It has been brought to my attention that some improvements have taken place in
Dave Osberg your back yard in the past few years which involved raising the grade of the yard
City Administrator and extending the fence to the rear property line. This area happens to be a
drainage and utility easement and is intended to drain properties to the east of
you. The City of Eagan also owns utilities in this area.
We actually have two issues; the first is with the City utilities. While we are not
currently requiring you to remove your fence I must inform you that if City crews
Municipal Center or contractors working on behalf of the City need to access the utilities they have
the legal right to remove the fence (within the easement) and are not obligated to

replace it.

property and is threatening to flood their lower levels. I must inform you that
should any of those properties sustain water damage you could be held liable in
Maintenance Facility C1V11 COUTt.
