II (. .; , , the bids WE!ra referred to tlt.:: tOW,l engineer for tabulation whereupon. the tv\'Jl1 engineer reported baclt that the low bid was from Champion Truck Center of St. Paul in the sum of $2,708.82 plus accessories briQ8ing the total price to $2,957.34. Upon motion duly made by Supervisor Schwanz, secondP-d by SuperviaOr Rahn, it was RESOLVED that the township purchase said pick-up truck with accessories from Champion Truck Center, St. Paul. The reading of the minutes of the previous meeting was unanimously waived alld, upon motion by Chairman Klein, seconded by Supervisor Rahn, rhe'L minutes were approved as presented. The application of Rauenhorst Development Corporation to rezone certain acreage in Section 11-27"23 South of Lone Oak Road from A, Agricultural to I-I, Light Industrial was presented. The Board was informed that the applicant had requested the removal of the two Rahn farm properties from the application for the reason that purchase arrangements had not been cons~ted. The Advisory Planning Committee recommended approval. Upon .. 1 .. motion duly made by Chairman Klein and secon1ed by Supervisor Schwanzt it was RESOLVED that a public hearing be set for December 19, 1967, at 7:30 P. M. for the purpose of rezoning that portion of the property described in the application less the two Rahn properties. The application of ROdney Effress and Alphy LeMay to rezone approxi~Ately 78 acres from At Agricult~ral to R-lt Residential, R-6 Residential and C,,2 Heavy Commercial for an apartment complex and shopping area on Highw8j 1f31 was presented. It was noted that the Advisory Planning Committee recom.. mended approval. Upon motion duly made by Supervisor Schwanz and seconded by Chairman Klein, it was RESOLVED that the matter be re-referred to the Planning Co:nmittee at their December 11, 1967, meeting for further consider.., stion due to appearances in opposition to the application on the ground that all the facts had not been presented to the Planning Committee before it made its recommendatiou. The application of Rodney Effress and Herbert Polzin to rezone certain property in Section 2-27-23 frOM A, Agricultural to I-It Light Industrial near Hight-lays #49 and 4155 was presented. It was noted that the Planning Committee recommended approval. The application of H~~bert and Salome Wells to rezone certain property i!:'. the SW Quadrant of Highway #30 and the proposed I-35E from A, Agric1.11tm:u~ to C..I, Light Commercial and for a special use permit to construct a filling station thereon was presented. It was noted that the Planning Committee rec01!lD1An.ded approva 1. Upon motion duly mad e by Supervisor Rahn and seconded by Supervisor Schwanz, it was RESOLVED that a public hearing be had on the application on December 19, 1967, at 8:15 P. M. The application of Wesley Schmidt to rezone certain property on Lexington Avenue from A, Aericultural to R-l Residential and for preliminary plat approval of W. Schmidt Addition was presented. It was noted that the Planning Committee recommended approval. Upon motion duly made by S~perv1sor Schwanz and secouded by Supervisor Rahn it was RESOLVED that a public hf'...H~i'!Jt; be held on the application for rezoning and preliminary plat approval at 8:30 P. M. on December 19, 1967. The review of the proposed mutual fire aid agreement with Mandota Hei3hts was tabled until the December 5, 1967 Board meeting. the prelimir~ry plat of the Harvey Kirchner Addition was presented. It waR noted that the Planning Committee had approved the zoning of the prop<')~ed plat but had not given preliminary plat approval. Upon motion dul;T made by Chairman Klein and seconded by Supervisor Rahn, it was RESOLVED that th2 ~reliminary plat as presented be, and hereby is, duly approved subject to proper street grades and approval by the town engineer; and FURTHER RESCLV~I that a public hearing on the preliminary plat be had on December 19, 1967 at 8:45 P. M. - 3 - Mr. N. C. Waldor appeared with regard to the extension of utilities in the Sibley Inaustrial Terminal Park. Upon motion duly made by Supervisor Rahn and seconded by Supervisor Schwanz, it was RESOLVED to direct a change order in Project #lSB in order to extend sewer and water service to the North area of Lot 1, Block I, Sibley Industrial Terminal Park, and the tO~7n engineer was directed to effect such change order immediately. ~~. Everett Davies appeared resarding a law suit against McWilliams Construction Company which is engaged in a utility project for Eagan Township and also a garnishment levied against the township for funds that are remaining to be paid to McWilliams. Mr. Davies requested that the township pay over to:.him monies owed to him for insurance premiums which Chairman Klein, upon advice of the town attorney and town engineer, declined to do. There was no formal action taken by the Board. roe matter of the Sparkman dumping problem was called to the attention of the Board relative to burning out the stumps and trash under the auspices of the Eagan Fire Department. It was informally noted that no burning shoul1 take placa until after the first snow fall and then only under the contrc.l and direction of the Eagan Fire Department. Upon motion duly made by Chairman Klein and seconded by Supervisor Rahn, i~ WdS RESOLVED that the application for building permit be, and tne same hereby is, duly approved subject to the submission of the proper ';' application and plans and specifications to the town engineer within one week from date.. ..: . The matter concerning permits for Northern States Power to extend gas utilities into the Rauenhorst area was brought to the attention of the Board. The town attorney advised the Board that no franchise agreement had as yet been reached with NSP Company. The town attorney wes thereupon directed to contact Mr. Eklund of NSP in oDder to try to resolve the franchise problem and spheres of influence as to gas utilities before grant- ing any formal permission for NSP to extend its lines in Eagan Township. The town attorney reported to the Board that Dr. Lyle Hay had not been paid under the purchase agreement which was to have been closed on November I, 1967, for property for water site. Upon motion duly made by Supervisor Schwanz and seconded by Supervisor Rahn, it was RESOLVED that the $28,500 balance on the purchase price be, and hereby is, duly authorized and ordered paid immediately. Discusssion was had regarding compensation of Chairman Klein as the Chairman of the B-E-B Committee. The Board directed the town attorney to render a legal opinion as to. the ability of the township to pay Mr. Klein for contemplated services to the joint sewage treament committee. Upon motion duly made by Supervisor Schwanz and seconded by Supervisor Rahn, it was RESOLVED that the township purchase a snow plow for the smail tractor unit at a cost of $300. plus $150. for attachment. Upon motion by Chairman Klein, seconded by Supervisor Schwanz, it was RESOLVED that available funds will be used to meet Bny additional bond retirement payments for 1968 and no further budget request will be needed. TIle clerk was authorized to order insurance for the pump house and equipment. Upon motion all bills were approved as presented and paid. Upon motion, the meeting adjourned.
