MINUTES OF A REGULAR MEETING OF THE BOP.Bl) OF SUPERVISORS

A regular meeting of the Board of Supervisors of Eagan Township,

Dakota County, Minnesota, was held oq OctoberS, 1967 at 8:00 o'clock P. M.
at the town hall at which all members were present. The mtDutes of the
previous meetings "'ere approved as mailed.
The building penDit application for Richter, Inc., 3339 TenDinal
Drive, for a garage building permit, 300 sq. feet, 50' x 60', $12,000 made
of painted structural steel was presented. Upon motion by Chairman Klein,
seconded by Supervisor Schwanz it was RESOLVm that said application be, and
hereby is, approved, subject however to final engineer's approval.
The fire chief and assistant fire chief of the Eagan Volunteer Fire
Department appeared relative to certain activities of the Eagan Fire
Department including the follOWing: It was indicated that additional hose
and other equipment were needed by the fire department. The fire department
requested that a mutual aid agreement with Mendota Heights be entered into;
that a proposed automatic fire alert telephone system be installed and
further the fire department requested a joint meeting with the town board to
discuss a proposed 3 year plan in the fire department.
The town attorney presented a proposed purchase agreement covering a
20 acre well site on Yankee Doodle Road to he purchased from Dr. Lyle Hay
consisting of a 500' width and approximately 1,700' depth at $1,500 per
acre. Upon motion by Supervisor Rahn, seconded by Supervisor Schwanz, it
was RESOLVm that the purchase agreement be, and hereby is, authorized to
be executed for the purchase of said site.

The town attorney presented the following ordinance amendments:
Amendment to Ordinance 413; Amendment to Ordinance #13 and Amendment to
Ordinance #20. Upon motion by Chairman Klein, seconded by Supervisor Rahn
the foregoing ordinances amendments be, and hereby are, adopted and the
clerk ordered to publish in the Dakota County Tribune.
The Board reviewed the sewer trunk line easements south of Highway #55
aequired to date and those that hed not been completed. It was noted
that the easements over the Kirchner property, the Milwaukee Land Ccmpany
property now owned by Rauenhorst Development Corporation; the Veronica
MacLean property, the J. t. Case property, and the railroad crossings have
not yet been acquired.
Upon motion by Chairman Klein, seconded by Supervisor Schwanz it was
RESOLvm that the bid of Phelps-Drake Company for sewer and water extension,
Improvement Project #15, part B, in the sum of $215,845.40 be, and hereby
is approved and at-1arded.
Mr. D'Arcy Cole of 2985 Lexington Avenue Appeared relative to his
8'6Wer assessment covering 328' of frontage on the West side of Lexington
Avenue. Mr. Cole had indicated that be desired to be connected to the sanitary
sewer system but in effect that his parcel had two homes on Lexington
Avenue and that one additional parcel for home construction could be used.
After review and upon motion by Supervisor Rahn, seconded by C. Klein it
was RESOLVED that the sanitary sewer lateral assessment against the D'Arcy
Cole property along Lexington Avenue be assessed for 109' in front of his
homestead which would total about $660.00 based upon one third of the total
frontage of 328 feet.
The Board also discussed the easement that waS proposed to be acquired
from Vincent Kennedy on Blackhawk Road. Chairman., Klein indicated that he
would contact Mr. Kennedy concerning the easement.

Discussion was had concern1~ the easement proposed to be acquired from
Mrs. Veronica MacLean along Highway #55 which included a 11ft station easement
50' in width. It was noted that part of the lift station would be extruding
out ot the ground and for this reason there may be justification for an
additional credit beyond the normal $2,000.00 per net acre credit for.'

Upon motion made by Supervisor Rahn. oeconded by Supervis(Jr Schwanz it
wa~ RESOLVED that the tQWn attorney be authorized to negotiate with
Mrs. MacLean on the basi~ ~f a credit for sanitary sewer trunk assessment in
the approximate sum of $2,224.25 which is about $650 above the normal credit

Di$cus~ion was also had concer~~~, the trunk sewer assessment on 30.67
acre parcel owned by William OINe!l!. OD Highway #49 as parcel #3521-A. It
was noted that the description of the parcel went to the centerline of
Highway #49, a State highway. Mr. O'Neill was requested to determine the
number of square feet in the state hi,hway right of way which under the praceic..
of the Eagan Board is not included in the sanitary sewer trunk assessment.
Mr. Jean Parranto presented the final plat of Cedar Industrial Park
covering Blocks 1, 2, and 3 with a total of 11 lots. Upon tIlQtion by Chairman

Upon motion all bills were ordered paid.
