At 7:00 r.M. the Chairm.an announced the opening of a revised hearing con-
cerning Trunk 0ewer Project #35 consisting of storm sewer improvements in the
Rahn Road an.' County Road fl30 ar0$3. It was noted that publication of the first
hearing waR incomplete. The town engineer made the presentation and upon motion
by Uselmann, seconded by Klein, aye Rahn it was RESOLVED that said project be
ordered covering Part A, Sections 1 and 2, pursuant to the engineer's preliminary
report covering storm sewer trunk facilities ben1een Carnelip-n and Pumice Lane
to Jade Lane and Rahn Road end from RRhn Road to Jade Lane to County Road #30.
Mr~ J~!l1eS Olsen, the fiscal cor.&~ltant, then made a presentation concerning
p~~posed 5-Ye~r Fire Fighting Equiptment Certificates covering the purchase
of new fire equiptment. Upon motion by Klein, seconded by Rehn, aye Uselmann,
:It T~as RESOLVED that in light of the current interest sitnntion and the small
size of the issue that the Town sell $41,000.00 of 5-Year Fire Fighting Eqoiptment
Cert1ficat~s at a net interest rate of 6.05 to Juran and Moody pursuant to the
resolution to be submitted to the Board.
Upon motion by Klein, seconded by Uselmann, aye Rahn it was RESOLVED that a
hearing on the preliminary report for Project #38 for Silver Belle Road Improve-
ments from Highway #13 to Blackhawl Road be scheduled for July 1, 1969 at 8:00 P.~
at the Tcn-m Hall.

pbt for Lexington Addition. The architect of tbe project appeared on behalf of
the applicant. Mr. Robert J. O'Neill, an adjacent property cn-mer. appeared e.~d

The Chairma~ then announ~ecl the opening of the public hearing cunceLning
the proposed change order to ProjE~t #28 for water service in the Raymer Hardware
area on Lexington ~venue. Tea engineer presented the proposal end upon lli~tio~
by Uselmann, 3f-.conded by Rahn, aye Klein it was RESOLVED that said project be
ordered as B Cl!Clnge order to Project #28 at the same unit .osts. It was noted
that no objections were made to th0 proposal.
The ~inutes of the ~y 28, 1~59 meeting were upon motion by Klein, seconded
by Rahn, aye UseLmann approved withth~ exception that on page 5 that the date be
changed from June 13th to June Jrd relative to the Project #3J hearing. And
further that on page 4, in regard t/J ::-:<' Larry Milliman matter that a resolution
was passed upon motion by Klein, seconded by R2hn, to with-held building permita..
from Mr. Nilliman until he compUGUfully with the building ordinances.
Upon motion ~ade and seconde. the minutes of the Special Meeting of the Board
01 Supervisors of May 27, 1969 were approved as presented.
Upon motion by Use1mann, seconded by Rahn it was RESOLVED that the Board
instruct the town attorney to write to the ~linnesota Municipal Commission notifying
them of the action taken by the Board of approving the Incorporation Bill and
indicating the Eagan Board's desire that the 11unicipal Commission fake no action
in the form of any hearings until next fall.
Donslu Bohn requested 8 building permit for a garage with a variance of 1\
feet fr~ the 5 foot side yard requirement at 3990 M~ca Trail. Upon motion by
Rahn, 8ecol~ed by Uselmann it was RESOLVED that the appiication be approved.
Fire Chief Schultz appeared on behalf of the Fire Department indicating that
Qn open house would be held on June 21, 1969 at the new Fire Hall.
The application of Wayne R. Winsor for preliminary plat approval for Blackhawk
Hill. Addition in Government Lot. 2 and 3 in Section 16 was next prese~tnd.

The application of Steenberg Construcdon Company for building permit for
U. S. Pl}vood warehouse on Lots 21, 22, 23 and the Northeast half of Lot 20,
Block 5, Eagandale Center Industrial Park was next presented. It was noted that
the APC recommended approval. The building would consist of 74,000 square feet
being 240 ft. x 300 ft., $550,000.00. Upon motion by Klein, seconded by Rahn,
aye Usel~ann it was RESOLVED that the application be granted.
The town engineer read 8 letter from Inver Grove Heights requesting sewer and
w~ter service in a portion of Section 18 of Inver Grove Heights adjacent to and

The Board then discussed the application of FotOlU:,it for a Fotonmt store i.n
Cedarvale Shopping Center. It waS not~d that the applicant had not reappearec
requesting approVal nor had it submitl~d any further informu~ion concerning traffic
patterns, etc. Aft~r discussion. upon motion by Kle:f.n. seconded by Rehn, aye
lTae1.mann it ,qas RESOt.VED that because of the lack of response and the inapproprbte'
..ess discussed at an earlier meeting of the location of the Fotomat store in CEdSJ"='~
vale Shopping Center. both aesthetically and for safety factors acd traffic view
points amongst others. that said application be denied.
Chairman Klein then announced that he had been served with a notice of w~etin~
of Mayors of the 8 municipalities in the 3rd Commissioner District that n meeting
would be held on June 5, 1969 at the Dakota County Courthouse to fill <i V<1cancy
on the Dakota County Board. the notice had been served by the County Sheriff and
signed by the County Auditor. The Chairman also read a letter fro$ the Attorney
General, dated June 2, 1969 concerning the appointnGllt of a Town Board Chairman
to fill the vacancy. Hr. Klein iDdicatee! his interest in being 8 candidate for thf'
vacancy. Mr. Klein then notified tbe Board that he wal resigniag al Chairman of
tbe Eagan Town Board. but not .. a -.her of the Board of Supervllorl. aDd would

then qualify a8 a candidate for County CoDlllissioner. Upon motion by Rahn,
seconded by Uselmann it waG r.Ef,OLVED that said resignation be accepted and upon
vote by the members of the Board of Sil\;>ervisors, Ar':hur Rahn was elected Chairman
of the Eagan Board and was appointed a delegate to the J~l~ 5, 1969 meeting to
fill the vacancy on the County D~~~d.
Upon motion all bills were ordered paid.

points aMOngst others, that said application be denied.
Chairman Klein then announced that he had been served with A r.1tice of meet1~g
of Mayors of the 8 municipalities in the 3rd Oommdssioner District that D meeting
would be he1e! on June 5, 1969 at the Dakota County Courthouse to fiU a vacancy
on the Dakota County Board. the notice had been served by the COQnty Sheriff and
signed by the County Auditor. The Chairman also read a letter !~~ the Attorney
General, dated June 2, 1969 concerning the appointttellt of a Town Board Chairman
to fill the vacancy. Mr. Klein indicated his interest in being a candidate for the
vacancy. Mr. Klein then notified the Board that he was resigning a8 Chairman of
the Eagan Town Board. but not .s a member of the Board of Supervisors. and would
then qualify a8 a candidate for County Comadssioner. Upon motion by Rahn,
seconded by Uselmann it was RESOLVED that said resignation be accepted and upon
vote by the members of the Board of 3uperv:lsors, Ar';hur Rahn waS electp.d Chairman
of the Eagan Board and was appointed a delegate to the June 5, 1969 meetiD6 to
fill the vacancy on the County nQa~d.
Upon motion all bills were ordered paid.
