Re: Temporary 3.2 Non-"Intoxicating Liquor License
Dear Ms. Singleton:
In official action that was taken by the Eagan City Council at a regular
meeting held on Tuesday, April 21, 1981, an application for a non-intoxica-
ting malt liquor license for May 2, 1981 to be dispensed at a garage sale
at 2075 Bluestone Drive was denied.
The reason for denial was a clear interpretation of the ordinance, Ordinance
43, Section 43.15, Subdivision 1, "A temporary on sale license may be issued
upo n application to the Council of any charitable or non-profit organization
for a fee prescribed by the Council on a one day basis and not to exceed
two consecutive days. Council shall presribe such conditions to the permit
as it deems advisable and necessary under the circumstances."
A non-intoxicating malt liquor license does not qualify by interpretation
of the ordinance, and, therefore, there was City Council denial.
