TO: FROM: DATE: SUBJECT: City of Eagan MEMO HONORABLE MAYOR AND CITY COUNCIL CITY ADMINISTRATOR HEDGES MARCH 26, 2004 SPECIAL CITY COUNCIL MEETING /MARCH 31, 2003 A special City Council meeting is scheduled for Wednesday, March 31 at 8 a.m. in the Eagan Room of the Eagan Municipal Center. The following two items of business are scheduled for consideration. I. RESOLUTION IN SUPPORT OF THE TPL GRANT APPLICATIONS FOR THE DNR NATURAL AND SCENIC AREA GRANT AND THE DNR RECLAMATION GRANT Per the request of The Trust for Public Land (TPL), the City of Eagan has been asked to submit a resolution of support for TPL's applications for the Department of Natural Resources (DNR) Natural and Scenic Area Grant and the DNR Reclamation Grant. As the resolutions indicate, per the requirements of the DNR grant application process, a government agency must submit the grant applications. Therefore, while TPL wrote the two grant applications, the City of Eagan is asked to submit the grants as the acting government agency. The application for the DNR Natural and Scenic Area Grant would apply to both the 20-acre and 10-acre Caponi parcels, and the Reclamation grant would apply solely to the 10-acre Caponi parcel. The deadline to submit the grant application is Wednesday, March 31. Should the resolutions be approved at the Special City Council meeting, the resolutions would then be included with the two grant applications being submitted by the City on behalf of TPL. Enclosed on pages through _ are the two resolutions to be considered. ACTION TO BE CONSIDERED: 1.) To approve a resolution in support of the TPL grant application for the DNR Natural and Scenic Area Grant; and, 2.) To approve a resolution in support of the TPL grant application for the DNR Reclamation grant. Hed~ City Administrator LOCAL GOVERNMENT RESOLUTION BE IT RESOLVED that City of Eagan act as legal sponsor for the project contained in the Reclamation Grant Program Application to be submitted on March 31, 2004 and that Beth Wielde, Parks Research and Special Projects or Paul Olson, Parks Superintendent is hereby authorized to apply to the Department of Natural Resources for funding of this project on behalf of City of Eaaan . BE IT FURTHER RESOLVED that Ci of Eagan has the legal authority to apply for financial assistance, and fmancial capability to meet the match requirement and ensure adequate management and protection. BE IT FURTHER RESOLVED that City of Eagan has not incurred any costs described on Item 5 and has not entered into a written purchase agreement for the property described on Item 4. BE IT FURTHER RESOLVED that upon approval of its application by the state, City of Eaaan may enter into an agreement with the State of Minnesota for the above-referenced project, and that City of Ea ag n certifies that it will comply with all applicable laws and regulations as stated in the grant agreement including dedicating the park property for natural andlor scenic uses into perpetuity. NOW, THEREFORE BE IT RESOLVED that Beth Wielde, Parks Research and Special Projects or Paul Olson, Parks Superintendent is hereby authorized to execute such agreements as are necessary to implement the project on behalf of the applicant. All three grants are on schedule, and will be submitted prior to the March 31 deadline. Below is a summary of each of the grants: DNR Outdoor Recreation Grant- Location: Thresher Fields Submitted By: City of Eagan Purpose: to construct a shelter complex and unpaved trails Grant Amount Being Sought: $175,000 (46.9% of project cots) Local Match if Awarded: $198,000 (53.1% of project cost) to be paid out of the Park Site Fund and an in-kind allocation. DNR Remediation Grant (incorrectly referred to previously as the,~it~~ Grant)- Location: Caponi property (10 and 20 acre parcels) Submitted By: City of Eagan (with technical assistance from TPL) Purpose: The program provides funding to acquire, protect and restore natural resources, compensating the State of Minnesota for damage to resources from the release of hazardous substances from closed landfills. In short, the eligibility is based on proximity to landfills. Grant Amount Being Sought: $190K DNR Natural and Scenic Area Grant- Q~~~ Location: Caponi Property (10 and 20 acre parcels) Submitted By: City of Eagan (with technical assistance from TPL) Purpose: land acquisition for open space i 1 ' Eligibility Requirements: open space preservation Grant Amount Being Sought: $500,000 ~` 'ti~ As you will note in the above grant descriptions, the acres associated with the two grants for the Caponi property is the same, which is not what was reflected in the cover memo to the Council last Friday. Beth noted the change, along with the correction that the City is seeking funding through the Remediation Grant, not the Reclamation Grant. Beth will have the copies of the resolutions to be signed tomorrow morning, and she will be in attendance at the meeting to answer any questions. In particular, you may want to have Beth explain why the Caponi property is eligible for the Remediation grant, as it sounds as if receiving that grant may be a long shot.
