In order to aecomodate your request, we must pursue one of the following
alternatives:
1. City staff could research the information you are requesting at times when
the normal workload permits. Based on current work levels, that could
take two to four weeks. We would determine whieh information might be

FACTS
The facts of this case are as follows:
The Plaintiff originally brought an action against Metro Custom
Homes as the general contractor and vendor of his home. Plaintiff's
Complaint included numerous allegations of defective workmanship.
This matter was tried to a jury in January of 1988. Plaintiff's
verdict was in the sum of Six Thousand Seven Hundred Fifty-five and
no/100 Dollars ($6,755.00). Plaintiff subsequently sued numerous
parties including some of the subcontractors and the City of Eagan.
The Plaintiff bases his claim against the City of Eagan on negligence
by the City in the inspection and enforcement of the municipal
building codes. Plaintiff describes various violations and claims
that the City of Eagan, in not preventing these code violations, is
liable to the Plaintiff.
The City of Eagan issued the building permit for the Plaintiff's
residence on September 23, 1985. The permit was issued to Metro
Custom Homes as the owner and the permit was signed by an agent of
Metro Custom Homes on the express condition that "all work shall be
done in accordance with all applicable State of Minnesota statutes
and City of Eagan ordinances". The building inspector at the time was
Dale Peterson. Mr. Peterson has subsequently retired. The current
building inspector is Doug Reid.
DISCOSSION
The law is clear in this case. Plaintiff is not entitled to
recovery from the City of Eagan. While it is true that 5466.02 of the

Minnesota Statutes, with certain exceptions, abolished the defense of
immunity from tort liability for acts of municipalities performed in
exercise of a governmental or proprietary function, the statutory
provisions merely removed the defense of immunity. They did not
create any new liability for a municipality. in order to recover
against the City, Plaintiff must show a breach of some duty owed him
in his individual capacity and not merely a breach of some obligation
owed the general public. The purpose of a building code is to protect
the public. This is well stated in 7 McQuillan, Municipal
Corporations, (3 Ed.), §24.507, p. 523:
". The enactment and enforcement of building codes and
ordinances constitute a governmental function. The primary
purpose of such codes and ordinances is to secure to the
municipality as a whole the benefits of a well ordered municipal
government or as sometimes expressed, to protect the health and
secure the safety of occupants of buildings and not to protect
the personal or property interest of individuals."
The Minnesota Supreme Court spoke directly to this issue in
Hoffert v Owatonna rr,r, mnwr,p Mntal rncnrnnraraA, In that case, they
said:
"BUilding codes, the issuance of building permits and building
inspections are devices used by municipalities to make sure that
construction within the corporate limits of the municipality
meets the standards established. As such, they are designed to
protect the public and are not meant to be an insurance policy
by which the municipality guarantees that each building is built
in compliance with the building codes and zoning codes. The
charge for building permits is to offset expenses incurred by
the City in promoting this public interest and is in no way an
insurance premium which makes the City liable for each item of
defective construction in the premises." Hoffert v. Owatonna Inn
-=.w."° w==e', Z^c., 293 N.ir.a. 223. 199 1;.n.26 158, 150 (1972).
The Minnesota Supreme Court also said in Roerig v. Hou ton:
"A building inspector acts exclusively for the benefit of the
public. The act performed is only for public benefit and an

individual who is injured by any alleged negligent performance
of the building inspector in issuing the permit does not have a
cause of action." Roerig v. Houghton, 144 Minn. 231, 235, 175
N.W. 542, 544 (1919). See also, Hitchcock v. County of
Sherburne, 227 Minn. 132, 135, 34'N.W.2d 342, 344 (1948).
in 1986, the Minnesota Legislature codified these court
decisions and amended the Municipal Tort Liability Statute, The
special duty doctrine, as it relates to the issuance of permits and
licenses, has been resolved. Municipalities now have immunity.
Minnesota Statute S466.03, Subd. 10, added by laws 1986, Chapter 455,
§69, establishes municipal immunity for:
"any claim for a loss based on the failure of any person to meet
the standards needed for a license, permit or other
authorization issued by a municipality or its agents."
with this revision, the legislature has decided to protect
municipalities from liability in their increasing duty in the
issuance of permits and licenses, including building permits.
Plaintiff's claim for a loss is based on the failure of Metro Custom
Homes to meet the standards needed for a building permit issued by
the City of Eagan. With the 1986 changes in immunity, there can be no
recovery for Plaintiff.
CONCGOSION
In conclusionr Plaintiff is prohibited from recovery from the
City of Eagan both by Minnesota Supreme Court decision and Minnesota
statutory authority. Plaintiff's proper action lies against the

I am looking Eor heip in getting our home builder to
complete, repair and correcl various items in our home.
Attached is a listing oE the problems we have Eound. '
We contracted eith METRU CUSTUM HUMES in Aug. 1985 to
build our $130,000+ home.
Thanksgiving weekend 1985 we moved in after cleaning
up after the contractors. But we were not able to close due
to numerous incomplete items; the most obvious was the
improperly painted interior walls. Only aE'ter the completion of the
obvious items and after the third appraiser call back was the
mortgage company willing to close on Dec. 20,T985.
At closing xe submitted a second list oE incomplete items
to the builder. He indicated they would be taken care
o£ and to not bring them up in front of the loan ofEicer.
Uuring the next seven months the call backs were
numerous and we were calling th?ir oEfice frequently in order
to adjust our schedules to accomodate their personnel.
The calls included many requests Eor the removal of several
hazards to which their r?sponses included; it is out oE our rontrol
or it has been identiEied ta our help.
* One trash pile was in our frotit yard until late spring
1986. A second trash pile was on the south side
oE our lot and was not removed until July 1986. Even
then we had to complete the clean-up oE both piles.
* Standing water in our back yard several feet deep was
not drained by our btiilder or developer Eor over a
month. Only aEter complaining to the city inspectors
was the pond drained and drainage maintained.
* The garage fire wall was to have been taped shortly after
we moved in as per code. But the wall was not taped until
we requested it to be reinspected by the city in Aug.1986.
Over these seven moiiths a number oE itenis were taken care oE
through our persistence. Rut the builders willingness to complete
other items (old and newly found) was becoming less and less.
I met with the builder on July 28th to discuss the open items.
But we could not agree on tlie repair of several major items and the
quality oE the workmanship I,?XpP_CfE'Cj in our home. tthe workmanship
is not equivalent to other h.nmes and models they had builtl. With
my comment that I would be contacting an attorney he directed all
work on our house to stop.
At this time xe contacted an attorney and hired an
independent house insp?ctor.

we had identiEied earlier tv the builder. (ref. attached
report).
In Aug. our attorney iurmally notiEied the builder oE our
problems and requested a respons?. ln Nov. aEter several more

receive their written reply. lt was not accepl:able to us.

EXPECTED REPAIRS summarized Aug. 1986 and

may be done during the repairs.
+ The retaining walls have cracked and have moved away from the

the basement. the crack is the widest near the door
(nearly 1/8 "), the Eloor is also uneven ( over 1/16 ")

FASCIA AND TRIM
Replace and paint the fascia and trim boards; with popped out knots
and or impropperly cut edges.
+ Note; The knot holes were present at the time the trim was

grade oE material should never have been used. the lumber
yard wouid have taken it back.
+ All corners and joints should have been mitered at 45's to

FRONT ENTRY POST
Correct the length and repair any damaged siding and roofing
DRIVEWAY AND GARAGE FLOOR
Remove and replace the driveway with 18 Eoot wide as per
print. we expected the added cost oE the concrete
driveway included the 18' width.
+ The primary reason for the driveway replacement is; the sur£ace
continues to deteriorate due to improper installation, this
was first identiEied in Nov. 1985, code requires proper
percautions should have been taken:
* The driveway should have been covered during cold
weather installation
* An entrained air mix should have bPen poured to
minimize shrinkage and expansion do to Ereezing
* Salt resistive additives should have been added
to the mix
None of these percautions were taken on the driveway or
garage Eloor when the cement was poured. the Minnesota
climate and weather conditions dictated these pr.ecautions
should have been taken when ordering the mix.
Note: the number and length of the cracks in the garage
floor is increasing
EXTERIOR LIGHT FIXTURES

IMTERIOR FRAMING

crack directly above the laundry room door.
FRAMING AND SUPPORT OF THE BASEMENT STAIRS AND FOYER
+ The print identiEies there should be a 2x6 load bearing wall
on the south side oE the basement stairs instead oE the 2x9 stud
wall which was installed. note; the lst Eloor interior wall
and 2nd floor exterior H311 directly above are oE 2x6
construction supporting the roof; thus the basement

support wall should be the same and corrected.
+ The print identifies there should be support posts on either
side oE the stairs near the landing. the north post is
missing and should be installed. the footing pad was installed
+ The print identifies there should have been 'L more double
joists supporting the front foyer floor area. these
should be installed
+ The stud walls on either side of the basement stairs are too
short and these Nalls are not supporting the the Eloor joists.
this should be corrected
+ The south post near the stair landing is supportinq only "L of the
3 floor joists which is supporting the 2x6 load bearing
wall above. this post appears to be not centered on the
Eooting pad
+ Note: the material for the missing items were delivered but
not used
+ Together these items may be the rause oE the wall cracks on the
lst Eloor around the stairs. these cracks have been repaired but
continue to open up. I question the structural integrity
oE this Framing. also many new cracks have appeared
+ Also this may contribute to the " 2nd floor interior wall
separation from the Floor " which was described by the
carpenter Hho returned in the spring oE 1986 to eliminate
the " Eloor groans ". his installation of shims under the
walls did not work; the noise continues. at that time
he also indicated the materials were shrinking.
HOLE IN FLOORING
+ Near the basement door in the family room there is a hole in
the Eloor over which the carpet was placed. this should be
fixed.

can damage the plumbing there should have been air trap

chambers should be at the end of all branch lines or East

this must be rectified.

elements as of the dates of inspection. It is based on our special limited
scope visual inspection as requested by client and has been performed
accorrling to industry starxlards. No water, air, soil, or material analysis,
including those for health or environmental considerations, were perfornted
for this report.
These inspections were of relatively short duration and done for the
client in a dispute with the builder/developer. The inspector is a Minnesota
registered architect. If the dispute proceecLs to a fornial level, these
inspections should be considered as preliminaiy due to the likely need to
prepare, for trial, detailed docLmnentation, researrh, or evidence such as
photographs, measurements or drawings which were not done for this report.

Some of the conflicts between specifications atxl drawing are as follows:
(1) Specifications state "The footings and block shall be installed
according to plan..."; the drawinqs do not state size of bloclc work; scaling
indicates mostly 12" block at house, 8" block at garage. See Fowidation
comments. (2) Specifications require 16 foot wide driveway; drawings shaa
18 foot wide driveway. 16 feet width was constructed. (3) Specifications
require 1/2 inch OxUoand roof sheathing; a note on section drawing states 1/2
inch CDX plywood sheathing. Oxboard t-ras installed. (4) Specifications state
2 X 4 studs; upper level plan and section through family/garage irxlicate 2 X
6 studs at exterior walls. 2 X 6 studs were installed. [Note that the first
major paragraph of the General Terms and Corxiitions states" ... Where the
specifications and plans differ, the specifications shall govern ..."].
C'ONSTRUGTION DRAWING DISCREPAt7CIES (12-3-86)
Some conflicts between drawings (dated 9/15/85) were noted as follows: (1)
On rear elevation, a double casement window was shown for upper bathroom; on
upper level floor plan it is a single casement. A single casement window was
installed. On baseme.nt plan an awning window is shaan for left side; on left
end elevation no window is indicated. A window 4ras installed. On section
marked Family/Garage a basement window is sha,m clase to garage wall; on
right end elevation the window is sha•m close to rear wall. Winda,a installed
was in about the center. (2) Main floor plan indicates 24 foot wide garage;
dimension string indicates 6 feet, plus 16 feet-2 inches (M.O.), plus 2 feet
or a total width of 24 feet - 2 inches. (3) 11 feet dimension shawn for
kitchen counter and cabinets; scale of drawing indicates 9 feet long. Nine
feet of cabinets were installed. (4) Main floor plan shows exterior kitchen
wall as 20 feet long plus width of wall between kitchen and dining rocrm for a
total exterior length of 20 feet-5.5 inches; basement plan shows fowidation
supporting exterior kitchen wall as only 20 feet long. House was built
according to basement fouridation dimension, resulting in kitchen wall above
being built about 5 to 6 inches shorter than designed. This error resulted
in chaixles to cabinets, bay window, ancl reduction of dinette windaa to three
panel casement from four panel per plan. Correction of this error will be
extremely costly. (5) On basement plan, left foundation wall is dimensioned
26 feet; dimension string indicates 16 feet plus 12 feet or a total length of
28 feet. The wall was constructed as 26 feet long. The 16 feet dimension
appears to be an error; it scales as 14 feet. (6) Basement plan lacks
footing pads for support posts at main beam which are required by codes.
Photos indicate sane footirigs were constructed, but unable to determine size
or location. (7) Basement plan lacks continuous frost footing at rear door
as required. (8) Basement plan does not indicate frost footings for
retaining walls at rear steps/area way. (9) Basement plan does not indicate
stepping of frost footinys such as at garage or rear area way steps. (10)
Basement plan does not indicate size/type of main framing support beams. '
(11) Main floor plan states 1,242 square feet; calculations indicate 1,276
square feet for house.

ROOF (9-19-86)
Roofing is not installed properly. Underlayment is not installed to outer
edge of roof sheathing or trim at both lader horizontal edges and at sloped
rake edges. For example, the starter course above garage door is one inch
back from horizontal edge. Along rakes it varies 1 to 3 inches back fram
edge. At the horizontal edges, the underlayment leaves a gap between roof
sheathing and fascia trim. Because the fascia trim is improperly installed
too high, the slope of shinqles changes to form a trouqh at the roof edge,
which is improper since instead of shedding water, it traps water. The
trapped water thett leaks daanwarl, tlirough the unprotected gap between the
fascia and sheathing into the soffit. This (and other lealcage) is not
accorling to Minnesota Building Code UBC 3202 (a) "Roof caverings...shall
prwide weather protection...'t
Flirthermore, tYte underlayment at bottom edges appears to not be of the proper
tY1e construction: UHC 3203 (d) 3. "Underlayment consistirx3 of two layers
of Type 15 felt applied shingle fashion shall be installed and mopped
together with approved cementing material between plies extendirig from the
eave up the roof to a point 24 inches inside the exterior wall line of the
builduig." Such treatment was not visible within the first 4 inches of outer
roof edge tutder the shirigles at garage.
Also noted that boston ridge shingles were inproperly cut resulting in a
ragged appearance. Roof appearance is also degraded by discolorations on
roof (reportedly frmn gold and black spray painting), by mismatching of
shirigle colors (reportedly due to rnmerous replacement of areas of shingles
caused by shinyles having blown off six different times), by popping up of
some staples, and by bulge in roof in the area where the house arxi garage
roofs join together (this appears to have been caused by shrinkage of house
framing or by original construction where roof lines did not match in a flat
plane. Shrinkage is suspected as probable cause due to likely absorption of
water in framing, roofirg and other construction materials with subsequent
release of moisture and consequential shrinkage. 4'his likelihood is due to
lack of any protection of materials and materials sitting in wet mud at many
other nearby hmnes being built by this builder on the day of inspection.
(Note: Client reported that carpenter said that the house framing had
suffered from shririlcage.) Lack of protectirig materials from moisture is
contrary to manufacturer's instructions, and therefore, contrary requirement
that code approvals of manufactured items are usually contingent upon
following manufacturer's instructions. (Note UBC 2510 has specifics for roof
truss protection which may or may not app].y.)
There is no metal drip edgirxg as is called for in the construction contract
and as recrnronencled by manufacturer's instructions. Therefore, if c.ode
approval of these GAF "Sentinal" Class A shirgles is contingent upon having
metal drip edginq, then this lack of edgirig is also contrary to code
requirements.
Check with manufacturer to determine whether their warranty is voided and, if
so, what corrective measures are necessary to re-establish warranty.

F'IASHINGS (9-19-86)
Three areas of flashing the joints betcoeen house siding ancl roofing have been
improperly perfonnecl. (1) The long joint between the house and the laaer
roof wer family xoom at rear has a continuous piece of trim board installed
the entire lenyth of the roof-siding joint. This board will trap moisture
frrnn rain/snow between the board and cause the fiberboanl siding to
deteriorate rapidly. Fiberboazti siding is particularly susceptible to
moisture damaging oonditions such as this. (2) The metal flashimg at the
top of the small roof above front entry is apparently not fonned on a metal
brake, is crooked, is lifted and therefore can easily permit water entry.
Normal technique is to ba1-¢i metal flashiny on a brake to form straight edges
and corners and to create a spririg action which holds flashing tight to
shingles, which was not done. Appearance indicates amateurish inattention to
detail. (3) At this same roof, flashing along sloped joint with siding is
not designed to divert water to outside of siding. Water is leakuxJ behind
siding and through wall into garage. Damaged fiberboarl sheathing near the
leak may be caused by freezing of leaking water and expansion of ice. This
is contxaty to code requirements that structure be protected from moistnre
penetx2tion. [UBC 1707(b)]
SIDING (9-19-86)
Several defects noted in siding installation which are contrary to
manufacturer's instructions and to code requirements [UBC 1707(a). The
butted end joints of siding are supposed to be protected by metal joint
covers to reduce chance of water absorption into siding. Although joint
cavers are installed, they are the wrong type for this siding profile and, in
a few spots, the joint cavers do not caver the ends of the siding. The
profile of the siding is that each siding board is formeci to look like three
laps of a clap board type pattern, but the joint covezs are designed for flat
type siding boands. The joint cavers are also causing the siding board above
each cover to bulge outwand, creating a thicker shadaw line. These joint
covers are aesthetically objectionable due to shadow patterns which develop
from the mi.smatch and functionally inappropriate since the mismatch leaves
gaps through which water/moisture can easily enter anci will result in rapid
deterioration of butt ends of siding.
The siding is too close to grade in areas ard to deck at rear which will
result in more rapid deterioration of bottom siding boan9s due to splash-up
of rain water and/or snaa piled next to house. The closeness to grade may
indicate non-conformance to UBC 2907 (a) ". Founciations supporting wood
shall extend at least 6 inches above the adjacent finish grade. "
Without such clearance, the bottom of framing is more susceptibleto moisture
damage. The painting of siding is not adequate; the bottam edges closest to
grade are unpainted in areas; these edges are the most susceptible to
moisture damage and the inadequate painting will likely result in premature
failure of tliis siding.
Check with manufacturer to determine GAiether their warranty is voided and, if
so, what corrective measures are necessary to re-establish warranty.

Construction drawings indicate improper structural design/construction of
footings and foundation at rear basement door and for area way retaining
walls. UBC 2907 (a) (modified) states 1? ...the minimtm alla•table footing
depth in feet due to freezing shall be...three and one-half feet..." This
requirement is intended to prevent fowxiation movement due to frost heaving.
The drawings indicate there is no footing below the door and that the
footings of the retaining walls are at the same elevation as the house
footings. Such depth is not adequate at this depressed area because the
footings are very close to the exposed steps anci concrete slab at the bottam
of the steps. Lan7e vertical cracks through both retaining walls close to
house foundation indicate failure, probably due to this inadequate footing
depth. Pattern of cracks irxiicates outer encls of walls are settling dawnwand
in relation to house foundation. In winter these cracks may tert3 to close
some as frost heave raises retaining walls; then open more with sprirg thaw.
Such cycle will likely continue. The house footing is also at inadequate
depth at rear door for the same reason, though no evidence of failure noted
on 9-19-86. However see basement floor coments. The house footing should
have been stepped down to an adequate depth belaa the rear door for frost
protection and for footing continuity/strenyth.
FASCIA AND TftIM (9-19-86)
Noted nwnerous ]mot holes in trim and fascia boanls; these are lower quality
boards than nornially used for trim. Holes need to be filled, caulked and
painted to prevent water entry. Gaps noted at roof pealc miter joints are
open and need caulkinq to prevent water entry. Trimwig of rear bay window
is of poor quality; horizontal joints need flashinq/caulkiny.
FRON'P EN'IRY POST (9-19-86)
Pnst holding up corner of roof aver front entsy is about one inch too tall.
It reportedly was added by builder after house was built, causing stresses
ancl cracking of adjoining finished surfaces.
DRIVES?TAY (9-19-86)
Concrete driveway has ntmerous popouts scattered throughout its surface.
Apparently driveway was poured during winter type conditions without using
any cold weather techniques. Such iniproper installation would result in
improPex' curing arxl defective, easily deteriorated surface. E?cpect popouts
to continue; rate of deterioration may accelerate. Such iniproper curing is
contrary to codes UBC 2605 (e) and (f) unless special type concrete was used.
These code sections require maintaining tenperatures above 50 degrees F., and
i.n a moist condition for at least 7 days (3 days for high early strerigth
concrete) after pouririg, and that equipmeant for heating the concrete is
necessatiy during freezing or near freezinq weather.
GRADING (9-19-86)
Exterior gradinc3 is poor. Law areas do not drain away from founclation
adequately and may result in future water perietration iiito basement. UBC
2905 (f) states "Provisions shall be made for the control and drainage of
surface water around buildim3s." Noted on 9-19-86 swp pLmp had water with

differential crack is likely due to lack of footing/heaving of grownd
beneath.
FOUNLIATION (12-3-86)
Foundation was covered by furring arxi insvlation. Photograph indicated vexy
tall footing step between garage and house; this is not against UHC 2907(c),
but it is not a very good design due to creatung a likely high bending stress
and likely separation. Photograph shaas footing is broken at this steep
step.
Specification states concrete block to be accortiing to plan which irxlicates
by scalirig 12 inch at house anci 8 inch at qarage; it appears some of block
which should have been 12 inch are actually 10 inch, though difficult to
verify due to furring,
INPERIOR FRAMITIG (9-19-86)
Noted roof sheathing anchors (staples) missed first tniss in from north side
of garage. Noted no bridging for first floor floor joists; although
custamarily used in past, appeais to be in accorlance with code.
FRAMING (12-3-86)
Wood support post/colimui is missing at stair as required by basement plan and
other post, which was installed, is in the wrong location.
Basement plan indicates several beams should have been installed beneath
front foyer/bathroom area; these beams are missing. Floor joists in this
area have somewhat long spaiLS.
Noted that joists are not doubled beneath wall between dining room and
kitchen and beneath wall between family room and lawndiy room; hawever, these
walls appear to be non-bearitvj walls. Noted doubled joist header below
bearing wall between stair and family rarm which is a bearing wall is not
continuous at post. Careful measurement indicates the joist of the header
pair which supports floor joists has settled 1/16 inch to 1/8 inch in

walls to bend outward. This could be caused by interior side of studs
becrnning drier or exterior side beccrming damper or a combination of both.
Noted significant vertical crack above door to lawldry; probable cause is
differential settlement due to mwemernt of joist header which passes beneath

Specification states urderlayment for vinyl flooring shall be "glued art3
screwed to joists". Vinyl flooring at first floor was being replaced during
inspection which revealed that underlayment was stapled at about 3 inches on-
center. Also noted smne staples popped up. Noted hole through family room
on first floor next to stairway should be repaired.

How Do You Pay a Judgment?
• Payment may be made directly to the party that wins the case (prevailing party) or payment
may be made through the Conciliation Court. '
• If the prevailing party is paid directly, obtain a statement of payment from the party
(satisfaction of JudgmenU and file this with the Gourt. Special forms for this procedure are
available at the Conciliation Court office.
• If the Court is not properiy notified of payment, you will have an unsatisfied judgment on your
record.and your credit rating may be affected. . ,
How Do You Collect a 3udgment?
Although a case is decided in your favor, a Conciliation Court judgment does notcreate a lien
against the debtor's property unless the procedure outlined below is foilowed. You can try to
collect the judgment yourself 'rf it has not been paid within the required 20-day period, and if the
other party has not filed an appeal. The judgment is good for 10 years and may be renewed for
another 10 years, If the party is declared bankrupt follow(nga judgment, you-may receive part of
your payment if assets are divided among the partys creditors, or the debt may be discharged
and you cannot collect.
The following information may help you in collecting the amount of the judgment:
• Inordertocollecionyourjudgmentyoumustobtainatranscnpt(record)ofyourjudgmentfrom
the Conciliation Court and file it in District Court togetherwith an Affidavit of Identification. The
judgment will then be "docketed". There is a $S fee for obtaining that transcript.:
• Upon docketing, you may obtain an Execution from the Cou"rt Administrator. Ao Execution is a
legal paper authorizing the sheriff to levy (coliect) on a' debtor's assets. The most common
assets that can be levied upon are bank accounts and wages. You must be able to provide
detailed information regarding the assets before thesherHf asn make a levy. The feeior an Ex-
ecutlon is $5. Fees expended for the Execution process may be recovered from the De6tor.
• If you do not know what assets the judgment debtor has, you may request the Court to order
the debtor to tell you what those assets are. You can make that rpquest only if:
1. The judgment has been docketed for 30 days.
2. You have not received payment of the judgment.
3. You and the debtor have not agreed to some other method of settlement.
If those provisions can 6e met, the Request for Order for Disclosure form can be obtained from
the Court Admini"strator. A fee is required. It the request is granted, the de6tor will be ordered to
complete and mail to you a listing of his'assets within iD days. Once you have that informa-
tion, you can give the Execution to the sheriff, advise him of the debtor's assets and ask him to
coliect your judgment.
Fiow Do You Appeal a Judgment?
• Any party who was not present at the trial, and who has good reason for not having been pra
sent, may apply to the Court, not later than the date indicated on the "Notice of JudgmenY"
(on the frort of this form) for permission of the Court to re-open the case for another trial. It the
Court grants another trial, the judge may require payment of costs to the other, party, atisolute
or conditional, not to exceed $25.
• Any party who believes this judgment to be incorrect may appeal to the Distriqt Coyrt for a
completely new trial, by a different judge'or 6y a jury if desired. The statutory requirements for
such an appeal must be complied with not later than the date indicated on the "Notice of
Judgment" (on the front of this form). Such requirements are time-consuming and it is
suggested that such inquiries be made well in advance of the date ind'icated.
