09/15/1969 - City Council Regular EXTRACT OF MINUTES OF MEETING OF THE BOARD OF SUPERVISORS EAGAN TOtINSHIP, DAKOTA COUNTY, MINNESOTA HEII) ON September 15 lg 69 Pursuant to due call and notice thereof, a special meeting of the Board of Supervisors of Eagan Township, Dakota County, Minnesota was duly held at the town hall in said municipality on the 15thday of September , 1969 at 7:30 o'clock P. M. The following members were present: John Klein and Paul Uselmann, Jr.' and the following were absent: Arthur Rahn The Clerk presented an affidavit showing publication of Notice of Hearing on the proposed assessments for water improvements to the Airliner Motel in Kolofski's Addition in Section 2, T27N, R23W of Eagan Township. in the official newspaper in accordance with a resolution heretofore adopted by the Board of Supervisors, which affidavit was examined, found satisfactory, and ordered placed on file. The Chairman announced that the meeting was open for the consideration of objections, if any, to said proposed assessments. All persons were then given an opportunity to present oral objections, and all written objections theretofore filed with the clerk were presented and considered, and all such objections were tabulated as follows: NAME PROPERTY NATURE OF OBJECTION No Objection - 1 - Supervisor Klein then introduced the following resolution and moved its adoption: RESOLUTION E.D©PTING AND CONFIRMING ASSESSMENTS FOR WATER IMPROVEMENTS BE IT RESOLVED by the Board of Supervisors of Eagan Township, Dakota CountS~. Minnesota, as follows: (1) The clerk, with the assistance of a qualified person heretofore selected by the Board of Supervisors has calculated the amount proper and necessary to be specially assessed for water improvements to the Airliner Motel in Kolofski's Addition in Section 2, T27N, R23W of Eagan Township against every assessable lot, piece or parcel of land affected thereby upon the basis of benefits, without regard to cash valuation, in accordance with the provisions of Minnesota Statutes Annotated, Section 429, and notice has been duly published and mailed, as required by law, that this Board would meet to hear and pass upon all objections, if aay, and to amend said proposed assessment. as might be necessary, and said proposed assessment roll has at all times since its filing been open for public inspection, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessments (2) This Board, having heard and considered all objections so presented, and being fully advised in the premises, finds that each of the lots, pieces and parcels of land enumerated in the proposed assessment roll (~~)* ~,ras and is specially benefitted by the construction of said improvement in not less than the amount of the assessment set opposite the description of each such lot, piece and parcel of land, respectively, and that such amount so set out is hereby levied against each of the respective lots,pieces, and parcels of land therein described. (3) The proposed assessment roll (,Tt7~X~* is hereby adopted and confirmed as the proper special assessment for each of said lots, pieces and parcels of land respectively, and the assessment against each parcel, together with interest at the rate of 8 °/a per annum accruing on the full amount thereof from time to time unpaid shall be a lien concurrent with general taxes upon such parcel and all thereof. The total amount of each such assessment shall be payable in equal annual installments extending over a period of 20 years, the first of said installments, together with interest on the entire assessment from the date hereof to December 31, 19 6~ to be payable with the general taxes collectable during the year 1970, and one of each of the remaining installments, together with one year's interest on that and all other unpaid installments, to be payable with general taxes for each consecutive year thereafter until the entire assessment is paid. (4) Prior to certification of the assessment roll to the County Auditor, the owner of any lot, piece or parcel of land assessed hereby may at any time pay the whole of such assessment with interest accrued to the date of payment to the Treasurer of the Town. * Strike the matter in parentheses if assessment roll was not amended. 2 (5) The Clerk, shall, as soon as may be, prepare and transmit to the County Auditor a certified duplicate of the assessment roll, with each then unpaid installment and interest set forth separately, to be extended upon the proper tax lists of the County, and the County Auditor shall thereafter collect said assessments in the manner provided by law. (6) The proposed assessments heretofore made in respect of the improvement shall be and are hereby amended so as to read as shown below, and the cleric is authorized and directed to indicate the said amendments on the face of said assessment roll. Clerk - 3 - MINUTES EAGAN TO'~JNSHIP, DAKOTA COUNTY, MII~TNESOTA September 15, 1969 A Public Hearing concerning the Sanitary Sewer Assessments in all Section 10, 11, 12, 8c 16, the North 2 of Section 29, all of Section 20 lying East of Blackhawk Road and that portion of Section 17 lying South of Kylo Lane and East of Blackhawk Road was convened at the Town Hall at 7:30 P.M. on September 15, 1969. All members were present except Supervisor Rahn. Chairman Klein presided. Mr. Rosene explained the assessment which will be X125 per platted lot and ~p225 per net acre. Questions were as follows: H. J. Bruestle, Pilot Knob Rd.: I do not want to pay for the lift stations that are required on tYie other end of the Town. Rosene: The overall trunk costs are spread over all the area. H. Bruestle: What about Federal Aid on this project? Klein: We have been denied aid on this. Paul Dehler, Pilot Knob Rd.: What do we do to connect to sewer? Rosene: You will have to petition, and then pay a front footage charge. Don Grant: Isn't it possible another trunk will have to be installed in our area? Rosene: Possible, but you will get only one assessment for sewer trunk. R. Heimke, Wren Lane: what happened to our petition for sewer and water to Harvey Addition? Rosene: We are preparing a study. Joe Roberts: 'rlhat is the rate of interest? Rosene: 8~ over 25 years. Don Grant: What was the bond interest on this? Klein: 6.97io J. Truesdale: How long will it be before we have the services on Highway 55? Rosene: Next year. Louis Englert: Can yTou build on a sewer easement? Rosene: No. You can build on either side but not on it. D. Griep: Who is going to benefit from this except industry? Klein: The whole Town will. Joe Kellner: Who makes a determination when laterals go in as far as health pro- blems: Klein: The Board. Don Chapdelaine: What provision is made for wetlands? Rosene: There is a 20~ reduction for streets, etc. and if an easement is page 2 September 15, 1969 granted for ponding purposes then there will be no assessment on that land. Harry Ray: How will Green Acres affect this? Klein: Don't know at this time. There being no further questions, upon motion the hearing was declared closed. The Chairman next announced the Public Hearing concerning the sewer, water and street assessments in Valley View Plateau 1 and 2. Mr. Rosene explained the assessment which will be X2510 per lot over 20 years at 6% interest. He stated this was a 15.9;$ increase over the estimate. Wm. Dougherty: The streets look good but curbing isn't what it was. Rosene: Retained the old curb and hand shaped it. We could have put in machine laid curb but it would have been an additional X125 per lot. A letter from Fred Post objecting to his assessment was placed on file. Mr. Rosene explained the pressure in the lines and the eventual looping of the water system. There being no further questions, the hearing was declared closed. The Chairman next announced the Public Hearing concerning water main extension to serve the Airliner !~~otel. A'Lr. Rosene explained the assessment which will be ~~+115 for 20 years at 8,~ interest. Mr. Lal~ioria was not present. There being no questions, the hearing was declared closed. The Chairman announced the Public Hearing on the proposed street assess- ment on Rahn Road. Mr. Rosene stated this was figured at $5.50 per foot to be spread over 10 years at 8,~. Larry Holsapple, x+301 Rahn Road: Before project started, I had one level on my drive ,,nd now I have two levels. It looks like the end of my drive will be a catch basin. Mr. Rosene: We will check on this. Larry Trustree, ~+3~+7 Rahn Road: Water ponds in my drive and there is quite a drop at entrance. Asphalt is poor and starting to crack. They put only dirt under drive and no fill. Rosene: This will be checked. There being no further questions, the hearing was declared closed. The Chairman a^nounced the Public Hearing on the proposed street assess- ment on Eagandale 2 streets and storm sewer. Mr. Rosene stated this was figures at X13.50 per foot and will be spread over 15 years at 8,~ interest. page 3 Seetember 15, 1969 No property owners were present and there were no objections. The hearing was declared closed. Upon motion of Chairman Klein, second of Supervisor Uselmann, it was RESOLVED that the assessment rolls as presented be accepted with a determina- tion to be made on the Fred Post property at the next Board meeting.
