regarding requirements for preparation of plans
and specifications by registered architects and engineers in Eagan Town-
ship was presented to the Board along with the recommendation of the
Advisory Planning Committee to recommend Ordinance No. III in accordance
with the opinion. Upon motion duly made by Chairman Schwanz and second-
ed by Supervisor Trapp, it was RESOLVED that Ordinance No. III be, and
the same hereby is, amended to effect the proposals set forth in the
recommendation of the Advisory Planning Committee and the Town Attorney
subject to final review of the proposed amended Ordinance No. III.
Mr. Kenneth Mauweissen representing the West Eagan Civic Associa-
tion, and others, appeared in support of the proposal for a special fire
district including the Cedar Grove area. The matter was discussed at
length. Upon motion duly made by Supervisor Hahn and seconded by Super-
visor Trapp, it was RESOLVED that a notice of public hearing be published
setting same for December l3~, 1961 at the Cedar Grove Elementary School
for a public discussion of the issue involved.
The Town Attorney presented a proposed form of waterworks agree-
ment to be entered into between Eagan Township and Timberline, Incorpor-
ated et ale Upon motion duly made by Supervisor Rahn and seconded by
Supervisor Trapp, it was RESOLVED that said agreement as amended in its
proposed form including a performance bond in the sum of $15,000 and
lien waiver provisions, be approved subject to final approval of the
agreement as drafted in accordance herewith.
Mr. Bruce Thompson, representing Donnay Construction Co., appear-
ed in relation to its application for three building permits for model
homes on Hahn Road near County Road No.7. Upon motion duly made and
seconded, it was RESOLVED that said permits be, and the same hereby are,
issued conditionally upon applicant's meeting the recommendations set
forth by the Advisory Planning Committee and further that the subject
homes meet the county standards as to setback from County Road No.7.
Mr. David Deurenberger, Attorney, appeared on behalf of the Dako-
ta County Electric Cooperative with respect to delineation of areas of
public utility electrical service. Upon motion duly made by Supervisor
Rahn and seconded by Chairman Schwanz, it was RESOLVED that the Dakota
County Electric Cooperative and the Northern States Power Company, the
two utility companies in question, should be notified to appear at the
next town board meeting to be held on December 5~, 1961 to aid in the
Board's determination of service areas.
Donnay Construction Company, through its representative Bruce
Thompson, requested from the Board an expression that in the event
Donnay Construction Company proceed with its proposed plans for resi-
dential development adjacent to Cedar Grove in accordance with the
plans and specifications prescribed by the Board of Supervisors and
subject to all Veterans Administration and Federal Housing Authority
regulations, that the town would take over the sewage and water systems.
Upon motion duly made by Supervisor Rahn and seconded by Chairman
Schwanz, it was recommended that in the event such residential develop-
ment is completed in accordance with the plans and specifications and
other applicable rules and regulations of the Board of Supervisors the
sewage disposal and water systems constructed therein be taken over by
the Township upon completion subject to appropriate agreement and approv-
al by the Town Engineer and the Advisory Planning Committee.
Application for approval by the Township of the road through
Slater's Acres was presented. Upon motion duly made by Chairman
Schwanz and seconded by Supervisor Rahn, it was RESOLVED that the
said road through Slater's Acres be, and the same hereby is, accepted
by the Township conditioned that no additional platting of lots be per-
mitted until the connection between said road and Cedar Avenue South
is widened and the bank appropriately cut and until receipt of request
of the following abutting property owners therefore. to wit: Charles
Bolstrom. Arch Hum, James O'Donohue. and John Waubowski.
The Town Engineer delivered a report on the Beau de Rue Drive.
Upon motion duly made and seconded, it was RESOLVED to withhold $500
of the agreed contract price and to hold the performance bond in status
quo until further work upon said road shall be completed next spring by
Riegger Roadways in accordance with the agreement between it and the
Township.
Upon motion duly made and seconded, it was RESOLVED that Stuart
Barringer be directed to appear on December 5~. 1961 at the next regu-
lar meeting of the Board of Supervisors for his claimed violation of
Ordinances No. III and VI.
