02/02/1971 - City Council RegularMINUTES OF REGULAR MEETING OF BOARD OF SUPERVISORS TOWN OF EAGAN, DAKOTA COUNTY, MINNESOTA February 2, 1971 Theiegular meeting of the Board of Supervisors, Town of Eagan, Dakota County, Minnesota was held at the Town Hall on February 2, 1971 at 7;30 P.M. at which all members were present. Chairman Klein presided. Upon motion duly made by Chairman Klein and seconded by Supervisor Usel!nann, it was RESOLVED that the minutes of the pre- vious meeting of the Board be, and they hereby are, duly approved sub3ect to the inclusion in paragzaph three of page 3 of "Mr. Steak" as being the owner mentioned in that application. Fire Chief William Schultz appeared to discuss the proposed Eagandale Center fire hall. No formal action was taken. Chief of Police Maxtin DesLauriers appeaxed and requested that the purchase of s 1971 police station wagon be set for the February 16th meeting of the Board. There was no Utility Department business. Chairman Charles Halls of the Park Committee appeared and requested that a special board meetinffi of the Advisory Planning Committee and the Park ?;oard be held on February 3rd to discuss the impending bond issue for.park acquisition. No formal action was taken although the meeting was scheduled for February 3rd at 7:00 P.M. at the Tawn Hall. Chairman Klein reconvened the continued hearing on the application of Hillcrest Development Company for preliminary plat approval of part of Section 17 along Highway No. 13 near Blackhawk Road. Mr. Edward E.. Parranto appeared on behalf of the applicant. It was noted that the Advisory Planning Committee recommended approval, and it was also noted that no one appeared in opposition to the application. Upon motion duly made by Chairman Klein and seconded by Supervisor P~ahn, it was RESOLVED that the application fox prelimin- ary plat approval be, and the same hereby is, duly approved. Chairman Klein next convened the public hearing on the application of Crown Builders to rezone part of the NEB of the SEA, Section 13-27-23 being situated South of County Road 63A and Esat of Highway No. 49 from A, Agricul- tural, Co Z-1, Light Industrial. Mr. James Diffley appeared on behalf of the application, and no one appeared in opposition to the application. It was noted that the Advisory Planning Committee recommended approval. Upon motion of Supervisor Uselmann and seconded by Supervisor Rahn, it was RESOLVED that the application for rezoning be, and the same hereby is, duly approved. Chairman Klein then convened the public hearing on the application of Pilot Knob Properties for preliminary plat approval of I2O s~cres in Section 15- 27-23 and also to rezone certain lar..~~o lying Fast of Pilot Knob Road and South of Yankee Doodle Road from A, Agricultural to R-4, Town House and also a supplementary planned unit development under Ordinance No. 6. Mr. Hagemeister .appeared on behalf of the application. It was noted that the Advisory Planning Committee recommended approval. Upon motion duly made by Chairman I{lain and seconded by Supervisor Uselmann, it was RESOLVED that the applications be, and they hereby are, duly approved subject to appropriate park property dedication pursuant to Subdivision Ordinance No. 10. Chairman Klein next convened the public hearing on the application of Jack DeBoer Associates, Inc. and E. E. Parranto for preliminary plat and site plan approval for an apartment complex to be situated in the SEA of the I~T~ and S~ of the NEB, Section 15-27-23 which lands are situated between Pilot Knob Road and Lexington Avenue. It was noted that the property was zoned R=6; Multiple Residential. No one appeared in opposition to the application. Upon motion duly made by Chairman Klein and seconded by Supervisor Rahn, it was -i- RESOLVED that Phase No. 1 as presented be, and the same hereby is, duly ap- proved based upon the density requirements of old Ordinance No. b in ef~ect at the time the original application was discussed; and FURTHER RESOLVED to grant a variance for the issuance of a building permit for 1656 units for the tract proposed subject to the approval of subsequent Phases 2 through 5. Chairman Klein then convened the public hearing of E. E. Parranto to rezone four acres situated in the Southeast corner of Cedar Avenue and Cliff Road from A, Agricultural, to C-2, Heavy Commercial, It was noted that ~.r~_ the Advisory Planning Committee recommended denial. , Upon motion duly made by Supervisor Uselmann and seconded by Chairman Klein, it was RESOLVED that the application for rezonin; be, and the same hereby is, duly approved. Mr, William Clynes appeared on behalf of the application of Ernest M. Ganley Co. for a building permit to construct an office and warehouse for Nelson Tire and Rubber Company on Lot 8, Block 1, Sibley Terminal Industrial Park. It was noted that the Advisory Flanning Committee recommended approval subject to certain conditions, It was noted that the Town Engineer recommended approval. Upon motion duly made by Supervisor Uselmann and seconded by Super- visor Rahn, it was RESOLVED that the building permit application be, and the same hereby is, approved subject to the conditions set by the Advisory Planning Committee and the permit ordered issued upon payment of the appropriate fees therefor. Upon motion duly made by Supervisor Uselmann and secocuied by Chaxrz~,~n Rlein, it was RESOLVED that the application of Beure-Co. for preliminary pla: and site plan approval for the construction of tom houses and apartment bsii.d~- ings in part of the SW~ of the SEA, Section 20«27.23, along Blackhawk Road be set for public hearing at a;00 P,M. on February 16, 1971. -3- Upon motion duly made by Supervisor Uselmann acd ascanded by Chair- man Klein, it was RESOLVED that the following applications be set for public iaeariitg on March 2, 1971 at C:00 P.Nt., to wit; (1) application of DC~i Asso• ciate4 for preliminary plat and site plan approval in Section 9-27-23 North of Yark.o vu~nlZe ~c+s.rt aex2 TiaoC of Cc-Ar}mwn Roed; (Z) application O.f Arnold Carlson, d/b/a Evergreen Park Addition to rezone the N'~ of the N~ of the SW's of Section 27-27-23 next to Oak Chase Addition containing 40 acres from A, Agricultural, to R-1. Single Faa-ily Residential; acx2 (3) application of E. E. Parranto to rezone Lot 11, Blackhawk ,acres from R-1, Single Family Residential to R•6, Multiple Residential. Upon motion duly made by Supervisor Uselmann and seconded by Super- visor Rahn, it was RESOLVED that the Town Engineer be, and he hereby is, author- ized and directed to prepare preliminary reports on public improvement project No. 65 ($el-Mar Builders) artd public improvement project No. b7 (McCarthy Ridge); and FURTHER RESOLVER that the letting of bids on project No. 61 (Coach- men Road) be scheduled far March 16, 1971. at P. M. The matter of the sewer hookup to Inver Grove Heights was discussed and it was informally decided to turn over the progosed agreement from Inver Grove Heights to the Town Attorney far study and report. Upon awtion duly made by Supervisor Uselmann and seconded by Chairman Klein, it was RRSOLVED that the Town Engineer be, and he hereby is, duly author- ized and directed to prepare trouble shooting maps for the town water system. Mr. Ray Pfeiffer appeared on behalf of the application of Naegele Advertising Company for a sign permit for a directional sign to be stationed at the intersection, of Blackhawk Road and High~~ay No. 13, 10' x G.0'. Upon motion duly made bg Chairman Klein and seconded by Supervisor Rahn, it was RESOLVER to refer the application to the Chief of Police for study and recom- mendation as to placement and safety factors. -4- Upon nation duly made by Chairman I{lein and seconded by Supervisor Rahn, ft was RESOLVED that the Town Attorney be, and he hereby is, authorized and directed to prepare appropriate legislation to give to Eagan Township additional powers. Supervisor Uselmann abstained. Mr. E. E. Parranto appeared with a request for paving Robin Lane, Blackhawk Acres. Upon motion duly made by Chairman Klein and seconded by Supervisor Uselmann, it was RESOLVED that the matter be referred to the Town Engineer for a feasibility study and report. The application of Robert R. Leahy, 555 Wescott Road for tax abate- went on Parcel No, 31813C was presented, It was noted that the Dakota County Assessor recommended that the application be denied on the ground that the parcel has been valued at the fair market. Upon motion duly made by Supervisor Uselmann and seconded by Chairman Klein, it was RESOLVED that the abatement application be, atxi the same hereby is, duly denied upon the recommendation of the Dakota County Assessor. Upon motion duly made and seconded, it was RESOLVED that all bills as presented be, and they hereby are, duly approved and ordered paid, Ugon motion duly made and seconded, the meeting was adjourned.
