MINUTES OF A REGULAR MEETING OF THE BOARD OF DIBECTORS OF
EAGAN TOl-1NSHIP, DAt<<>Tf. COUN1Y, MINNESOTA
September 19, 1967
A regular meeting of tqe Board of Supervisors, Eagan Township, Dakota
County, Minnesota l-laS held at the town hall at 7:00 o'cloct p. Me
at which all members were present. Chairman Klein presided.
The Chairman announced the commencement of the assessment hearing
covering water, sanitary sewer and storm sewer improvements in Eagandale
Industrial Center area. The Chairman read the notice of publication in the
newspaper. It was noted that no objections had bean submitted orally or in
t'1riting. Upon motion by Supervisor Schwanz, and seconded by Chairman Klein,
it was RESOLVED that said assessment roll be, and it hereby is, adopted a4~
that it be certified to the County Auditor.
At 7:30 P. H. the Chairman announced the opening of the Assessment
hearing concerning water, sanitary sewer, and storm sewer improvements in
the Univac Industrial area. No objections were received. Upon motion by
Supervisor Schwanz, seconded by Supervisor Rahn it was RESOLVED that said
roll be, and hereby is, adopted and certified to the County Auditor.
At 8:00 o'clock P. M. the Chairman announced the commencement of the
assessment hearing covering street improvements for Rahn Road Extension North
to Beau de Rue Drive. No objections were submitted. Upon motion by Chairman
Klein, seconded by Supervisor Rahn, it was RESOLVED that said assessment roll
be, and hereby is, adopted and that the clerk be authorized to certify the
roll to the County Auditor.
The regular meeting of the Board of Supervisors of Eagan Township commenced
at 8:15 P. M. at the town hall. All members were present.
The minutes of the previous meeting were approved as read with the follo\1ing
exceptions. Upon motion duly made and seconded, it wa$ RESOLVED that Albert
Perron and Richard Moss be hired as part time road workers for Eagan township

at $2.25 per hour.
The application of Wayne Winsor to rezone and approve a preliminary plat
were approved.
There were no building permit applications.
The Chairman then announced that the accounting firm of Johnson, West
and Co., Pioneer Building, St. Paul, had been hired to review the financial
statements of Cedar Grove Utilities Company relative to the proposed increase
in sewer service rates. The town attorney explained in the presence of numerOtlE
residents of the Cedar Grove area the developments to date. Mr. William Busch,
attorney, appeared on behalf of Cedar Grove Utilities Company. Upon motion
by Chairman Klein, seconded by Supervisor Rahn, it was RESOLVED that a review
of the proposed sewer rate increase be referred to the town attorney and town
accountant to make further stud~. and that the matter be continued to a
Special Board meeting on September 26, 1967, at 8:00 o'clock P. M. at the
tOl'lD hall relative to the reasonablness of the rate increase and whether further
action should be taken at thet point.
Upon motion by Supervisor Rahn, seconded by Supervisor Schtl1anz it was
RESOLVED that the application of Harvey Kirchner to rezone 12.5 acres at Dodd
Road and County Road #30 in Section 25 from A, Agricultural to R~l, Residential
be scheduled for public hearing on October 17, 1967 at 7:30 p. M. at the to:~1
ha 11.
The application of Metal Buildings Construction Company for building per.Mit
to move an existing building off the premises of Northern Propane Gas Company
and construction of a net'1 cylinder dock near Beau de Rue Drive was next
presented. Upon motion by Supervisor Rahn, seconded by Chairman Klein, it was
RESOLVED that said application be, and hereby is, approved for a new cylinder
dock 40' x 60' X 10', $5,600.00 subject to engineer's approval of plans and
specifications be, and hereby is, approved.

An appraisal from Mr. Edward Kuntz, 143 Concord Street, South St. Paul,
appraiser, cOvering the proposed water well site property owned by Dr. Hay on
Yankee Doodle Road 'JUlS presented. It was noted that the appraisal covered 15
acres at the price of $1,500.QQ per acre. It was resolved that negotiations
be entered into for the purchase of 20 acres at that site for $1,500.00 per
acre a nd that an easement be acquired along with property directly east of
the well site property for road purpose~ and subject further to submission of
a legal land survey by the seller. An appraisal from Mr. Kuntz for 20 acres
in the Cedar Industrial P,ark area was also submitted. The appraised value
per acre was $2,700.00. Upon motion made and seconded it trlaS RESOLVED that the
township negotiate for the purchase of said 20 acres and report the findings
to the Board.
The Board discussed the rec~mmendation of the Planning Committee that no
changes be made to ordinance #6 concerning zoning relative to open space and
screening. The Board requested the town attorney to do more research into
the matter.
The town attorney and town engineer reported relative to their negotiations
with Mr. Theodore Kaysen, Jr. concerning the reconstruction of Blackhawk Road
near Highway #13. After discussion and upon motion by Chairman Klein, seco!IDed
by Supervisor Rahn it waS RESOLVED that the A. D. Strong Company, l1idland
Bank Building, Minneapolis, be engaged to appraise the property anj if Mr.
Kaysen agrees to accept the appraisal as submitted, the Board of Superviscr2
will also accept such appraisal. In the event that this agreement is not
reached the Town Attorney is then authorized to commence condemnation proceed~.l1f
for the road right of way and slopage.
Upon motion by Chairman Klein, seconded by Supervisor Rahn, it l'laS RESOLV)1:j:

that the town be authorized to acqutre 300' of 2\11 fire hose to be charged to
the sewer and water department. . The town attorney 't-78S further requested to
revise the water and sewer ordinance to delete the check valve requirement.
upcn motion by Chairman Klein, seconded by Supervisor Sch~-1anz, ii: was
RESOLVED that a proposed agreement between the Town of Eagan and the Wenzel
Plumbing and Heating Company to install water meters in the Timberline
Addition in the amount of $28.00 per installation be, and hereby is, approved
subject to performance bonds and insurance requirements.
The application of Roger Sterns, 3875 Dodd Road for a garage permit was
upon motion by Chairman Klein, seconded by Supervisor Rahn, approved and the
clerk ordered to execute the permit.
Mr. Matthew Hope appeared requesting the right to place a trailer house
on his property while constructh.g a home in Clearview Addition. Upon motion
by Chairman Klein, seconded by Supervisor Rahn, it was RESOLVED that a trailer
permit be issued to Mr. Hope which permit shall be issued at the time that a
buildt~ permit is issued by the township.
Upon moti.on by Chairman Klein, seconded by Supervisor Rahn it ''las RESOLVIlli
that the full time town employees be granted 8 paid holidays during the cou~se
of each year. It was FURTHER RESOLVED thbt the clerk be authorized to pay
salaries for all town employees on the first and fifteenth of each month but
to submit supporting hours to the Board of Supervisors.
Upon motion the bills were ordered paid.
Upon motion the meeting adjourned.

The Clerk presented an affidavit showing publication of Notice of Hearillg
on the proposed assessments for Eagandale Industrial Center Water, Sanitary
Sewer and Storm Sewer Improvements - 1967
in the official newspaper in accordance with's resolution heretofore adopted
by the Board of Supervisors, which affidavit was examined, found satisfactory,
and ordered plac~d on file.
The Chai.man flunounced that the meeting was opell for the consideration
of objections, if any, to said proposed assessments. All persons were then
given an opportunity to present oral objections, and all written objections
theretofore filed with the clerk were presented and considered, and all such
objections were tabulated as follows:

Supervisor Schwanz then introduced the following resolution and moved its

Center Water, Sanitary Sewer & Storm Sewer Improvements - 1967
BE IT RESOLVED by the Board of Supervisors of Eagan Township, Dakota County,
Minnesota, as follows:
(1) The clerk, with the assistance of a qualified person heretofore
selected by the Board of Supervisors has calculated the amount proper and
necessary to be specially assessed for Eagandale Industrial Center Water,
Sanitary Sewer and Storm Sewer Improvements - 1967
against every assessable lot, piece or parcel of land affected thereby upon the
basis of benefits, without regard to cash valuation, in accordance with the
provisions of Minnesota Statutes Annotated, Section 429, and notice has been
duly published and mailed, as required by law, that this Board would meet to
hear and pass upon all objections, if any, and to amend said proposed assesoment~
as might be necessary, and said proposed assessment roll h3S at all times
since its filing been open for public inspection, and an opportunity has been
given to all interested persons to present their objections, if any, to such

(2) This Board, having heard and considered all objections so presented,
and being fully advised in the premises, finds that each of the lots, pieces
and parcels of land enumerated in the proposed assessment roll ~.~~~~)*x
was and is specially benefitted by the construction of said improvement in
not less than the amount of the assessment set opposite the description of
each such lot, piece and parcel of land, respectively, and that such amount

parcels of land therein described.
(3) The proposed assessment roll ~.XBBeB484)* is hereby adopted and
confirmed as the proper special assessment for each of said lots, pieces and
parcels of land respectively, and the assessment against each parcel, together
with interest at the rate of 6 % per annum accruing on the full amount thereof
from time to time unpaid shall be a lieD concurrent with general taxes upon
such parcel and all thereof. The total amount of each such assessment shall
be payable in equal annual installments extending over a period of 20 years,
the first of said installments, together with interest on the entire assessment
from the date hereof to December 31, 1968, to be payable with the general
taxes collectable during the year 1968, and one of each of the remaining
installments, together with one year's interest on that and all other unpaid
installments, to be payable with general taxes for each consecutive year
thereafter until the entire assessment is paid.
(4) Prior to certification of the assessment roll to the County Auditor.
the owner of any lot, piece or parcel of land assessed hereby ~y at any time
pay the whole of such assessment with interest accrued to the date of payment
to the Treasurer of the Town.

(5) The Clerk, shall. as soon as may be, prepare and transmit to the County
Auditor a certified duplicate of the assessment roll. with each then unpaid
installment and interest set forth separately, to be extended upon the proper
tax lists of the County, and the County Auditor shall thereafter collect said
assessments in the manner provided by law.
(6) The proposed assessments heretofore made in respect of the tmprovement
shall be and are hereby amended so 88 to read as shown below, and the clerk is
authorized and directed to indicate the said amendments on the face of said
assessment roll.
