A RE'"JLAR ME TYNG OF TI'S BOARD OF StTPERVISORS TGWN CF EACAPd, DAi'.OTA COUNTY, MTNM'ESOTA iovember 4, 1969 A regular meeting of the Board of Supervisors of the Town of Eagan, Dakota County, Minnesota was held on November 4, 19b9 at the Town Hall at ~:00 o'clock P„M, at which alI members were present. Chairman Klein presided, and the minutes of the previous meeting of the Board of Supervisors was unanimously approved as presented. There was no Fire Department ar Utility Department business. Police Chief DesLauriers introduced Mr. Pat Geagan of 3919 Mica Trail and recommended that he be hired for part-time police duty immediately. Upon motion duly made by Rahn, seconded by Uselmann, it was RE50LVED that Mr. Geagan be, and he hereby is, hired and employed as a part-time police officer with the Eagan Police Department. Mx. Leonard Perron appeared on behalf of his application for a residental building permit. Upon motion duly made by Chairman Klein, seconded by Uselmann, the matter was refeured to the Town Engineer and the Town Attorneys because of technical zoning and legal problems involved in granting the permit as applfed for. Mrs. ~. Zeule appeared on behalf of her application fsr a building permit to construct a garage, 24' x 24' at an estimated cost of $2,300.00,. It was noted by the Roard that no house existed on the pregerty i. question but rather a trailer under tedopsrary permit. There was no raoti4n to grant the permit and same failed for any formal actin, Chairman Klein then convened the hearing on xmpravement Project #42 foz extension of water main to the B»E+B plant site in the Cedar Industrial Park area. Mr. .Tenn Parrrtnto appeared in oposition thereto. Upon motion duly made by Rahn, seconded by Uselmann, aye Klein, it was RESOLVED that MlM Improvement Project ~iE42 be, and the samF hereby is, approved and the Project ordered pursuant to the Engineer's Preliminary Report and further that the $ngineer prepare plans and specifications, Chairman Klein then convened the public hearing on Project ~4$ consisting of street improvements in Eagandale No. 3, consisting of gravel base at an estimated cost of $36,040.00 with a front foot assessment on all beneficed property to be in the sum of an estimated $2.40. Upon motion made by Klein, seconded by Rahn, aye Uselmann, it was RESOLVED that said project be, and the same hereby is, duly approved and ordered in, Chairman Klein next called for the opening of bids for the purchase of a dump truck and snow plow and apparatus. Upon motion duly made by Klein, seconded by Uselmann, it was RESOLVED Co refer the bids for tabulation to the Town Engineer as follows: Bob Cartar Ford $11,842.50. T''^ '"~-•^ '~-~`~- _L subsequently having reported back with the bids tabuk~ed, upon motion duly made and seconded it was RESOLVED that the low bid in the sum of $11,842.50 submitted by Bvb Cortez Ford of South St. Paul, Minnesota, be and the same hereby is, approved and accepted. The continued hearing on the application of Carl Qlson to rezone certain acreage in Section 10, South of LeMay Lake was stricken for lack of appearance, subject to reinstatement on the agenda of the Advisory Planning Committee in November upon the request of the applicant. Mr. Jim McShane, engineez, appeared on behalf of the application of Rauenhorst Development Corp. for a building permit to construct a 15,82 square foot building at as estimated cast of $150,000 for Hehenstein Delivery ~2~ Company on Lots 6. 7. 8 and 9, Block 3, Eagandale No. 3. Upon motion duly made by Rahn and seconded by Uselmann, Chairman Klein abstained from voting with reservations as to the aesthetics of the layout ark the proposed over- all operation, it was RESOLVED that the building permit be, and the same hereby is duly approved and the building permit ordered and granted subject to the submission and approval of an appropriate site plan, Mr. Jim Kelly appeared on behalf of the application of Bachman's Inc, for a refrigerated flower processing plant building permit to b8 located on Lot 5, Block 1, Sibley Terminal Industrial Park. It was noted that the Advisory Planning Committee recommended approval. Upon motion duly made by Rlein, seconded by Rahn, it was RE54LVED that the concept of the proposed structure and accompanying activity be, and hereby is, approved, subject to the submission of an application €or a building permit including the plans and specifications therefore to the Adviary Planning Committee. Mr. l~rlyn Barfknecht, 835 Lone Oak Raced, appeared on behalf of his application for a special use permit to engage in the operation of a Lire business at that address. It was noted that the Advisory Planning Cvmoefttee recommended approval. Upon motion duly made by Uselmann, seconded by Rahn, it was RESOLVED that said special use permit be granted tv applicant on a renewal basis of one year provided that applicant will not operate said business after 9;00 P. M. in the evening, and subject to immediate revocation by the Board of Supervisors in the event that such condition is violated by the applicant, It was noted that the report of the Park Committee was to be deferred for px esentation to the Board to its nest meeting on November 18, 1969. Upon motion duly made by Uselmnnn, seconded by Rahn, it was RESOLVED to set the public hearing on the application of Dayton Development Company to rezone certain property in the NE carver of the Township to C-2, Heavy ..3.. Commercial and R-b, Multiple Residental to be held at $:04 P.M. on the lt3th of November, 1969, and the Tcswn Clerk to publish notice thereof according to law. Upon motion duly made by Uselmann, seconded by Rahn, it was RESOLVED to set a public hearing on the application of ExpresswAys Property, Inc., formerly Rauenhorst Development Carp., to rezone certain property in Section ll from A, Agricultural to Y-1, Light Industrial for 8;08 P,M. on November 18th, 2969, and that the Clerk publish notice thereof according to laxa. Chairman Klein directed the Town Attorney to notify the applicant for improvements in the Lexington Addition to appear before the next meeting on November 18th, of the Board regarding the waiver of the bond, The request of the owner of the South Oaks Addition to accept streets in said addition was next presented. Upon motion duly made by Klein, seconded by Rahn, it was RESOLVER that the Town Engineer be directed to send a letter to the applicant stating that said streets in the proposed addition are not acceptable and will not be taken over by the Town until such time as same are brought up to Township standards. Upon atotion duly made by Klein, seconded by Rahn, aye Uselmann, it was RESOLVED that a public assessment tearing for Rahn Road and Beau d'Rue Road improvements and also sewer end water iaapxovements for the service road along Highway #35E SauCh to Eagandale Boulevard be held on November 25, 1969 aC ?;OQ P,M, at the Town Hall, the Clerk to publish and serve noti ce thereof according to law. The Town Attorney presented the Valley View Water Works Purchase Agra©ment Upon motion duly made by Rahn, seconded by Uselmann, it was RESOLVED that the Chairman and Clerk be, and they hereby are, authorized and directed to execute said Agreement, the samme being approved in all «4.. things. The request of Mr. James Olsen, Juran & Moody, Township fi$cal consultant, for a meeting with the Board relativ® to the ss7,e of the B-E-B and Eagan Improvement Bonds was submitted. The Board designated that a meeting should be held on November 12, 1969 at S:QO P.M~ at the Town Hall and that Mr. Olson be notified thereof prior thereto. Upon nation duly made by Chairman Klein, seconded by Uaelmsnn, aye P,ahn, it was RESOLVED to set the opening of bids for street improvements to Pine Ridge Drive and McCarthy Road, Project ,1~+6, for November 25, 1969 at 3;00 P.M. at the Town Hall. Mr. Frank Molton, attorney, appeared with Mr. Zefron, applicant, regarding a corner lot assessment appeal on Mr. Zefron's property on Pilot Knob Road in Country home Heights. Chairman Klein xeferred the matter tq the Assessment Committee for reconsideration and report to the Town Board, the Town Attorc~ey to contact Mr. Melton upon the conclusion of the reconsideration by the Assessment Conanittee. The Town Clerk reported that People's Natural Gas had proceeded with the utility construction an Pine Ridge Drive and Cedar Grove No. 7 prior to the issuance of permits therefore. Upon motion duly made and seconded it was RESOLVED that the Town ~Lngineer be, and hereby is ordered and directed to notify People's Natural Gas Company that they have violated the provisions of the ordinance regarding issuance of permits in this regard and that for those two projects they are to be charged a double fee pursuant thereto, acd it was 1~URTHER RESOLVED that in the future permits will be obtained by the Gas Company from the Tawn Engineer prior to any further construction. Clerk $olke presented certain corrections to Lakeside Estates' plat per accomp$nying letter, Upon tsotion duly made by Chairman Klein, ,~5~ seconded by Rahn, it was RESOLVED that the corrections as contained in the attached letter be, and they hereby are, approved and to be noted on the plat per the survey of Leo Shaw. The Tawn Attorney discussed with the Board the upcoming preparations for the hearing on the incorporation question before the Minnesota Municipal Commission and requested that he have authority up to $1,000 fur the preparation of necessary exhibits to be placed in evidence. Upon oration duly made by Klein, seconded by Rahn, it was RESOLVER that the Town Attorney be, and hereby is authorized to spend up to a maximum of $1,000 for necessary preparations of exhibits for the hearings. Upon motion duly made anal seconded it was RESOLVED to grant Gruden Bros, plumbing (Zti a renewal license for one year for the operation of its plumbing business in the Town of Eagan. Upon motion made and seconded, it was RESOLVED that all bills as presented, be, and they hereby are, duly approved and ordered paid. Upon motion made and seconded, the meeting was adjourned.
