EAGAN TOWNSHIP JANUARY 16th. 1962 A regular meeting of the Board of Supervisors, Eagan Township ....as held on January l6tb, 1962 at 8:00 0' clock P.M. at the Town Ball at ....hich all members were present. Chairman Rahn presided. Mr. and Mrs. Stuart Barringer appeared in response to an earl1- er request by the Board of Supervisors and requested that the plat in- troduced for Barringer's 1st Addition to Eagan Township, Route 1, St. Paul 11, Minnesota be accepted. Upon motion duly made by Supervisor Trapp and seconded by Supervisor Schwanz, it was RESOLVED that said plat be, and the same hereby is accepted. The following building permits were applied for: Stuart Barringer -Rt. 1. After reviewing the recommendation for approval by the Advisory Planning Comi ttee in regard to the application of the St. Paul Diocese for the rezoning of part of the NW 1/4 of the SW 1/4 of Section 20-27- 23 from At Agricultural to P, Public Facilities, upon motion b1 Chair- 191 man Rahn and seconded by Supervisor Schwanz, it was RESOLVED that the application be. and hereby is, approved. Mr. Charles Rueger appeared on behalf of his application to rezone a strip of land along old Highwq No. 13 on the Southeasterly side thereof from A. Agricultural to c-2, Heavy Commercial. A letter of consent from Gordon Beaudette, a contiguous residential land owner, and a map showing the proposed rezoDed area to conform to the base of the bluff on the Ease side of the proposed area were submitted. Upon motion duly made and seconded, it was RESOLVED that a strip of land approximately 1,500 feet wide and approximatel1 1,200 feet long running parallel on the Southeast side thereof, commencing from the North line of the existing Heavy Commercial zoning near the Beaudette Well Drilling Company, be rezoned from A, Agricultural to C-2, Beav,- Commercial, subject to the submission by Mr. Rueger of an appropriate legal description of the area proposed for rezoning. The applicatioD of Ashbach Construction Co. for a gravel pit permit and special use permit for operations in all that part of Sec- tion 18 situated Northwesterly of the Chicago and Northwestern Rail- road tracks upon lands owned by J. A. Adelman, was tabled until an appropriate agreement is drawn up and submitted b1 the Town Attorney. The application of Raymond Rabn for rezoning of property on High....ay Ne. 7 an. Blackhawk Road from A, Agricultural to C-l. Light Commercial for the operation of a ....elding shop was considered. After review of the Advisor,- Planning Committee's recommendations and upon motion by Supervisor Schwanz and seconded by Supervisor Trapp, it was 187 RESOLVED that rezoning be, and hereby is~ denied. Consideration of the application by Mr. Oscar Jones for a gravel pit permit in the SW 1/4 of the SW 1/4 except the North 1 rod thereof, SectioD ll-2?-23, and the NW 1/4 of the NW 1/4 of Section 14-27-23 was deferred until the Town Attorney and the Town Engineer have prepared an appropriate agreement for said gravel pit permit. The Town Attorney rendered an opinion concerning the use of money received for clearing private drive~s with township equipment. It appeared that township equipment could be used for private purposes in the case of snow removal provided that a reasonable charge be made to the individuals benefited to cover the costs thereof to the town- ship. A report by the Town Attorney as to the status of the road in Posts Addition No.1. parrallel to Highway No. 13 was made. Mr. William Busch and Mr. EDil Jandric appeared on behalf of the application of Cedar Grove Utilities Co. for approval of the mort- gaging of the Cedar Grove Utilities Co. Water and Sewer Franchises. Upon motion made by Chairman Rahn and seconded by Supervisor Trapp, it was RESOLVED that the mortgaging of the Water and Sewer Franchises of Cedar Grove Utilities Co. \U1der the terms of the Indenture Agree- ment dated January 1st, 1962 by and between said Cedar Grove Utilities Co. and Northwestern National Bank of Minneapolis, as rtrustee, the form of such indenture having been presented to the Town Board, be approved, subject to review by the Township Attorney, to the affect that the township has no financial obligations nor liabilities under this in- -Ii '~ lH:l denture, as evidenced by separate resolution of even date herewith. Upon motion duly made and seconded, it ....as RESOLVED to extend the Contract between Eagan Township and George Ohman, Jr. for snow removal on the public roads in Eagan Township for one year covering the period January 1st, 1962 to December 31st, 1962.
