MINUTES OP REGULAR MEETING OF THE BOABD OF SUPERVISORS

A regular meeting of the Board of Supervisors of Eagan Township was held
.
on October 18, 1966, at 7:30 o'clock P. M. at the Town Hall at which all
members were present. Chai~n Rahn presided.
Chal~n Rabn announced the first order of business was a public
hearing concerning the appl1cat ion of Vernon R. Colon, Degree of Honor Bldg.,
St. Paul, Minn., to rezone the N 460' of the E 200' of the NE 1/4 of the
HE 1/4 of Section 16-27-23 from A, Agricultural to C-l, Light Commercial.
The clerk presented tbe affidavit of publication. Mr. Colon and attorney,
'Rober Miller, together with Mr. and Mrs. Englert appeared concerning the
application. It was noted that the applicant moved to SDeDd the description
in the application to strike out a portion of the former amended description
and to read as follows: Beginning at the NE corner of the NE 1/4 of the NE 1/4
of Section 16-27-23, then W along the N line thereof 200.0', then Sand
parallel with the E line of said section 460.0', then northeasterly 208.16'
to a point on the East line of said section which is 400.0' S of the point
of beginning, then N along said Eline 400.0' to the point of beginning and
the W 100' of tbe E 300' of the N 400' of the HE 1/4 of the HE 1/4 of Section
16-27-23. Upon motion by Chairman Rahn, seconded by Supervisor Schwanz, it
was RESOLVED that said application for rezoning be and it hereby is approved
pursuant to the amended description of pro perty . Supervisor Klein voted Nay.
4t 8:00 o'clock P. M. the Board announced that a public hearing concernin~
the application of the Lutheran Evangelistic Movement, Inc. 904 Hennepin
Ave., Minneapolis, Minn. j relative to rezoning from At Agricultural to P,
Public Facilities of 120 acres in Section 35-27-23 was reconvened. The
Chai~D read 8 letter from the Dakota County Planning Commissioner and a
resolution fram the Dakota County Park Board favoring the area for inclusion
in the County Park System. Mr. Justin Torgrimson and Mr. Claire Jennings
appeared on behalf of the appli~a~t. Num~rous neighboring property owners
also appeared in opposition.
After extended discussion and upon motion duly made by Supervisor Schwanz
and seconded by Supervisor Klein it was RESOLVED that said application for re-
zoning be, and it hereby is, denied. The decision was based upon numerous
objections which were raised either formally or informally during the
original and continued hearings, including the following, but not excluding
othera not hereinafter cited:
1. There appeared to be a lack of a comprehensive plan for the proposed
camp.
.2. The lack of muniCipal utilities including sewer and water for at
least the immediate future years.
3. The expressed desire by the Dakota County Park Board that the area
around Holland Lake including the applicant's area be included within the
county park system.
4. The desire on the part of the Eagan Township Park Board that in
tbe event that the srea is not included within the county park system that it
would be desirable 8S 8 town pa rk.
5. The lack of adquate fire and police protection desirable for a private
camp in the township.
6. The apparent inadequacy of access roads at the present time to handle
up to 1,500 people at the camp.
7. The potential problems accompanying the influx of bouse trailers on
the premises including utilities, police and fire protection, etc.
The minutes of the previous meeting were approved as mailed.
There were no building permit applications.
Mrs. Lins, Mr. George Temple and Mr. Dick Thorpe appeared on behalf of
the proposal of the Cedar Grove Women's Community Action organization concern-
ing a proposed warming house for the Cedar Grove Park Pond for skaters. Mrs.
Lins ~ead a proposal dated October 18, 1966, and filed it with the clerk.
Upon motion by Supervisor Klein, seconded by Chairman Rahn it was RESOLVED
that the townShip would pay for the electrical installation in an amount not
to exceed $100.00 to be supervised by the town park chairman, Richard Thorpe.

It was further RESOLVED that the W. C. A. 0. be, and it hereby is, permitted to
proceed with construction of the warmirz 'house acco!-ding to the plans submitted
subject to final approval by the town engineer before acceptance by the
township of the completed building.
Discussion ensued concerning the billing by the township for sewage
service in Cedar Grove #5. Uponnnotion by Supervisor Schwanz, seconded by
Chairman Rahn, it was RESOLVED that the town clerk be, and she hereby is,
directed to bill directly to property owners in Cedar Grove #5 which come
under the municipal system but which are receiving services from Cedar Grove
Utilities Company on the following basis: That $1.00 be added for each month
service bill over and above the amount paid to Cedar Grove Utilities Company
and further that one month advance deposit be required from each property
owner.
The application of Lull Engineering Company for a building permit to
construct two additions to its faciltties at 3045 Highway #13 was next presented
It was noted that the Advisory Planning Committee recommended approval.
Upon motion by Supervisor Schwanz, seconded by Chairman Rahn, it was RESOLVED
that said building permit application be, and it hereby is, approved subject,
however, to the town engineer's approval of the final plan. The engineer
reported that the plans were acceptable and recommended approval.
Mr. George Leitner, 931 Randolph Avenue, St. Paul, Minnesota appeared on
behalf of his application for a gravel pit permit under Ordinance #8 to extract
peat from certain acreage in a 28 acre parcel described as parcel 3050D
consisting of the S 8 acres of the NW 1/4 of the SW 1/4 of Government Lot 7
and being part of Government Lot 7 lying west of the Railroad lying in the
NE 1/4 of the SW 1/4 containing 20 acres and Parcel 3058, S 264' of the N
1056' of the NW 1/4 of the SW 1/4 containing 8 acres. It was noted that the
Advisory Planning Committee recommended approval for a one year period and
subject to the following conditions as recommended by the Planning Committee:

1. The filing with the t~rn clerk of a $500.00 performance bond.
2. That DO excavating be p~~lttcd upo~ the properties described in the
application and for which area the permit would be issued to a depth of more
than 4 feet.
3. the permit fees to be waived.
Supervisor Klein voted Nay.
Mr. Charles J. lWeger, 3980 Beau de Rue Drive, and Mr. Jean Par.anto
appeared on behalf of the Reuger application to rezone part of the Section
19-27-23 containing 21.8 acres from A, Agricultural to R-6 Residential-Multipl€
District. Upon motion by Supervisor Klein, seconded by Supervisor Schwanz it
was RESOLVED that a public hearing be, and it hereby is, scheduled for Novembet
15, 1966 at 7:00 o'clock p. M. and the clerk be directed to publish notice of
same.
Mr. Jean Par.anto also appeared info~lly to present a preliminary plat
of the Cedar Industrial Park situated on Highway 113 near Blackhawk Road.
After discussion and upon motion by Chairman Rahn, seconded by Supervisor
Schwanz it was RESOLVED that the general layout of the street plan of Cedar
Industrial Park covering 175 acres with approximately 30 sites, be and it
hereby Is, approved subject to submission of a fo~l plat indicating the exact
street layout together with an application. The Advisory Planning Committee
had recommended approval.
Mr. Thomas S. Mohr, Route #2, Rosemount, M1oo. appeared regarding alleged
continued violations of Eagan Ordinances upon his premises. A report from
Pol1ce Chief Martin Deslauriers concerning an inspection of the property on
October 5, 1966, was read and discussed. Mr. Mohr also questioned whether the
Town intended to improve the town road lying adjacent to the Mohr property
between Highway #3 and Dodd Road. Upon motion by Supervisor Klein, seconded
by Supervisor Schwanz it was RESOLVED that the town engineer be, and he
hereby is, instructed to inspect the property together with the road overseer
and make appropriate recOlllDendations concerning tbe up-grading of the road.

Upon motion made hy Supervisor Schwanz, seconded by Supervisor Klein,
it was RESOLVED that the Board of Supervisors be, and it hereby is, on record
ratifying the actions of the town officials in acquisition of a $10,000.00
loan from the Valley National Bank dated September 13, 1966, to run through
October 1, 1966. The reason for the loan was to permit a savings of approx-
imately $740.00 in interest on certain time certificates held by the town at
Valley National Bank.

The town attorney presented a proposed Amendment to Ordinance #10
concerning the sale of topographic maps. Upon motion by Supervisor Klein,
seconded by Supervisor Schwanz, it was RESOLVED that said proposed amendment
be, and it hereby is, adopted with an addition to provide that the 2' contour
map to be submitted to the Township with an application for approval of a plat
be used only in conjunction with that application.
Discussion was had concerning the matter involving the inclusion of
Yankee Doodle Road in the Dakota County Road system. Upon motion by Supervisor
Schwanz, seconded by Chairman Rahn it was RESOLVED that the Town Board be,
and it hereby is, on record dropping any legal action against Dakota County
to include tbe Yankee Doodle Road in the County Bead system. Supervisor
Klein voted Nay.
The Chairman announced that bids would be opened for a station wagon type
police car. The following bids were submitted.
Fairview Plymouth, Inc. St. Paul, 1967 Plymouth station wagon - $3,195.00
less trade in of $675.00; tinted wind~gs - $23.00 extra
Bob Carter Ford, South St. Paul, Minn., 1967 Ford Ranch Wagon - $2,987.53
less trade in of $675.00; tinted windows $28.40 extra.
Upon motion duly made by Supervisor Klein, seconded by Chai~n Rahn it
was RESOLVED that the bid of Bob Carter Ford.be, and it hereby is, accepted
subject to meeting the proper specifications as provided by the township.

After discussion and upon motion duly mac'ia by Supervisor Klein, seconded
by Supervisor Schwanz it was RESOLVED that the Board of Supervisors be, and
it hereby is, on record declaring a moratorium on the consideration or
granting of filling station applications for rezoning or for building permits
in the township during which time the town officials will study a proposed
filling station ordinance.
Upon motion by Supervisor Schwanz, seconded by Chairman Rahn, it was
RESOLVED that a separate checking account be established at Valley National
Bank for proceeds from bond issues to be used for construction of improvements
and further that the town treasurer be authorized to invest the proceeds until
they are disbursed for improvements.
A letter was read from Suburban Engineering, Inc., 6875 Highway #65 N. E.,
Minneapolis, Minn. requesting that the Board adopt revised name changes in
Cedar Grove #5 because of conflict of names with other municipalities. Upon
motion by Supervisor Klein, seconded by Supervisor Schwanz, it was RESOLVED
that said name changes be, and they hereby ar.e, accepted namely: Ruby Road
to Beryl Road and Crystal Drive and Crystal Court to Cinnabar Drive and Cinnabal
Court; Pearl Lane to Pumice Lane and Pearl Court to Pumice Court. The town
attorney was directed to notify the proper. authorities concerning the name cha~
Upon motion by Supervisor Klein, seconded by Chairman Rahn it was RESOLVED
that the application of Herbert Sharpsteen, 1339 Woodhill Road, Burnsville,
Minnesota, for an off sale 3.2 beer license at Harold's Dairy Store be, and
it hereby is, approved.
The town engineer submitted a schedule of accepting bids on water and
sewer:
1. Central Water Trunk Part 1 - Improvement Project #6; advertise for
bids October 27. 1966, open bids, November 22, 1966 at 8:00 p. M.

Upon motion duly made by Chairman Rahn, seconded by Supervisor Schwanz,
it was RESOLVED that the pre1tminary plans for said Central Water Trunk Part 1~
be, and they hereby are, accepted and that the town clerk be, and she hereby
is, authorized to advertise for bids for said improvement.
2. Temporary Sewage Treatment Part 1, Improvement Project #5; advertise
for bids November 3, 1966, open bids December 15, 1966.
3. West Trunk Sanitary Sewer Part A, Improvement Project #4; advertise
for bids, November 3, 1966, open bids, November 29, 1966 at 8:00 p. M.
4. North Central Trunk Sanitary Sewer, Improvement Project 118; advertise
for bids November 10, 1966, open bids December 6, 1966.
Upon motion aU bills were ordered paid.
Upon motion the meeting adjourned.
