I have looked into this matter further, and here is what I've learned. I called the Better Business
Bureau of Minnesota and they informed me that they have been unable to contact this company and
have received similar complaints. They said the only thing they could suggest for further action is
to file a formal complaint with thern that may be resurrected if they are ever able to contact this
company. Then, I drove to the home of Mr. Peterson to look at the numbers painted on his curb and
to make sure they were not in violation of City Code. Although they are unsightly and not painted
on every resident's curb, the numbers do not violate the City of Eagan's statutes. I next called the
office of the Secretary of State because they are responsible for the records of all incorporated
businesses in Minnesota and I learned that Curbside Painting Services, Inc., is "active, but not in
good standing." I asked them to clarify that standing and was informed that the company has not
filed any of the necessary forms since 1994 and that the corporation may be dissolved sometime in
the coming year. After briefly explaining Mr. Peterson's situation to them, I asked if it would be
appropriate to continue my inquiry with the office of the Attorney General and was told that the
Attorney General's office would be unable to help me because they do not regulate corporate
business; she sug,ested filing an official complaint with the Better Business Bureau and/or retaining
tegal counsel to discuss the specific situation.
Other than relaying all this information to Mr. Peterson and expressing regret at being unable to
help him any further in his complaint, I am uncertain what else we can do. At yow convenience,
please consider this matter and give me some direction about responding to this resident.

Thank you for bringing your problem to my attention. Although your specific situation is new to me, I have received
inquiries before about curbside painting, and I wouldlike to share that information with you.
CHAPTER 7, SECTION 7.10 Curb & Gutter, Street & Sidewalk Painting or Coloring prohibits the painting of any public
street or curb except for the placement of house numbers with the coloring to be approved by the City Engineer. The
specifications require that the numbering be black on a white background with the border not exceeding one inch;
numbers may be up to four inches high with a one-inch brushstroke. A standard detail plate is being designed for the City
of Eagan which will allow for consistency in labeling. These regulations detail the type of curbside painting that is legally
allowable according to City code, the labeling you described in your letter appears to be within our specifications.
However, your situation is clearly different because this numbering was done against your wishes. It is disturbing to me
that your private property was violated in the way you described and further disturbed at the unauthorized and unsolicited
alterations made to public property in the City of Eagan. I commend your efforts to handle this situation on your own,
but I am uncertain the City of Eagan will be able to help you any further. As I am sure you understand, it woutd be
difficult to hold Curbside Painting Service accountable for this action if we are unable to contact them. I encourage you
to follow through on this incident if any new information becomes available to you (i.e. a bill arrives with a veritable
address).

Dear Mayar Eagan:
As you requested in my phone call to you this date i am providing information thai I have
concerning what I feel is a fraudulent scam operating in our neighborhood.
The attached flyer appeared on mailboxes in our neighborhood this morning indicating that
house numbers would be painted on curbs tomorrow, a Monday.
The exact same flyer appeaxed August 22, 1986 at which time I taped a full size piece of
paper facing out on the inside of our glass front door saying "DO NOT PAINT CURB" in
large letters. When I returned home from work the next afternoon; the door had been
opened, my note removed, and our curb painted with our house number. No bill was ever
sent. It was then a brand new concrete curb and we do not want it defaced with paint.
Directory Assistance had no listing for Curbside Painting Services and did not again today.
I sent them a nasty letter asking that the paint be removed. It was returned unopened with
a U. S. Post Office indication "BOX CLOSED UNABLE TO FORWARD". I next
contacted the Better Business Bureau of MN which responded later that they had the
same result and could not locate Curbside Painting Service.
What kind of business has a closed P.O. Box address (interestingly the same one two years
later!) and no phone? Isr.'t some kind of licensing or registrat:on required to do business
in Eagan? In my opinion this is nothing more than some con artist practicing a scam in
our neighborhood.
Any assistance that the City of Eagan could provide in having the paint removed from our
curb and returning it to it's original condition at the expense of the individual posing as
Curbside Painting Service would be appreciated.

You informed me about an inquiry you received from an individual interested in painting house numbers on
the City curb and what process andlor criteria is required.
This activity appears to be covered under two different sections of the City Code identified and discussed as
follows
CHAPTER 7, SECTION 7 10 Curb & utter Street & Sidewalk Painting or Coloring
This section prohibits the painting of any public street or curb exent for the placement of house
numbers with the coloring to be approved by the City Engineer. Although we do not have a
standard detail plate that we can distribute (one is being prepared this Spring), the specifications
have required that the numbering be black on a white background with the border not exceeding
one inch and a numeral height of 4 inches with a one-inch brush stroke.

T'his type of activity appears to be covered under this section of the City Code. However, there
may have been a previous interpretation by the previous Deputy City C1erk that this type of activity
was exempt (due to a superceding state law?). [How does this compare to Girl Scout Cookie
selling, Boy Scout Christmas Wreaths sales, school or athletic association fund raisers, etc., etc.?]In
any event, I'm not familiar with the registration process or requirements.
I know I've asked more questions than have provided answers. If there is a policy that governs this activity
beyond the City Code, it may be helpful to share that so that we can uniformly respond to any future
inquiries we may receive.
