MINUTES OF A REGULAR ~1EETl:\G OF THE BOARD OF SUPERVISORS
EAGAN TOWNSHIP, DAKOTA COUNTY, MINNESOTA
November 15, 1966
A public hearing concerningthe:application of Charles J. Rueger to
rezone part of the NE 1/4 of Section 19-27-23 from A, Agricultural to R-6
Residential-Multiple was called to order at 7:00 P. M. Mr. Jean Parranto
and Mr. Charles Rueger appeared on behalf of the application. Certain
neighbors appeared including representatives of Mount Calvary Lutheran
Church exp~essing objection to the rezoning on the basis that there were
no specific proposals for the ultimate use of the property. Because of
error in the legal description included in the ~blic Notice, upon motion by
Supervisor Klein, seconded by Supervisor Schwanz it was RESOLVED that said
public hearing be, and it hereby is, continued to December 6, 1966 at
8:00 o'clock P. M.
The regular meeting commenced at 8:00 P. M.
All members were present.
Chairman Rahn presided. The minutes of the previous meeting were approved
as read.
Mr. Dean Longquist, 3165 Blackhawk Road appeared in response to a notice
on behalf of the Eagan Police Department relative to the lack of a building
penDit for the construction of a horse barn, 16' x 20' at the rear of his
property. The cost of tbe building was $207.00 for materials. The Board
determined that no penDit was necessary.
Mr. James Tousignant, 2009 Rudy's Drive, Burnsville, appeared requesting
a building permit for a residence on a 4 acre unplatted parcel on Cedar
Avenue near Nancy Circ Ie, $ 22,000.00, 26' x 52'. Upon moti.em by Supervisor
Klein, seconded by Supervisor Schwanz, it was RESOLVED that said building
permit application be, and it hereby ls, approved under the variance clause
of Ordinance #10 being less than a 5 acre parcel under the folloWing
stipulations:
(a) Subject to the acquisition of dedication of a 66 foot

right-of-way approximately 330' east from Cedar AVenu~. (b) That the
township will not accept such dedication for construction or maintenance

buildinp, permits for residential units will be granted for said 4 acre
parcel until the parcel is platted.
11r. James O'Neill appeared on behalf of the application of Rauenhorst
Corporation for a building permit for construction of a concrete block and
steel building for New HollaDd Machinery Company in part of Section 3-27-23.
It was noted the Advisory Planning Committee recommended approval. Upon
motion by Supervisor Klein, seconded by Chairman Rahn, it was RESOLVED that
said building permit application be, and it hereby is, approved, subject
however to the finished grading on the property being not lower than
approved site grading, drainage, and street plans to be submitted by the
applicant and approved by the t~Nn engineer.
The application of Barry-Howard Investment Company and Alonzo Hauser
to rezone from A. Agricultural to C-2, Heavy Commercial the West 1/2 of the
South 32 Acres of the West l/2 of the NW 1/4 of Section 1-27-23 fot use as
a shopping center was next submitted. It was noted that:the Advisory
Planning Committee recommended approval. Upon motion by Supervisor Klein,
seconded by Supervisor Schwanz, it was RESOLVED that a public hearing be
scheduled for December 6. 1966. at 7:30 P. M. to rezone said parcels together
with an 83.45 foot strip currently owned by Mr. Hauser running 577.42 feet
east of Highway #49.
The application of Barry-Howard Investment Company to rezone 11.6 acres
in Section 2-27-23 from A, Agricultural ~q C-2 Heavy Commercial, was presented.
The Advisory Planning Committee had r9C.~ep4ed approval. Upon motion by
Supervisor Klein, seconded by Supervisor Schwanz it was RESOLVED that a
public hearing to consider rezon1.ng of said parcel be, and it hereby is,
scheduled for 7:45 on December 6, 1966, subject, however, to submission of

Upon motion by Supervisor Schwanz, seconded by Supervisor Klein it
was RESOLVED that the Board of Supervisors be, and it hereby is, on record
denying the right of acquisition and granting the power to sell certain
tax forfeited land constituting part of Government Lot 1, formerly the
Warren Thompson property on Lone Oak Road and instructed the town attorney
to return the certificate to the County Board.
Upon motion by Supervisor Klein, seconded by Supervisor Schwanz it
was RESOLVED that a 11 streets in Cedar Grove ~j3 and #4 be, and they hereby
are, accepted for snow plowing purposes and further that the performance
bond be reduced in accordance with a letter to be prepared and submitted by
the tORR engineer.
Upon motion by Chairman RE.hn, seconded by Supervisor Schwanz it was
RESOLVED that the sum of $20.00 be, and it hereby is, approved as annual
dues for the Eagan Police Department in the International Associatlon of
Chief's of Police, Inc.
Mr. Lloyd Kuhrke, People's Natural Gas Company appeared relative to
the granting of a permit for utility purposes in Eagan Township. The question
of A t.ownship authority to grant utility franchises was discussed and the
tow~ attorney was instructed to submit an opinion relative to the right of
the township to grant utility franchises aDd further the..power of a village"
relative to thegranlSing of ~ll1ty franchues..

~le town engineer reported on his work relative to the location and
acqui~ition of land for the proposed temporary sewage ponds.
Upon motion by Chairman Rahn, seconded by Supervisor Schwanz, it was
RESOLVED that the lay member of the assessment committee be, and he hereby
is, authorized to be paid $5.00 per meeting.
Upon motion by Chairmen Rahn, seconded by Supervisor Schwanz it was
RESOLVED that all bills including a statement from the election judges be,
and they hereby are, ordered paid.
