This morning we met to try to resolve grading issues with respect to the property line
between 1380 Braun Court (Lot 1, Block 1, Sunrise 2' Addition) and 1390 Braun Court
(Lot 2, Block 1, Sunrise 2'd Addition). It appeared we were not going to have a
resolution to this matter.
You requested a copy of our code and standards for slopes. The engineering department
is providing the enclosed for your information. The City does make allowances of up to
1.5 feet of the proposed garage floor elevation when necessary to allow proper drainage.

installation within the City of Eagan. This manual serves as a reference for Engineering
Standards that must be incorporated into the design, plan and specification preparation,
construction, and/or connection to public infrastructure facilities within the City of Eagan.

6. Show the most recent City's Comprehensive Storm Water Management Plan
NWL and HWL for. ponds.
7. Show all easements on the plan.
8. Show 1st floor and basement walk out elevations. Verify that HWL of adjacent
ponds are 3' lower than lowest entry level of affected houses.
9. If retaining walls are needed, submit detailed plans and specifications that show
type and height of retaining wall.
10. Show City of Eagan project number on the Plan.
11. Show emergency overflow routes from all low points and show elevation of high
point along emergency overflow route.
12 Show removal of all trees and brush below the controlled water level that will be
impacted from existing and newly created ponding areas.
13. Show or define access routes for maintenance purposes to all inlets or outlets
at ponding areas (must be maximum of 8% grade, 2% cross slope and 10'
wide).
14. Show limits of clearing and grading.
15. Show all existing and proposed grades. Required standard is 2' contours with
existing contours shown as dashed and proposed contours shown as solid.
16. Upon completion of grading, the developer is required to provide the City with
an "as-built" grading plan certifying grades and house pad and lowest exposed
structure elevations existing or proposed.
17. Show 5-year design, 10-year design, and 100-year design drainage boundaries.
18. Provide hydrologic/hydraulic calculations for 5, 10, and 100 year storms.
19. Provide detailed hydrologic/hydraulic calculations verifying location and capacity
adequacy of all overland drainage routes.

The purchase agreement of Lot 2, Block 1, Braun Sunrise 2nd Addition, between Henry Braun and
Bonita Yard was reviewed by all in attendance. This agreement contains a clause stating "Seller
agrees to allow fill to be placed on the east property line and the adjoining lot so drainage along
buyer's driveway and garage will flow to the cul-de-sac." As there are no City Codes addressing
this issue, this is a private matter between the Buyer and Seller of Lot 2; however, Doug Reid agreed
to arrange a meeting between both parties, their representatives, and City staff to try and find a
workable solution for all concerned.
During construction of the home on Lot 2, Block 1, Wright Homes Inc., general contractor, raised
the garage floor 1'6" from the proposed site plan to allow for better drainage at the rear of the home
to the street. Mr. Braun (residing on Lot 1, Block 1) finds he cannot properly mow his yard with this
change. Mrs. Yard feels she did everything required by her contract.
After considerable discussion, both parties agreed to give consideration to the following:
1. Mr. Braun has asked that Mrs. Yard install a timber retaining wall along the property line to
reduce the slope so he can mow his property.
2. Mrs. Yard offered to purchase a part of Mr. Braun's property on the west side that is too steep
for Mr. Braun's use.
3. As the garage floor was constructed 1'6" higher than indicated on the original site plan, install
a retaining wall of the same height to reduce the grade levels between the two lots to be less
sloping.
A follow-up meeting has been scheduled for Wednesday, January 22, 1997 at 9:00 a.m. in the
Municipal Center Conference Room.

This letter is in response to your concerns with the elevation and drainage between Lots 1 and 2 of
Braun Sunrise 2nd Addition.
In a recent meeting between Engineering Tech Craig Knudsen, Building Inspector Mike Barck, and
you and I, you indicated that you would like a 6' high retaining wall installed within 6' of the garage
at 1390 Braun Court. Since the current condition of the side property line is not in conflict with City
Ordinance or Building Codes, the City is not in a position to require any changes. It is recommended
that any conflict be resolved in accordance with the purchase agreement between the Buyer and
Seller. City staff is in agreement that the slope appears to be properly installed.

Dear Mr. and Ms. Braun:
You have expressed a concern to the Eagan Police Department that both the pedestrian and
motor vehicular traffic should not be permitted to cross from Braun Court to Pilot Road. It is
my understanding that you wish persons crossing from Braun Court to Pilot Knob Road to be
cited for trespass or some other criminal violation.
By way of history, I understand that you owned a considerable amount of property in the
Braun Court area. Specifically, you owned Lot 1, Block 1, Braun Sunrise Addition. A Mr.
Wayne Cordes owned the property to the west of Braun Sunrise Addition. On May 2, 1988,
you entered into an Easement Agreement which allowed the Cordes family to cross a
triangular piece of property from Braun Court to the Cordes' property. In exchange for the
grant of this easement, the Cordes family agreed to use the easement access for private use
only, to be solely responsible for the control of said driveway and to prevent its use for
commercial or business purposes and to further prevent direct access to Pilot Knob Road from
Braun Court. You have since subdivided Braun Sunrise Addition into Braun Sunrise Second
Addition and you have sold Lot 2 of that addition to Bonita Yard.
It is my legal opinion that the City of Eagan cannot charge persons crossing the property of
Bonita Yard, without the direct request of Bonita Yard. It is my further opinion that we
cannot bring trespass charges against anyone on the Ricke property without the direct request
of the Rickes.

Minnesota Statute §609.605, relating to trespass, provides that the City may charge an
individual trespassing on the premises of another when, without claim of right, that person
refuses to depart from the premises on the demand of the lawful possessor. The lawful
possessor of the Yard property would be Ms. Yard. The lawful possessor of the Ricke
property would be the Rickes.
In reviewing the Easement Agreement signed between yourselves and the Cordes, I would
interpret that Agreement to refer only to motor vehicular traffic and not to pedestrian traffic.
In any event, even if there is a violation of that Easement Agreement, such a violation does not
rise to a violation of the trespass law, unless the trespasser would refuse to depart after a
lawful demand by Ms. Yard, on her property, or by the Rickes, on their property.

An application has been submitted to rezone approximately 3.8 acres from A
(Agricultural) to R1 (Residential Single District). The second application
submitted is for a preliminary plat, Braun Sunrise Acres, which would consist
of approximately 3.8 acres and contain four (4) single family lots.
COMIvIENTS :
1. When Drexel Heights was platted, Outlot"A"was dedicated to the City as park
land. In November 1979, the Eagan Park Committee and the Eagan City Council
determined this park land was unusable for park purposes and sold Outlot"A"
to Henry Braun in the process of negotiating an easement which the City needed.
2. Presently Henry is proposing to subdivide his property and Outlot "A"
into four (4) single family lots. Lots 2,3, and 4 would have direct access to
Drexel Court, lot 1 presently has access to Pilot Knob Road and also has 30
feet of frontage on Drexel Court. When Pilot Knob Road is upgraded, access
may be obtained from lot 1 to Drexel Court by placing this 30 foot of frontage
along the north property line of Mr. Brauns property it allows the possibility
to obtain additional 30 feet when Harvey Braun subdivides his property. With
this dedication, the City would then have the full 60 foot right of way to
provide access if the property would be further subdivided.
3. All lots meet the requirements of the R1 (Residential Single District).
4. Mr. Braun is proposing to dedicate the additional right of way for Pilot
Knob Road.
IF APPROVED, the plat should be subject to the following conditions:
1. All easements shall be dedicated as required by the Eagan City Staff.
2. A road easement shall be required.on the 30 foot of frontage abutting
Drexel Court in lot 1, block 1.

Eagan City Staff.
4. A park dedication shall be required on each of the newly created lots

ENGINEERING RECOM[uSENDATIONS:
1. A 30 foot street and utility easement should be dedicated along the north
30 feet of lot 1, adjacent to lot 2.
2. A more detailed grading plan must be submitted and approved prior to final
plat approval, pertaining to lots 3 and 4.
3. A 75 foot half right of way must be dedicated adjacent to Pilot Knob Road.
4. The developer shall agree to pay his fair share for individual sanitary
sewer, watermain, storm sewer and street assessments for benefits received from
those utilities constructed for Drexel Heights.

The Public Works Department has the following comments to offer in regards
to the above referenced proposal:
UTILITIES:
Sanitary sewer, watermain, storm sewer and respective services have been
installed with the utilities of the Drexel Heights subdivision, of sufficient
size and depth to accommodate the proposed plat.
STREETS AND GRADING AND DRAINAGE
Access to this proposed plat will be provided by way of the Drexel Heights
street improvement which is presently under contract and anticipated to be
completed by mid summer of 1980. A 30 foot street easement is being dedicated
over the northeastern corner of lot 1 to provide future half right of way
necessary for access to Drexel Court for the future subdivision of lot 1.
This will eliminate the need for direct access onto Pilot Knob Road once
it is improved to its designed County standard. Lots 3 and 4 are heavily
wooded lots with the total differential and elevation from east to west of
approximately 45 feet which accounts for an average of 22% slope. Grading
plan submitted calls for a retaining wall to be constructed approximately
60 to 75 feet from the east property line. This retaining wall would have
to be a total of 20 feet in height. The expense of constructing a retaining
wall of such dimensions might be cost prohibitive in considering its stability
to be developed. Consequently, a more detailed plan must be submitted showing
how these lots could be graded to make them developable. The overall drain-
age is to the east onto Drexel Courts which has existing storm sewer lift
station.
EASEMENTS AND RIGHTS OF WAY:
A 75 foot half right of way would have to be dedicated adjacent to Pilot Knob
Road for its proposed future upgrading. All other easements as proposed or
already dedicated are satisfactory to Staff.
I will be available to answer any further questions regarding this proposal
at the Planning Commission meeting of May 27, 1980.

BRAUN'S SUNRISE ADDITION
DEVELOPMENT CONTRACT
THIS AGREEMENT, made and entered into on the 2/ day of
1980, by and between the City of Eagan, a
municipality, of the State of Minnesota (hereinafter called the
"City"), and Henry A. Braun and Adona E. Braun (hereinafter
called the "Owners").
A. The "Owners" as used herein refers to Henry A. Braun
and Adona E. Braun, whose address is 3740 Pilot Knob Road, Eagan,
Minnesota 55122.
WHEREAS, the Owners have applied to-the City for approval of
the rezoning and final plat approval requested by the Owners for
the plat or subdivision known as Braun's Sunrise Addition; and
WHEREAS, the City Council has agreed to approve said
rezoning and final plat on the condition that the Owners enter
into this Development Contract, which Contract defines the work
which the Owners undertake to complete within the boundaries of
said lards, and,
NOW, THEREFORE, the City and Owners agree as follows:
1. Subject to the terms and conditions of this Development
Contract, the recitals above, and all other applicable Eagan
Ordinances, including the Subdivision Ordinance, the City of
Eagan hereby approves the recording of the plat known as Braun's
Sunrise Addition.
2. The parties mutually acknowledge that it is the inten-
tion to develop the entire plat as three (3) single family
dwelling units and one (1) existing single family dwelling unit.
3. The Owners shall provide the City with a grading and
drainage plan and shall construct drainage facilities adequate to
serve the addition. The Owners agree to grant to the City of
Fagan all necessary easements for the preservation of said
drainage system, for drainage basins and for utility looping.
The grading and drainage plan shall include lot and house
elevations, drainage swales which shall be sodded in the same
manner as boulevards, storm sewer, catch basins, erosion control
structures and ponding areas to conform with the overall City
storm sewer plan, and shall be approved by the City engineer
prior to final plat approval. Construction shall be in confor-
mance with the grading and drainage plan and subject to inspec-
tion and approval by the City.
Said grading and drainage plan shall provide as much detail
as is possible pertaining to Lots 3 and 4, Braun's Sunrise
Addition.
4. The Owners will provide, in the final plat, five foot
drainage easements adjacent to all common property lines and ten
foot drainage and utility easements across the front of each lot
adjacent, to a public right-of-way or adjacent to any lot lines not
common to other lots of this addition. Additional utility ease-
ments may be required by the City of Eagan and will appear on the
final plat or will be submitted to the City of Eagan by an ease-
ment deed when requested.
5. The Owners shall provide an erosion control and pond
maintenance plan and shall install and maintain such erosion
control structures as appear necessary under the plan or become
necessary subsequent thereto. The Owners shall be responsible
for all damage caused as the result of grading and excavation
within the above devleopment, including but not limited to,
restoration of existing control structures and cleanup of public
right-of-way, until all lots are developed and improvements are
completed. As a portion of the erosion control plan the Owners
shall re-seed or sod any disturbed areas within 90 days of com-
mencing grading operations or when 90 percent of the grading
operation has been completed, whichever occurs first. The City
reserves the right to perform any necessary seeding and/or
sodding, as required if these requirements are not complied with,
and the developer shall be financially responsible for payment
for this extra work within 30 days of formal billing by the City.
6. The Owners shall, prior to the release of the final
plat, deposit with the City the park contribution required on
each of the newly created lots at the current park dedication
rate.
7. The Owners shall dedicate as part of the final plat of
Braun's Sunrise Addition a 30-foot half right-of-way for street

and utility purposes on the north 30 feet of Lot 1 and shall
further dedicate a 75-foot half right-of-way adjacent to the cen-
terline of Pilot Knob Road.
8. The Owners hereby agree to pay an equitable assessment
for benefit received from sanitary sewer, water main, storm sewer
and street, improvements constructed or installed for Drexel
Heights.
9. The Owners shall submit a copy of the final plat to the
Dakota County Plat Commission for review prior to approval by the
City of Eagan. The plat shall be subject to the comments and
conditions imposed by the Dakota County Plat Commission.
10. Breach of any terms of this agreement by the Owners
Shall be grounds for denial of building permits for building
within the addition until such breach is corrected either by the
City or by the Owners as the case may be.
11. If any portion, section, subsection, sentence, clause,
paragraph or phrase of this Development Contract is for any
reason held to be invalid, such decision shall not affect the
validity of the remaining portion of this agreement.

This agreement is made this A/ day of IY1f+~~ 1988,
by and between Henry A. Braun and Adona E. E. Braun, husband and
wife, parties of the first part, and Wayne D. Cordes and
Deborah L. Cordes, husband and wife, parties of the second
part.
WHEREAS, the parties each desire certain street and sewer im-
provements, adjacent to or near their respective properties as pro-
posed by Project 487R of the City of Eagan, Minnesota., and
WHEREAS, parties of the second part desire to have a private
driveway easement (attached hereto as Exhibit"A") which leads into
Braun Court., and
WHEREAS, the parties have reached oral agreement relative to
various matters arising out of such improvements and driveway
and wish to set forth said agreement in writing.
NOW, THEREFORE, IT IS HEREBY AGREED by and between the parties
hereto based on the mutual considerations set forth below that:
1. Parties of the second part shall use the driveway leading
into Braun Court for private use only, and not for commercial or
business use.
2. Parties of the second part shall use said driveway for one
home only, and if their property is subsequently divided into two
lots, then they agree to rezone their entire property as R-1,
single family residential.
3. Parties of the second part shall be solely responsible
for the control of said driveway and to prevent its use for commer-
cial or business purposes, and they shall further prevent direct
access to Pilot Knob Road from Braun Court.
4. In the event that said driveway is used for commercial or
business purposes, either parties of the first part or the City of
Eagan would have the right to close off access of said driveway to
Braun Court.
5. In the event that parties of the second part create a
future use requiring a driveway access into Braun Court for the
purpose of providing access to a second home on their property,
then parties of the second part agree to pay an amount equal to
the original amount assessed them for the first access to Braun
Court to the following persons, their heirs, executors, adminis-
trators, agents or assigns in the following proportions:
Mary Braun - One-half (1/2)
Henry and Adona Braun - one third (1/3)
Leonard and Kathleen Walz - One-sixth (1/6)
6. This agreement shall be binding upon the parties hereto,
and all of their heirs, executors, administrators, agents or
assigns.

This letter is to certify that the windows installed at 1380 Braun Court have been
installed in accordance with the guidelines set forth in the installation manual provided by
Renewal by Andersen. This manual applies to all products that we install and all warranties are
in affect for product once it is installed. Renewal by Andersen assumes liability for the
installation of our products for 5 years from the date of installation, which would include labor
and materials for any product we install that fails for any reason caused by incomplete or faulty
installation practices. The Renewal by Andersen - Roseville retail location installation crews are
all trained through an in house trainer and are held to exceptionally strict standards through
internal quality control and through independent customer satisfaction surveys. We have also
confirmed with the homeowner that smoke detectors were installed in; every bedroom, their
adjacent hallways and on each level. In addition, carbon monoxide detectors were installed
within 10ft of any room used for sleeping purposes.
