MINUTES OF A REGUU\.R MEETING OF nm BOARD OF SUPERVISORS
EAGAN TOWNSHIP, DAKOTA COUNTY, MINNESOTA
July 20, 1965
A re~llsr meeting of the Board of Supervisors, Easan Township,
Dakota County, Minnesota was held at the Town Hall at 8:00 o'clock P.M.
on July 20, 1965 at which all members were present.
Chairman Rahn presided. The reading of the minutes of the previous
meeting wse . approved as read. There were no building permits.
The application of OCR Company, 3900 Sibley Memorial Highway, for
a building permit for construction of a hardware store, SO' x 80'
Northeast of the Texaco Station near Cedar Avenue and Highway #13 was
presented. It was noted that the Advisory Planning Committee recommended
approval subject to certain conditions. Upon motion made by Chairman
Rahn and seconded by Supervisor Klein, it was RESOLVED that said
application be, and it hereby is, approved and that the Town Attorney
be instructed to determine whether the immediate area was included in
an extension to the Cedar Grove Utilities Company Franchise Agree<<ent.
Judith MOhr appeared on behalf of her application for final plat
approval of Dodd View Addition, Section 36-27-23. It was noted that
the Advisory Planning Committee recommended approval subject to certain
conditions reflected in its minutes. After discussion and upon motion
by Chairman Rahn and seconded by Supervisor Schwanz, it was RESOLVED
that the applicant be given authority to install a culvert on Gun Club
Road near the Mohr property in Section 36 at Mohr's expense under the
supervision of the Town Road Overseer, Marvin Wenzel. The Board
instructed the applicant to submit its plat plans to the Town Engineer
to determine compliance with the applicable Eagan Ordinances.
The application of Richard Gates, Minnesota Machinery Company,
Highway #13, for a sign permit near their plant was next presented.

The Advisory Planning Committee recommended approval subject to approval
of the Town Engineer. Upon motion by Cheirtnart Rahn and seconded by
Supervisor Klein, it was RESOLVED that said application be, and it
hereby is, approved subject to the determination by the Town Engineer
concerning the required setback requirements.
Upon motion duly made and seconded, it was RESOLVED that those
certain resolutions presented by the Town Attorney relative to the sale
of road and fire equipment bonds, copies of which are attached hereto
and made a part hereof be, and they hereby are, adopted.
Dr. Elliot and Mr. Stoltman appeared relative to the street
situation in Timberline Addition explaining that no progress had been
made by the Timberline developers during the past two week period. After
discussion and upon motion duly made and seconded, it was RESOLVED that
the Town Attorney be, and he hereby is, instructed to send a letter to
the Timberline representatives relative to the June 15, 1965 understanding
at a regular Board of Supervisors meeting at which time the Timberline
representatives agreed to keep the roads in the Addition in a passable
condition; the Town Attorney was further instructed to state that if
the improvements contemplated at that meeting were not completed by
July 31, 1965, that at the Board's regular meeting on August 3, it would
consider forfeiture of the improvement bond and the possibility that no
further building permits be granted in Timberline Addition until said
improvements are completed.
Mr. Alphy LeMay appeared relative to a request for Special Use
Permit for operation of a blacktop plant in his gravel pit in the
Southwest Quarter of Section 10. The Town Attorney was instructed to
review Ordinance No. 8 relative to blacktopping and to report at the
next regular Board meeting.

Mr. Silas Palmer appeared relative to the assigning of cases to
Justices in the Township. The Board referred Mr. Palmer to the minutes
of. the Board's last regular meeting concerning assigning of cases by
police officers.
Mr. Dean Goserud, realtor, 1821 University Avenue, St. Paul appeared
relative to tbe potential sale of the Sparkman property at Deerwood
Drive and Highway #31, and the disposal of logs and refuse on that
property. After discussion concerning the Board's position in the
matter, an informal understanding was reached that the owner be given
an eight month period to sell the property and push the logs to the east
boundary of the lot in question and to place fill over the refuse and
logs to improve its appearance. Mr. Goserud was encouraged to arrange
an appropriate sale of the property.
Upon motion duly made by Supervisor Klein and seconded by Chairman
Rahn, it was RESOLVED tlwt a 1953 Ford Tractor, Serial Number NtoA 76773
be, and it hereby is, purchased from hlbert Wenzel for the sum of $995.00
and that the Town httorney be instructed to draft an appropriate Bill
of Sole.
Upon motion duly made and seconded, it was RESOLVED that Mr. James
Klingel be, and he hereby is, appointed as the representative from Eagan
on the Dakoto County Planning Commission.
Upon motion duly made by Chairman Rahn and seconded by Supervisor
Schwanz, it was RESOLVED that Mr. Rosene, the Town Engineer, be, and
he hereby is, instructed to inspect the Gopher Smelting Company plant
and report back to the Board of Supervisors concerning its operation.
Upon motion mode by Supervisor Klein and seconded by Supervisor
Schwanz, it was RESOLVED that the Town Engineer be, and he hereby is,
authorized to prepare a partial water study covering that portion of the
Township being considered for sanitary sewer purposes.

Upon motion duly made by Supervisor Klein and seconded by Chairman
Rahn, it was RESOLVED that the Clerk be, and she hereby is, authorized
to advertise for a public hearing covering proposed installation of
sanitary sewers in Eagan Township according to the proposed plan as
prepared by the Town Engineer.
Upon motion, it was RESOLVED that all bills as presented were
ordered paid.
Upon motion, the meeting adjourned.
