EXTRACT OF MINUTES OF MEETING OF THE BOARD OF SUPERVISORS OF
EJ,GAN TOWNSHIP, DAKOTA COmny, MINNESOTA
October 14, 1956
Pursuant to due call and notice thereof, a special meeti~g of the
Board of Supervisors of Eagan Township, Dnkote County, Minnesota was duly
held nt the town hall in said municipality on the 14th day of Octo~er, 1966,
at 7:00 o'clock P. M.
The following members were present: Rahn, Klein, Schwanz and none
were absent.
The clerk presented an affidavit showing publication of notice of
hearing on the proposed assessment for Sanitary Sewer Trunk and Lateral
Assessments in Cedar Grove #5 in the official newspaper in accordance with
a resolution heretofore adopted by the Board, which affidavit was examined,
ouod satisfactory and ordered placed on file.
The Chairman announced that the meeting was open for the consideration
of objections. if any. to said proposed assessments. All persons were then
given an opportunity to present oral objections, and all written objections
theretofore filed with the clerk were presented and considered, and all
such objections were tabulated as follows: There were no oral or written
objections.
Supervisor Klein then introduced the following resolud. on and moved its
adoption:
RESOLUTION llDOPTING AID CONFIRMING I~SSESSMENTS FOR SANITARY SEWER
TRUNK AND LATERALS.
BE IT RESOLVED by the Board of Eagan Township, pakots County, Minnesota
as follows:

in accordance with the provisions of Minnesota Statutes Annotated,
Section 429, and notice has been duly published and mailed, as required by law,
that this Board would meet to hear and pass upon all objections, if any, and t\;
amend said proposed assessments as might be necessary, and said proposed assess.
ment roll has at all times since its filing been open for public inspection,
and an opportunity has been given to all interested persons to present their
objections, if any, to such proposed assessments.
(2) This Board, having heard and considered all objections so presented,
and being fully advised in the premises, finds that each of the lots, pieces
and parcels of land enumerated in the proposed assessment roll was and is
specially benefitted by the construction of said improvement i.n not less
than the amount of the assessment set opposite the description of each such
lot, piece and parcel of land, respectively, and that such amount so set out
is hereby levied against each of the respective lots, pieces, and parcels of
land therein described.
(3) The propesed assessment roll is hereby adopted and confirmed as the
proper special assessment for each of said lots, pieces and parcels of land
respectively, and the assessment against each parcel, together with interest
at the rate of six (6) per cent per annum accruing on the full amount thereof
flOm ttme to ttme unpaid shall be a lien concurrent with the general taxes
upon such parcel and all thereof. The total amount of each such assessment
shall be payable in equ~l 8ll~u81 inr.tallments extending over a period of

other unpaid installments, to be payable .t-1ith general taxos for each consecutiv
year thereafter until the entire assessment is paid.
(4) Prior to certification of the assessment roll to the County
Auditor, the owner of any lot, piece or parcel of land assessed hereby m8Y
at any time pay the whole of such assessment with interest accrued to the
date of payment to the treasurer of the municipality.
(5) The Clerk, shall as soon as may be, prepare and transmit to the
County Auditor a certified duplicate of the assessment roll, to be extended
upon the proper tax lists of the county, and the County Auditor shall
thereafter collect said assessments in the manner provided by law.
~he motion for the adoption of the foregoing resolution was duly
seconded by Chairmen Rahn and upon vote being taken thereon the following
voted in favor: Rahn, Klein, Schwanz and none voted against same.
Whereupon said resolution was declared duly passed and adopted.

called and held on the date herein indicated, so far as the same minutes
relate to the levy of assessments for an tmprovement of said municipality.

HELD ON Octcber 14, 1966
Pursuant to due call and notice thereof, a special meeting of the
Board of Supervisors of Eagan Township, Dakota County, Minnesota, W\S duly
held at the Town Hall at 8:00 p. M. on Friday, October 14th, 1966.
The following members were present: Arthur Rahn, John Klein, Edward
Schwanz, none were absent.
The Clerk presented an affidavit showing publication of a Notice of
Hearing on the proposed assessment for Rahn Road Improvements in the official
newspaper in accordance with a resolution heretofore adopted by the Board,
which affidavit was examined, found satisfactory, and ordered placed on file.
The Chairman announced that the meeting was open for the consideration
of abjections, if any, to said proposed assessments. All persons were then
given an opportunity to present oral objections, and all written objections
theretofore filed with the clerk were presented and considered, and all
such objections were tabulated as follows: (1) John Todd, Attorney repre-
senting Cedar Grove Construction Company, requested that the frontage com-
putation for Lot 1, Block 9, Cedar Grove #1, be reduced from 138' to 98'
because of a gas line easement. (2) Mr. Todd requested that computation
on Lot 8, Block 3, Cedar Grove #3 be reduced from 195' to 135' because of
gas line easement. (3) Mr. Todd explained that a portion of Lot 44, Block 8,
Cedar Grove #3 abutted upon Rahn Road was a rear lot liDe and requested that
the assessment be reduced from $850.00 to approximately $50.00 to $100.00.
Mr. Todd voiced verbal general objections to the assessment computation of
$5.00 per front foot on platted property and a credit of $2.50 per front
foot on unplatted and unsubdividable property.

Mr. Harry Ray, Attorn~y r~presenting the Minnesota Baptist Conference,
objected to the proposed aGSaSSI'l;:!at agai~,,~;t tn2 M1.rmcsota Baptist Conference
property constituting the Cedar Gruve Bapdst Church at Rahn Road and
County Road #30 on the following bases: (A) Tn8t churches cannot be
taxed on real estate. (B) That the premises are unplatted but being assessed
as platted property. (C) That the premises have not been;giva~ aCCCGS to
Rahn Road. The following persons also appeared generally objecting to the
assessment: R. H. Dalstrom, 2014 Carnelian Lane; Robin Norton, 2014
Bluestone Lane; Mrs. Klancher, 2014 Flint Lane.
After hearing the objections and upon motion duly made end seconded it
was RESOLVED that the hearing relative to assessments on Rahn Road be, and
it hereby is, continued to Tuesday, October 18th at 7:00 o'clock p. M.
Upon motion the meeting adjourned.

EXTRACT OF MINUTES OF MEETING OF THE BOARD OF SUPERVISORS
EAGAN TCMNSHIP, DAKOTA COUNTY, MINNESOTA
HELD ON OCTOBER 18, 1966
Pursuant to due call and notice thereof, a continued special meeting
of the Board of Supervisors of Eagan Township, Minnesota was duly held at
the Town Hall on the 18th day of October, 1966 at 1:00 o'clock P. M.
The following members were present: Arthur Rahn, John Klein, Edward
Schwanz and the following were absent: None.
The Chairman announced that the continued hearing concerning the
assessments covering Rahn Road improvements was open to consideration of
further objections, if any, to the proposed assessments.

Mr. Harry N. Ray, Attorney representing the Minnesota Baptist Conference,
III appeared and verbally renewed his objec 'ups at the first hearing and, in
addition, submitted a written objectioi i:0 proposed street assessment for
Rahn Road dated October 18, 1966. After discussion and upon motion by
Chairman Rahn the following resolution was introduced and moved for adoption:
RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS FOR RAHN ROAD IMPROVEMENTS.
BE IT RESOLVED by the Board of Supervisors of Eagan Township, Dakota
County, Minnesota, as follows:
(1) The Clerk, with the assistance of a qualified person heretofore
selected by the Board of Supervisors has calculated the amount proper and
necessary to be specially assessed for Rahn Road Improvements against every
assessable lot, piece, or parcel of land affected thereby upon the basis of
benefits, without regard to cash valuation, in accordance with the provisions
of Minnesota Statutes Annotated, Section 429, and notice has been duly
published and mailed, as required by law, that this Board would meet to
hear and pass upon all objections, if any, and to amend said proposed
assessments as might be necessary, and said proposed assessment roll has at
all times since its filing been open for public inspection, and an opportunity
has been given to all interested persons to present their objections, if
any, to such proposed assessments and said proposed assessment has been
amended as to certain parcels of land, by resolution duly adopted this date.
2. This Board, having heard and considered all objections so presented,
and being fully advised in the premises, finds that each of the lots, pieces, .
and parcels of land enumerated in the proposed assessment roll as so amended
was and is specially benefitted by the construction of said improvement in
not less the amount of the assessment set opposite the description of each
such lot, piece and parcel of land, respectively, and that such amount so set
out is hereby levied against each of the respective lots, pieces, and parcels
of land therein described.

(3) The proposed assessment roll as amended is hereby adopted and
confirmed as the proper special assessm~'!:';; for each of said lots, pieces
and parcels of land respectively, and t~( Assessment against each parcel,
together with interest at the rate of six (6) per cent per annum accruing
on the full amount thereof from time to time unpaid shall be a lien concurrent
with general taxes upon such parcel and all thereof. The total amount of
each such assessment shall be payable in equal annual installments extending
over a period of teu.:q (10) years, the first of said installmsnts, together
with interest on the entire assessment from the date hereof to December 31,
1966, to be payable with the general taxes collectable during the year 1967,
and one of each of the remaining installments, together with one year's
interest on that and all other unpaid installments, to be payable with
general taxes for each consecutive year thereafter until the entire assessment
is paid.
(4) Prior to certification of the assessment roll to the County
Auditor, the owner of any lot, piece or parcel of land assessed hereby
may at any time pay the whole of such asseSSment with interest accrued to the
date of payment to~e Treasurer of the municipality.
(5) The clerk, shall, as soon as may be, prepare and transmit to the
County Auditor a certified duplicate of the assessment roll, with each then
unpaid installment and interest set forth separately, to be extended upon
the proper tax lists of the County, and the County Auditor shall thereafter
collect said assessments in the manner provided by law.
(6) The proposed assessments heretofore made in respect of the improvemen
shall be and are hereby amended so as to read as shown below, and the clerk
is authorized and directed to indicate the said amendments on the face of
said assessment roll.

The motion for the adoption of the foregoing resolution was duly
seconded by Supervisor Schwanz and upon vote belug taken thereon tbe following
voted in favor: Arthur Rahu, John Klein, Edward Schwanz, and none voted
against same.
Whereupon said resolution was declared duly passed and adopted.
