As a result of additional research by some of the affected property owners and City staff,
the City Council in official action at the meeting held on November 26, 1999 approved an
adjustment to this assessment roll. The adjusted amount for each affected parcel results
from a different method of calculating the assessment that is considered to be fairer while
still consistent with City assessment policies. The new method assesses the storm sewer
trunk at a per square foot rate of $.082 to a maximum of $2,250 per lot. Lots that are
]ess than 25,610 square feet in size will receive a reduction in the assessment. If you are
interested in the calculation, the reduction equals $2,250 minus your lot size times $.082.
The reduction for your parcel equals $808.50.
Since you chose not to prepay the assessment, we will make an adjustment to the records
at Dakota County and your annual payments will be somewhat smaller over the 15-year
period of collection.

This Assessment Deferral and Settlement Agreement ("Agreement") is made this 2-4day
of J u L-Y , 1999, by and between NADER NOORYSHOKRY and GITY NOORYSHOKRY,
husband and wife, (hereinafter "Landowners"), and the CITY OF EAGAN, a Minnesota municipal
corporation (hereinafter "City") (hereinafter collectively referred to as the "Parties").
WHEREAS, Landowners are the fee owners of property located in the City of Eagan, County
of Dakota, State of Minnesota and legally described as:

WHEREAS, as part of Public Improvement Project No. 663 (hereinafter the "Project"), the

WHEREAS, the Parties aze desirous of resolving the Assessment Appeal upon the terms and
conditions contained herein.
NOW, THEREFOAE, in consideration of the mutual promises contained herein and other
good and valuable consideration, the receipt aitd sufficiency of which are hereby acknowledged. thr
Parties do hereby agree as follows:

The Defened Assessment shall be deferred without interest until
July 31, 2001, and shall thereafter accrue interest at the rate oY six
and one-halF percent (6 'h%) per annum. Said deferment shall
end if the Property is sold or until December 31, 2011, whichever
occurs first.
Then, the Deferred Assessment shall be payable over a term of five
(5) years at six and one half percent interest per annum (6 'h% per
annum).
Waiver. The Landowners hereby waive their right to object or appeal to the
Immediate Assessment or the Deferred Assessment, pursuant to Minn. Stat. §429.081
and fiirther waive notice of heazing on this Agreement.
4. Settlement of Assessment Auneal. The Parties shall execute a Stipulation of
Dismissal With Prejudice, dismissing the assessment appeal.
5. Binding Effec . This Agreement shall be binding upon and inure to the benefit of the
Parties' heirs, successors and assigns and shall run with the land.

"Landowner", and the CITY OF EAGAN, a municipal corporation, organized under the
laws of the State of Minnesota, hereinafter referred to as the "City".
WITNESSETH:
That the Landowner, in consideration of the sum of One Dollaz ($1.00) and other
good and valuable consideration, the receipt and sufficiency of which is hereby
aclmowledged, does hereby grant and convey unto the City, its successors and assigns, a
pernlanent drainage and utility easement, over, across and under the following described
premises, situated within Dakota County, Minnesota, to-wit:
An easement over, under, and across that part of Lot 1, Block 1,
JOSEPH A. SPANDE 15T ADDITION, according to the recorded
plat thereof, Dakota County, Minnesota, lying westerly of the
easterly 10.00 feet of said Lot 1, lying northeasterly of the
southwesterly 55.00 feet of said Lot 1, lying northerly of the 25.00
foot wide drainage and urility easement dedicated on said Lot 1 and
lying southerly of a line described as commencing at the northeast
