MINUTES OF A RECULAR MEE'!ING OF THE BOARD OF SUPERVISORS

December 21, 1965
A regular meeting of the Board of Superv13ors, Eagan TO~'n\ship,
was held on December 21, 1965 at 8:00 P. M. at the Town Hall at which
all members were present. Chairman Rahn presided. The minutes of the
last meeting were approved as read. There were no building pennits.
The application of Jerome Harrington for the rezoning of a 20 ~~re
perce 1 situated in the NE 1/4 of the NE 1/4 Section 29-27-23 from A,
Agr~.cult:ural to C-2 Heavy Comnercial was presented by attorney James
Nelson and Mr. Howard Dahlgren. It was noted that the Advisory Planr.lng
Commi ttee recoarnended approval subject to certain conditions. Upon motion
by Supervisor Klein, seconded by Chairman Rahn it was RESOLVED that the
application be and it hereby is approved subject, however, to submission
by applicant of an appropriate agreement by himself and his successors
that the r~zoning is subject to a 50 foot easement for highway purposes
south of the center line of Highway #30 and subject to the dedication of
40 feet of the west side of the easterly section line of Section 29 in
the event that the township should at some future t~me construct a
section line road between Sections 29 and 28.
An application was presented by Mr. Fischer for a permit under
Ordinance #8 to excavate and operate a gravel pit in the NE 1/4 of the
~~ 1/4 of Section 13-27-23, on property owned by Gopher Smelting Company.
It was noted that the Advisory Planning Committee recommended approval
as the excavation would be of high ground so as to ulti~ately level the
same with the grade of the adjacent railroad tracks. Upon motion by
3upervisor Klein and seconded by Supervisor Schwanz it was RESOLVED that
said application for a gravel pit permit be, and it hereby is, gr.:'m~e.j
subject, however, to the understanding that the applicant will notify the

The Reverand Frank DeCourcey appeared relative to a requc~t fo~ the
use of a Destroilet automatic toilet unit in the mobile Methodist Chl"-;,ch,
Upon motion by Chairman Rahn, seconded by Supervisor Schwanz it ~~s
RESOLVED that said Destroilet automatic toilet unit be, and ii: hc;:~~;)y
is, approved subject, however, to satisfactory performance as dcten~ined
by the Town Board.
The l-Town Engineer reported relative to his inspection of,t':1~
proposed location for two entry gates into Cedar Crest at the corner of
Cedar Avenue and Cocnelian Lane, Upnn motion duly made by Supervisor Klein~
seconded by Chairman Rahn it was RESOLVED that the request for the two
entry gates be, and it hereby is, approved provided that they be located
at least 15 feet from the edge of the service road curb and 13 feet from
the curb en Cornelian Lane, as recommended by the Town Engineer anc further
that it be subject to the submission of the appropriate building feG ty
Cedar Grove Construction Company.
The Town Attorney was requested to write Mrs. John Musser, Sa~~,n
Church Road in St. Paul requesting payment'. of $20.00 for pickin:; 'lP and
boa~dlng two dogs owned by Mrs. John Musser by the Eagan dog catch~r.
The clerk presented a request from the Dakota County Auditor for
approval of a non-conservation classification of for.feited lands COtl-
54.sting of the north two rods of the west two rods of the NW l/4 of th,,;;
SE 1/4 in section 31-27-23. Upon motion by Chairman Rahn and seconded by
Supervisor Schwanz it was RESOLVED th'et the appropriate officers bz, aad

Upon motion by Supervisor Klein and seconded by Chairman R.:t~m ~;:
was RESOLVED that the application of Fred Schulze for a tax abs':.;:1T.P'~':
coveri~g the east 1/2 of the northeast 1/4 of Section 35-27-23 be, al~
it b.eZ'~by is, approved subject. however, to the reconmended abatemer.t
valuation of the County Assessor.
Upon motion by Chairman Rahn, seconded by Super 'sor Klein if..: ,;va;:
RESOLVED that the statement of Kilmartins Toolhouse, Inc. of Minneapolis
for fire department tools in the sum of $138.88 be, and it hereby is
approved.
Upon motion all bills were ordered paid.
Upon motion the meeting was adjourned.
